Julie,
I checked with our stormwater group about changes they have made to their rules for single-family
residences. They require a deed restriction indicating the stormwater bmps location and that the drainage and
bmp must be maintained. However, they do not require an easement that connects to the public ROW. So that
will not be required for your variance application.
