Subject: Mitigation Compensation Change Request for the widening of NC 98 (Holloway St.) from east of US 70
BYP to east of Junction Road in Durham County, Division 5, Federal Project No. STP-98 (5), State Project
No. 8.1352401, WBS Element No 35011.1.1, T. I. P. No. U-4010.
The purpose of this letter is to serve as a cancellation notice for the compensatory mitigation requested in a letter dated Apri120,
2006. According to the Apri120, 20061etter, North Carolina Department of Transportation (NCDOT) requested the Ecosystem
Enhancement Program (EEP) provide confirmation for compensatory mitigation for 24 feet of jurisdictional stream impacts.
At the time the compensatory mitigation was requested, it was not understood that the stream impacts on this project would not
require mitigation. Mr. Eric Alsmeyer with the U.S. Army Corp of Engineers (USAGE) and Nicole Thompson with the North
Carolina Division of Water Quality (NCDWQ) visited the project site and detennined that no mitigation would be required for
the 24 feet of permanent stream impacts due to it's minimal function capacity.
NCDOT would like to retract the request for compensatory mitigation for project U-4010. If you have any questions or need
