PROJECT SUMMARY: The applicant has an existing private docking facility with two slips. He is proposing new dredging and relocation of one of the two boatlifts and new construction of a finger pier for private use. ' Field Investigation Report: Francis Hughes Page 02 9. Narrative Description: The property is a 0.67-acre private residential property on Core Creek in the Stanton Landing subdivision off of NC Highway 101 in Carteret County. The owners, Francis and Susan Hughes, wish to dredge around their existing docking facility, relocate a boat slip and construct a finger pier, and are applying for a permit to do so. The parcel lies at 245 Gatsey Lane in the Stanton Landing subdivision on Core Creek in Carteret County. The property fronts the east side of Core Creek, a tributary of Newport River. Core Creek is approximately 375' wide at the project location. There is 90' of shoreline on this property. The current vegetation on the tract mainly consists of well-established lawn grasses. None of the project area has submerged aquatic vegetation or other wetlands present. The elevation of the tract is + 6' nhw. Man-made features on the parcel include riprap revetment, private docking facility, and private residence. The existing docking facility extends 80' waterward of the existing bulkhead and is 101' from the edge of the AIWW channel. The adjacent properties also consist of similar private residences with docking facilities. The Carteret County Land Use Plan has classified this area as Rural, with CAMA AEC's classified as Conservation. These waters of Core Creek are not designated as Primary Nursery Area, and are closed to the harvest of shellfish north of the NC Highway 101 bridge. These waters carry a water quality classification of SA; HQW. The bottom substrate is fine silt, without submerged aquatic vegetation. These waters have an approximate +/-3' lunar tidal amplitude. 10. Proposed Development: The request is for new dredging, relocation of a boatlift and new construction of a finger pier in conjunction with an existing private docking facility. The proposed excavation and construction activity is to take place waterward, to the west, of the existing riprap, and expand the footprint of the existing docking facility on the property. The proposed dredging by barge mounted excavator is of approximately 242 cubic yards of bottom substrate, with one section being 20' long by 90'wide on the outside of the platform and the other section being 46' long by 12' wide on the north of the proposed finger pier, to depths of -6.0' nlw to be disposed of at an upland location off-site by a marine contractor, requiring the prior approval of the DCM. Current soundings in the slips range from -1.8' nlw on the landward edge, down to -7.0' nlw immediately waterward of the docking facility. The existing decked area of the platform is 8' by 45' (approximately 360 sf). The proposed finger pier would be 10' long by 4' wide and would consist of relocating a boat slip with a lift 13' long by 13' wide, both of which would connect to the existing pier and platform. The existing platform would also be reduced to 8' by 40'. This reconfiguration of the existing platform would have no net increase of total platform area. The proposed development would remain outside of the 15' riparian corridor as it is drawn perpendicular to the existing channel. At the terminus of the structure, there is -7.0' of water at nlw. The proposed structure is to be used for private boat docking of 22' and 32' boats. 11. Anticipated Impacts: As proposed, the finger pier will shade an additiona140 square feet of shallow shell bottom habitat, with the boat lift incorporating an additional 169 square feet. There will be 360 square feet of platform area along 90 linear feet of shoreline. No SAV or wetlands were observed in the area and this waterbody is closed to shellfishing. Turbidity impacts should be short term relating to the dredging and bucket removal of 242 cubic yards of fine sand and driving of the pilings. The intended uses include private dockage of marine vessels resulting in a reconfiguration of an existing docking facility. The excavation of the area should prevent future scarring. The proposed structure should not be a hazard to navigation since it will remain within the footprint of the existing structure and will not exceed the established pier length within this creek. The following is my assessment and consequent recommendations of the above referenced proposal: The project, as proposed, will have minimal environmental impacts. Small scale excavation of this type produces only minimal, short-term water quality impacts. Proper dredging of the two existing boat slips will have little impact due to the less productive biological strata, and the fine sand disturbance to water quality will be short-lived in nature. The proposed finger pier and boatlift are within the footprint of the existing structure and pose no threat to navigation. This proposal is not in conflict with the current usage of this tributary of Newport River, and this waterbody should not be deleteriously affected. There is no submerged aquatic vegetation, the waterbody is not a PNA. This area is closed to shellfish harvest. Assuming that state and federal agencies concur with the proposal, I recommend the project be authorized as proposed, contingent upon the following conditions: 1) That the disposal area of the excavated material be pre-approved by DCM before any dredging is to take place; 2) That the structure be strictly for private, non-commercial use; 3) That the docking facility not interfere with access to riparian property with a minimum setback of 15 feet from the riparian property lines; 4) Excavation will not exceed 6.0 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters; 5) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized; 6) No spoil material is to be placed within 30 feet of the normal high water line; 400 Commerce Avenue, Morehead City, North Carolina 28557 Phone: 252-808-28081 FAX: 252-247-33301 Internet: www.nccoastalmanagement.net An Equal Opportunity 1 Affirmative Action Employer-50% Recycled 110% Post Consumer Paper Francis and Susan Hughes January 22, 2008 Page 2 of 2 7) This permit authorizes a maximum of two boat slips at this structure; 8) The authorized structures and associated activity must not cause an unacceptable interference with navigation, and shall not exceed the existing footprint; 9) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. No non-water dependent uses of structures may be conducted on, in or over public trust waters without permit modification; 10) That the total platform area is not to exceed 360 square feet. 11) All excavated materials will be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 12) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 13) Approval of the structure was based on a determination that there would be no obstruction to navigation. Under conditions existing within the AIWW, a possibility exists that the structure may be damaged by wave wash from passing vessels. Unreasonable slowing down of vessel traffic can not be required because such an action would tend to nullify the navigational benefits on which the AIWW was justified. Issuance of this permit should not be construed as relieving the permittee of taking proper steps to ensure the structure and moored boats will not be damaged by wave wash normally to be expected in the AIWW. The permittee shall not hold the United States liable for any such damage. 14)The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. CC: Tere Barrett, DCM Ted Tyndall, DCM PROJECT DESCRIPTION Francis and Susan Hughes 245 Gatsey Lane Beaufort, NC Carteret County The proposed project will serve an existing single-family residence located at 245 Gatsey Lane, Beaufort, North Carolina. The project site is located adjacent Core Creek in the Stanton Landing subdivision. An existing pier with a platform, two boatlifts, and shoreline stabilization were previously installed at the site. The project consists of relocation of one of the existing boatlifts, excavation to accommodate the pier and boatlifts, shortening of the existing platform, and construction of a finger pier. The areas to be excavated measure 90' x 20' and 46' x 12'. The larger area is parallel to the existing platform and will provide better access to the channel for the boat to be stored on the existing lift. The other area to be dredged is perpendicular to the platform and parallel to the boatlift proposed for relocation (see plan drawings). Existing water depths average -3.6 NLW in front of the existing platform and - .5 NLW in the area of the relocated lift. Dredging will result in NLW depths of -6.0 NLW in both areas. A "bucket to barge" system will remove a total of 242 cubic yards of sand and mud. Spoils will be trucked off-site to apre-approved disposal area. The existing platform (45' x 8') will be shortened to measure 40' x 8'. A new finger pier measuring 4' x 10' will be constructed perpendicular to the north end of the shortened platform. An existing boatlift measuring 12.5' x 12.5' will be relocated north of the new finger pier as shown on plan drawings.
