Based on our meeting and my gathering of additional info about the Ordinary High Water Mark (OHWM), width, and depth of the stream from the OHWM, we have decided to apply for the more appropriate NW 18. I walked the sixty-five feet of proposed new stream impacts on April 4, 2016 and found the stream to average between 4 to 7 feet in width from OHWM to OHWM. The depth to the streambed from the OHWM was less than one foot for fifty of the sixty-five feet of new stream impacts and not more than two feet depth for 15 feet of the sixty -five feet of new stream impacts. Using these figures, the cubic yards of impacts was calculated as 7 X 1 X 50 divided by 27 =12.96 cu. yds plus 7 X 2 X 15 divided by 27 =7.77 cu. yds. Therefore, the total cubic yards of impacts equals 20.73. Please note that I used the seven foot width for the entire length of the stream even though most of the sixty-five feet of proposed new impacts had a width of less than 5 ft. Also, the depth from OHWM for most of the sixty-five feet of new stream impacts was less than one foot. I am also forwarding you an e-mail from the hydraulics engineer, Galen Cail, that explains why a culvert extension is believed to be necessary with a corrected impact summary sheet. We are requesting that you please re-evaluate the submitted application under a NW 13 for bank stabilization and a NW 18 for minor discharge. Please let me know if you have any questions or if you require additional information. In reviewing the information I developed a few questions: 1) what is the purpose of the culvert extension? There doesn't appear to be any road widening or shoulder improvements proposed, so please specify why lengthening the culvert is necessary as part of the project. Also, adjacent development was mentioned in one of the attachments. If any non-DOT development is associated with this project, please disclose and specify. 2) Dave Wanucha is correct: unless there is transportation associated with the project then the project won't fit a NWP 14. If purpose and need of the culvert extension can be justified, than perhaps a NWP18 would work for the culvert extension. In this case I need to know the dimensions of the stream channel. It seems that 65 I.f. of channel will be fill for the pipe extension, but I need to know the width of the stream from Ordinary High Water Mark to Ordinary High Water Mark, and also the depth of the stream from Ordinary High Water Mark to the stream bed. This information would allow me to calculate the volume of fill proposed below the Ordinary High Water Mark; a NWP 18 allows a maximum of 25 cubic yards. The rip rap pad and bank stabilization can likely be permitted under NWP 13 for bank stabilization. Another possibility for authorizing the culvert extension is NWP 3, but you would have to show that the fill is a"Minor deviation in the structure's configuration or filled area, including those due to changes in materials, construction techniques, requirements of other regulatory agencies, or current construction codes or safety standards that are necessary to make the repair, rehabilitation, or replacement." Please submit the requested information (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file. Please let me know if you have any questions. Sincerely, Dave Bailey David E.
