Mr. Sigmon,

Per our conversation, please below an email concerning the buffer mitigation requirements. As discussed, the project
will require an acceptance letter for the proposed stormwater pond within the riparian buffer. You had stated that the
City of Greenville plans to request a variance from the EMC from the mitigation requirements. Until either proof of
payment to a mitigation bank is provided or a variance is received waving the mitigation requirements, no impacts
associated with the subject stormwater wetland can occur.

As discussed, under SL 2015-246 Section 13.4(a) (attached) states “The Environmental Management Commission shall
amend its rules for the protection of existing riparian buffers to provide for the case-by-case modification of the
requirements for maintaining woody vegetation in the riparian buffer area upon showing by a landowner that

alternative measures will provide equal or greater water quality protection.” Please contact Jennifer Burdette at

After review of the Pre-Construction Notification application, I will be unable to process it without a buffer mitigation
acceptance letter for the stormwater wetland within within Zone 2. I will place the project on hold until an acceptance
letter is received.
