Thomas ivlcGannon 9. PROJECT DESCRIPTION: The project site is located at 8220 Bald Eagle Lane, adjacent to the Atlantic Intracoastal Waterway and Middle Sound, in New Hanover County. To locate the property from Market Street (NC Highwayl 7), turn onto Porter's Neck Road and travel east approximately 2 miles. At the stop sign, turn right onto Bald Eagle Lane and travel south approximately 0.1 miles. The property of interest is located on the left. The lot is approximately 0.64 acres and averages 20 feet above mean sea level. The applicant's property consists of a two-story single-family residence and a swimming pool with associated decking and concrete wall around the pool area. The 90' of shoreline is stabilized by a wooden retaining wall. Upland vegetation consists of ornamental landscaping, maintained lawn grass and hardwood species, primarily Oak Trees. Waterward of the retaining wall, the vegetation transitions into the high marsh of mixed coastal wetland and "404 type" vegetation including: Marsh Elder (Iva frutescens), Grounsel-bush (Baccharus halimifolia), Sea Ox-eye (Borrichia fruteseens), and Salt Meadow Grass (Spartina patens), which covers an area of approximately 50' in width. Low marsh consists primarily of Smooth Cordgrass (Spartina altern~ora), which covers an area approximately 50' in width to the AIWW and Middle Sound. Waterward of the pool area and retaining wall is an elevated platform that leads onto a private pier, measuring approximately 184' in length by 6' in width, which extends towards the AIWW in an easterly direction. The pier terminates into a gazebo, measuring 16' in length by 16' in width. Waterward of the gazebo is an uncovered platform, measuring 8' in length by 16' in width. Located on the landward side of the gazebo and the southern side of pier is an existing 10' in length by 8' in width platform/fish cutting area that leads onto an access ramp to an existing floating dock, measuring 8' in length by 32' in width. The floating dock runs perpendicular to the shoreline and the AIWW. Located between the floating dock and the gazebo and platform is an existing boatlift, measuring approximately 18' in length by 15' in width. The application states that the existing docking facility currently accommodates two (2) vessels in approximately -2' to -6'@ normal low water (NLW). The New Hanover County Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW and Middle Sound are classified SA- ORW by the Division of W ater Quality. The area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to reconfigure an existing private docking facility adjacent to the AIWW. The application states that the existing platform/fish cutting area, measuring 10' in length by 8' in width would be removed. A new finger pier, measuring 10' in length by 4' in width would be installed within the footprint of the platform. An access ramp would lead to a new 40' in length by 6' in width floating dock, which would replace the existing floating dock, measuring 32' in length by 8' in width. The existing boatlift would be replaced with a 16' in length by 16' in width boatlift. The application also states that asingle-pole boatlift, measuring 6' in length by 6' in width would be installed on the southern side of the pier, landward of the finger pier. The application states that the proposed reconfiguration would accommodate three (3) vessels. 10. ANTICIPATED IMPACTS: The proposed reconfiguration would incorporate approximately 536 sq. ft. of Estuarine Waters and Public Trust Area. The proposed structure would accommodate up to three (3) vessels. Minor increases in turbidity should be expected during construction. The existing docking facility extends approximately 90' into a waterbody, which measures approximately 600 feet across. This existing distance conforms with the 1/4 width distance rule and the established pier length. As proposed, the applicant's proposal would not encroach into the 80-foot setback frotn the AIWW and the adjacent riparian corridor 15' setback requirement. Submitted by: Robb L.
