On -Site Determination for Applicability to the Neuse Riparian Area Protection Rules (15A NCAC 02B.0233)
Dear Ms. Christensen:
On March 14, 2016, the Division of Water Resources (DWR) received your request to appeal an on-site
determination made by Cherri Smith of the DWR Raleigh Regional Office as provided in 15A NCAC 02B
0267(4)(cl). On March 30,2016, Niki Maher and Mac Haupt of DWR conducted an on-site determination
02B 0233).
The seven features that were evaluated are labeled bysite onthe attached map initialed by Niki Maher on
March 31, 2016 as follows (naming convention similar to that used by Ms. Smith in her determination):

• A. fire break ditch a Pond
• B. downstream a G2.
During their review, Ms. Maher and Mr. Haupt evaluated the features using the DWR Stream Classification
Form. Feature Awas evaluated tohave ascore of12.5atthe natural channel site, and a score of 15 at the
fire break ditch site umthe DVVRform. Feature Bwas evaluated mohave ascore ofI8.5at the downstream
site and a score of15.5 at the upstream site on the 0VVRform. Feature Cw/as not evaluated using the
form, asthere was nnevidence ofastream feature unthe ground. The pond was observed tobe|nhigh
ground, not imanatural valley. Feature G2was evaluated 10have ascore of4onthe DVVRform. The
form states that if the score is "greater than or equal to 19 points the stream is at least intermittent."
The DVVRhas determined that the features labeled /,B,[and G2onthe attached map are °ephemeral"
and not subject tothe Neuse Buffer Rule. The QVVRhas also determined that the pond isnot subject tn
the Neuse Buffer Rule.
