On behalf of KB Homes -Carolinas Division, we would like to request an appeal of the Stream
Determination issued by the Town of Chapel Hill on March 15, 2016 for the property located at
the 2516 Homestead Rd in Chapel Hill, Orange County, NC.
Project Description
The property is currently a ±8.0 acre private residential tract located at 2516 Homestead Rd in
Chapel Hill, NC (Orange County PIN#9880-02-8073). The initial field delineation was conducted
by Troy Beasley and Lyle Phillips of WithersRavenel (WR) on Dec 29, 2015. A request for
verification of the stream delineation was submitted to Town of Chapel Hill on Jan 29, 2016 for
the purposes of determination of the location and extent of the Jordan Lake Stream Buffers. The
stream determination letter was issued by the Town on March 15, 2016, and has been provided as
an Appendix to this letter.
Basis for Appeal
We are specifically appealing the Town of Chapel Hill's determination that there is a stream
channel between WR's Flag S-1 Stop Channel and Flag S -1A Start Channel, as shown in the
exhibits included with the WR Stream Determination Request which has been provided as an
Appendix. Town staff flagged an additional stream channel between Flags S-1 & S -1A as shown in
the exhibits of the Town's Stream Determination Letter. The Town's flag numbers along the
additional stream channel consisted of Flags TOCH 11 though TOCH 18.
The additional section of stream flagged by the Town is situated within a jurisdictional wetland
(verified 1/27/2016 by David Bailey of the US Army Corps of Engineers), where a clear break in
the stream pattern and profile occurs. The stop point of the stream (Flag S-1) was identified by
WR based on the lack of common stream parameters, particularly bed and bank. WR determined
the stream to restart where the bed and bank reformed (Flag S -1A). As no definitive channel was

present, other scoring parameters could not reasonably be applied to the additional stream
section flagged by the Town.
Martin Richmond with our office (formerly with NCDWR) conducted an additional site visit on
03/14/16 to score the additional stream channel flagged by the Town of Chapel Hill using the
NCDWR "Methodology for Identification of Intermittent and Perennial Streams and Their Origins
(Version 4.11)". Based on Martin's review, the segment of additional stream flagged by the Town
of Chapel Hill scored 16.5 points, which is below the 19 points necessary to be considered an
intermittent stream subject to buffers. More importantly, there was no bed and bank present
beneath the Town's flags delineating the stream location. Please note that the additional stream
flagged by the Town was liberally scored, as there was no distinct channel in which to observe the
parameters to be scored.
For your review, we have included the following:
• The Town of Chapel Hill Stream Determination letter issued 3/15/2016;
• The original stream determination request submitted 1/29/2016 by WithersRavenel to
the Town of Chapel Hill;
• Email from Dave Bailey with the Corps of Engineers documenting the approval of the
wetland delineation;
• A Stream ID form completed by Martin Richmond with WithersRavenel on 03/14/16 for
the additional stream flagged by the Town of Chapel Hill and email explaining the results
of the review of the additional stream;
• Photos taken during Martin Richmond's assessment of the additional stream on 03/14/16
depicting site conditions.
• Agent Authorization and Access Authorization forms for the project.

As requested, the Town Public Works Department has performed a stream determination on the
property identified on the attached forms. This determination indicates whether different types of
streams (perennial, intermittent, and/or ephemeral) or perennial waterbodies are present on the
property in question or nearby properties. These streams and their classifications are shown on the
accompanying map. Stream segments regulated by the Jordan Lake Stream Buffer ordinance are
highlighted. Locations of all features on the map are approximate and must be field
surveyed for precise location.
This stream determination information is used to determine the location and extent of the Resource
Conservation District and Jordan Lake Stream Buffer. Specific land use regulations and
restrictions apply within the boundaries of these protected areas. If you are considering any kind of
work on your property, including clearing vegetation, paving, grading, or building, please consult with
the Town Planning Department to determine the possible extent of the Resource Conservation
District and Jordan Lake Stream Buffer on your property and corresponding regulations.
This classification will remain in effect for five years from the date of the site visit before a request
for reclassification will be considered, unless the stream channel characteristics are significantly
altered as a result of watershed changes.
In accordance with the Town's procedures, you may appeal this administrative decision to the Town
Manager. If you wish to do so, you must file your written appeal accompanied by any materials you
believe support your appeal, within 30 days of receipt of this letter.

you if a new stream determination will not be needed for a property and provide copies of the relevant
prior records. Turnaround time is one to three business days. There is no fee for stream determinations.

not required. No new site visit will be made if a determination has been done in the last 5 years.
Turnaround time is two weeks for single-family lots depending on weather conditions and staff availability,
and longer for larger lots.

404. My only comment is that the revised sketch you sent states that I verified the waters on-site on 1/26/2016, when it

This email is in follow-up to your review of the wetland delineation of the ±8.1 acre property located at 2516 Homestead
Road in Chapel Hill, Orange County. At the site review, you approved the wetland limits as delineated with no changes.
The only change was that the onsite pond was determined to be jurisdictional. The approved delineation is depicted in
the attached exhibit.
We understand that it could be several months before the actual Preliminary Jurisdictional Determination is issued. In
order to provide documentation that the delineation has been approved for upcoming municipal submittals, will you
please respond to this email concurring with the delineation as depicted in the attached exhibit.

2516 Homestead Rd (02150552.00) - Site visit update
We scored the downstream section, below Flag S -1A, for approximately 40 ft (this section is off-site). This stretch scored
28.5, and we found mayflies, which equals perennial. We used this as a reference for the upstream section.
We then looked at a section above Flag S-1. We did not score this, as the score would be approximately the same as the
downstream stretch. This was also perennial based on indicators.
We then score the reach between Flag S-1 and Flag TOCH i2. This reach scored a 16.25 based on the DWQ Stream ID
Method. However, this section is not 'ephemeral' in the classic sense of a headwater stream, due to the fact this area is
a jurisdictional wetland. There was water moving through this area as the stream splayed into the wetland, but there
was no true channel in this area which would enable the scoring method. Items dependent on channel are generalized
(i.e. substrate, sinuosity, headcuts, grade control, iron bacteria, plants in the streambed, and macrobenthos) in order to
accommodate the scoring method; however, using the flags as a located channel, the score was below 19.
Of note: The bed & bank scored 'Absent', as did sinuosity, riffle -pool structures, substrate particles, depositional bars,
headcuts, grade control, and iron bacteria. Scored items include: active floodplain (strong), alluvial deposits (weak),
natural valley (weak, and only based on upstream drainage area —there is no water flowing streamside into this area),
baseflow (assumed strong, since this is a wetland), leaf little (moderate), sediment on plants (strong), wrack lines
(moderate), and soils. Also, in the area between Flag S-1 and Flag TOCH i2, there was fescue grass emerging and some
saplings (rooted plants in the 'channel'. I believe there were some FAC -Wet plants also emerging in the wetland, so we
added 0.75 pts.
Total score for this reach was 16.25.
The other sections flagged by TOCH extending down to Flag S -1A were similar and thus would score approximately the
same.
I'll go ahead and finalize the scoresheets and include them with the on-site pictures. Let me know if you have other
questions.
