Good afternoon Dave.

I wanted to let you know that we are appealing the stream determination on this site, specifically the additional stream
channel delineated with Town flags TOCH I1 – I8. Per the instructions in the Stream Determination Letter, the hard copy
of the attached Appeal Request will be delivered to Roger Stancil tomorrow via FedEx, but thought I would provide you a
courtesy copy and just give you a heads up that we are appealing the call.

Also, please note that there is an error on the aerial exhibit in the original Stream Determination Request that we
submitted, as Stream 1 was erroneously labeled as intermittent, when it is actually perennial. I just wanted to make it
clear that we are not contesting that Stream 1 is perennial upstream of Flags S-1 and downstream of Flag S-1A.
