PROJECT DESCRIPTION: The project site is located in The Beach at Bricklanding Subdivision, between 1933 and 1937 Stone Ballast Way SW, adjacent to the Atlantic Intracoastal Waterway (AIWW), on the mainland side of Ocean Isle Beach, in Brunswick County. To find the property from Shallotte, travel south on NC Highway 179 approximately 4 miles to Brick Landing Road. Turn left onto Brick Landing Road (NCSR 1143) and travel approximately 1.2 miles to Goose Creek Road SW. Turn right onto Goose Creek Road SW and travel <0.1 miles to The Beach at Bricklanding Subdivision. Turn left onto Stone Ballast Way SW and travel approximately <0.1 miles to the project site, which is located on the left between 1933 and 1937 Stone Ballast Way SW. The project site is located within an existing 16-lot subdivision and consists of a vacant parcel, which is designated as common area, totaling approximately 2.22 acres. The project site is bordered by residential property to the north, east and west and the AIWW to the south. The property measures approximately 240 feet deep (measured from NHW) by approximately 415 feet in width, with approximately 415 feet of shoreline frontage. The property has an average elevation of approximately 8 feet above Mean Sea Level. Upland vegetation consists of lawn grasses, landscape shrubs and Southern Wax Myrtle (Myrica cerifera). Waterward of the upland vegetation is an area of high marsh, which varies in width from approximately 10' to 15', consisting of mixed coastal wetlands, and "404 type" vegetation, including Wax Myrtle (Myrica cerifera), Salt Meadow Grass (Spartina patens), Glasswort (Salicornia spp) and Spike Grass (Distichlis spicata). There is a band of low marsh measuring approximately 30' to 40' in width, which consists primarily of Smooth Cordgrass (Spartina alterniflora). The applicant received a CAMA Major Permit (No. 49-89) on March 3, 1989 for the development of the subdivision. It appears that a Modification to State Permit No. 49-89 was issued in October 1992 for the construction the existing pier and "T-head". The existing pier measures approximately 6' in width by 130' in length and extends in a southerly direction into the AIWW and terminates in a "T-head" measuring approximately 10' in width by 48' in length. The applicant states that approximately 6 sq. ft. of the existing "T-head" platform encroaches into the adjacent riparian corridor to the east. However, the proposed addition would be located on the west end of the existing "T-head", approximately 20' from the 15' riparian corridor setback line. The Brunswick County Land Use Plan classifies adjacent waters as Conservation and the adjacent high ground portion of the project area as Residential. The waters of the Atlantic Intracoastal Waterway are classified as SA, HQW by the NC Division of Water Quality. These waters are NOT designated as Primary Nursery Area (PNA) by the NC Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to add an access ramp measuring approximately 3' in width by 16' in length and a floating dock measuring approximately 8' in width by 20' in length to the existing "T-head". The access ramp would be located on the west end of the existing "T-head" and would extend in a westerly direction down to the proposed floating dock, which would extend parallel to the shoreline in a The Beach at Bricklanding Property Owners Page 3 westerly direction. As proposed the floating dock would not extend beyond the existing "T-head" and would provide dockage for two vessels resulting in a two-slip facility. The application states that the water depth at this location ranges from approximately-4.75' to approximately -6.5' at Normal Low Water (NLW). 10. ANTICIPATED IMPACTS: The addition of the proposed access ramp and floating dock would incorporate an additional 208 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed floating dock addition would not encroach into the adjacent 15' Riparian Corridor Setback Area or the 80' USACE Federal Channel Setback. Minor increases in turbidity should be expected during construction. The proposed floating dock addition would extend an average of approximately 104' into the waterbody, which measures approximately 420' across. This distance conforms to the 1/4 width rule. The existing pier is located along the Intracoastal Waterway north of Shallotte Sound and approximately 0.5 miles northwest of Shallotte Inlet in Brunswick County, North Carolina. Waters in the vicinity of the property are classified as SA, HWQ (High Quality Waters) by the North Carolina Environmental Commission (EMC). The existing pier is 6 ft wide and 130 ft long and terminates at a "T Head" that is 10 ft wide and 48 ft long. Water depths in the vicinity of the proposed aluminum ramp and floating dock range from -4.75 ft NLW to - 6.5 ft NLW, therefore, no dredging will be required. The Atlantic Intracoastal Waterway in this area is approximately 420 ft wide. The center of the U. S Corps of Engineers navigational channel is approximately 175 feet and the near edge 80 ft setback is approximately 40 feet waterward of the exiting docks terminus. The proposed modifications to the existing pier includes the addition of an 8 ft x 20 ft floating dock with 2 temporary slips and an aluminum 3 ft x 16 ft access ramp. The floating dock will be privately owned and utilized solely by The Beach at Bricklanding Property Owners and their guests. No commercial activities or services are proposed. No parking will be constructed and the proposed project involves water-dependent structures only. There will be no additional upland development.
