We received your correspondence electronically on Monday, January 14, 2008 and are providing the enclosed information in response to this request. Please note that the Carolina Ecosystems, Inc. address in the Request is incorrect and for some reason the applicant, Apex First Development, did not receive the certified mail copy of the Request. Each requested item is shown below in italics, with our corresponding response. 1. Please provide documentation from the USACE authorizing placement of a stormwater BMP in a jurisdictional wetland. As described in our cover letter and permit application, the USACE determined that the wetlands in Site 5, the location of the BMP, were isolated and not under the jurisdiction of the Clean Water Act. This wetland area was confirmed as isolated by your staff on September 7, 2007. The impact sheets provided identify the areas as wetlands, but the cover letter and PCN clarify that these are isolated wetlands. Therefore, no authorization from the USACE is required for the placement of this BMP. We discussed the potential location of this BMP with your staff on September 11, 2007 during apre-application meeting for this project. At that time, we were unaware of any issue with this location of the BMP. The isolated wetland is located within a drained pond in an upland area of the site with no direct connection to downstream jurisdictional resources. As described in the permit application cover letter, the proposed stormwater design avoids any impact to resources under the jurisdiction of the Clean Water Act, but it was deemed impractical to avoid this isolated wetland and still meet both NCDENR water quality standards and Town of Apex requirements to retain the 25-year storm event on the site. If the ZISACE authorizes placement of a stormwater BMP in a jurisdictional wetland, please address the following: Although no BMPs aze located in jurisdictional wetlands, the following information is provided to assist in your further review of the stormwater management plan. a. All BMPs must be designed in accordance with the most recent version of the NC Division of Water Quality stormwater Best Management Practices Manual. BMPs have been designed in accordance with the Manual, and also to meet Town of Apex requirements. The supplement forms, checklist, and additional design information provided in the application or attached to this letter will allow full review of this stormwater management plan. A meeting is being scheduled with your staff and the Town to discuss any discrepancies between their requirements. b. If more than one stormwater BMP is proposed, please include a separate BMP Supplement Form for each proposed BMP....Please include both the Design Summary and the Required Items Checklist along with all the required items listed herein. Separate BMP Supplement Forms for each BMP were included in the Attachment 6 of the permit application, but the required items checklists were not. Five copies of the Required Items Checklists are attached. In addition, supplement forms and backup calculations are provided for the level spreader and bypass swale associated with wet detention pond 6, which were not included in the original application. c. Please incude a signed and notarized Inspection and Maintenance Agreement Form for each proposed BMP Signed and notarized Town of Apex Maintenance Agreements were provided in the permit application. These Agreements address the same issues as the NCDENR example forms, and are required by the Town of Apex. d. Please provide an agent authorization letter for the application signature. An agent authorization letter was included in the permit application directly behind the signed PCN form. Five copies of this letter are attached for your convenience. 3. Please submit an overall site plan on a full plan sheet at the largest scale available. Five copies of the full size overall site plan aze attached. In order to allow easier navigation of the stormwater section of the permit (not including the additional information attached to this letter), we have included a stormwater Management Plan Summary Sheet for that section to show how the materials are organized.
