The e�isting 20' W s 20.5' L timber bridge needs to be replaced due to deterioration and structural deficiency. The proposed replacement structure �vill be a 14' W s 2.5' H x 74' L bottomless reinforced concrete box culvert on the esisting location and 145° skew. SR 1348 is a dead-end road, so st�ge construction will be used to route h�affic during consh�uction. A short chTnnel relocation is proposed upstream of the bridge to eliminate a sh�rp bend in the stream chTnnel that is near the road shonlder aud to align the culvert inlet with the streTiu. Enclosed are a PCN �pplicatiou, Preliminary Jurisdictional Form, SHI'O forms, plan sheets showing the proposed work, a USGS quad mep, photographs, and other pertinent project informntion. The North C�rolina Natw al I Ierit�ge Program database was checked for records of threateued and en<iangered species. There are 51 species listed for Haywood County that have federal status. The bog turtle (Gl}premys inrihlenbergir) is listed as threateued due to siinilarity of �ppearance to the listed uorthern bog turtle. Bald eTgle (Ilnlrneetris leucocephalus) is Iisted under the BTId and Golden Eagle Protection Act (HGPA). Nine species, Carolina northeru flying squirrel (Glctticoii���s sabrinus colorolus), gray bat (Al��otrs grisescens), Indiana bat (d�I��otis sodrdis), nortl�ern Iong-eared bat (�Ltyolis seplenh•ionnlis, NLEB), Appalachian elktoe (dlnsmidonla rm�eneliann), spruce-fir moss spider (1llicrohesrn•n nionliv��gn), small whorled pogonia (I.solria merleoloirles), spreTding avens (Gemn rndinhm�), and rock gnome licheu (G��nnrorlerurn linern•e), are known from current records aud are listed as either threatened or endangered. According to the USFWS, Haywood County is now considered occupied sununer range for Indiana bats aud NL�F3. Appalachian e(ktoe are found in some well-osygenated streTms with moderate to f�st flowiug �vater and stable, mised substrates of silt, sand, gravel, and/or cobble. Streams th�t suppoit this mussel are typically much larger than L�urel Br�nch. The bridge is 035 miles upsh�eam of the Pigeon River aud this reach of the river is over 17 river miles do�vnstreaiu of occupied mussel habitat. With rare exception, gr�y bnts roost in c�ves year-round and Indi�na bats ancl NLEB wiuter in caves or mines with stable, but not freezing, cold temperatures. This project only involves a small bridge replecement, so construction �vork will not extend far from the e�isting right-of-way into areas where caves could occur. Therc �re no caves or mines visible near the bridge Tnd, accading to USGS data, the nearest imderground mine is over 3.2 miles eway. Therefore, gray bats and liibernating [ndiana bats and NL�B will not be affected by the project. In summer, IndiTna bets and NLEB generally roost on structures or under the loose bark of trees, either dead with peeling bark or cavities, or live trees with shaggy bark such as white oak, maples, sycamore and hickories. The bridge �vas surveyed on June 1, 201 S and there were uo roosting bats or any evidence of bat us�ge (i.e. staining or guano). The sh ucture is only 2-3 feet above the water surface and veiy cool uuderueath. There are uo kuown NLEB hibernacula or m�ternity roosl trees �vitliin 0.25 mile or I SO feet, respectively, of the bridge site. Therefare, the project should be consisteut with e�ceptions for iucidental tAke outliued in the NLEB Final 4(d) rule which went into effect February 16, 2016. The consh uction work m�y require the removal of 6 I�rge bradford pear h ees near the bridge. To protect Indiana bats, any obstructing trees will be removed from October 15 to April IS (�vinter clearing). With this measure, we recommend a "mny �ffect, �mt lilcely to adverselV affecY' determination for Indiana bat. Small whorled pagonia generally occurs in open, dry, deciduous woods with acid soil, tliough habitats can include slopes along streams and mesic forest with white piue and rhododendron. Land use adjacent to the bridge consists of maintained road shoulders, a lawn, a driveway, �nd a goat pasture. There is a narro�v fringe of wooded habitat �long the stream do«mstream of the bridge, but this are� is damp �nd heavily shaded with rhododendron. No small �vhorled pagonia were seen on site visits. And, the nearest record for this plant is over 8 miles fi'om the project. The Carolina northeru flying squirrel, rock gnome lichen, spruce-fir moss spider and spreading avens are found in spruce-fir forests and other isolated high elevation loc�tions in western North Carolina. However, rock gnome lichen is an e�ception because it can occasionally be found at lower elevations in deep river gorges �vith high humidity or on some vertical rock faces that are periodically wet The bridge site has an elevation of only 2,440 feet �nd lacks rock faces �nd other habitat couditions required by these speeies. The project is limited in scope. �rosion and sedimeutation control measures will be implemented to minimize adverse effects of the work on aquatic habitats. Habitats for listed species appear lacking at the project site and none of these species were obseived dw�ing field visits. For these reasons and those discussed above, we recommend that a determivation of"no effect" on listed species apply to this project, escept for NLEB and IudiTna bat as described above. Tl�is praject �vas reviewed by NCDO'I"s Human Environmeut Unit in 201 1. Swveys were not required for historic erchitecture or archaeology �vith determinations of "no effecY' (see attached forms). NCDOT best management practices �vill be used to minimize and coutrol sedimentation �nd erosion on this project Tlie construction foreman will review all erosion control �ueasures daily to ensure sedimentation aud erosion ca�trols are being effectively controlled. If the devices are not functioning as intended, they will be replaced inunediately with better devices. The channel is well defined �viUi a subsh�ate of sand, silt, cobble and bedrock aud is approsimately 8 feet in width. The sh•eam has sufficient flow to support fish and other aquatic life. Laurel Branch flows to the Pigeon River. The Yigeon River meets the definition of a Traditional NavigeUle Water ('I`NW). For these reasons, we believe Lat�rel Branch is a Relatively Permanent Water (RPW) and is under the jurisdiction of the U.S. Army Corps of Engineers. Erosion and sedimenlation measures will be installed. A shorl channel reach will be changed to protect lhe road shoulder and betler align with the culvert inlet. Once complete, lraffic will be placed on part of lhe new culvert and the old bridge will be removed. The new culvert will then be completed downstream. Additionally, no existing National Register of Historic Pfaces (NItIIP), State Study Listed (SL), Locally Designated (LD), Determined Eligible (DE), or Swveyed Site (SS) properties are positioned within or proximal ro the defined archaeological APE. This soil type is described as a shongly sloping, very deep, well-drained soil in coves, toe slopes, and on benches of intermountain hills with stones and boulders scattered across the surfaces of these areas. The WoC type is bordered to the east and west by (BsE) Brasstown-Junaluska complex-30% [0 50% slopes. This datn, along with ropography of ihe project area, enforces low archaeological site probabiliry as most historic and prehistoric settlement is typically confined to land surfaces and slopes of less than 6%.
