JAY ZIMMERMAN Do,, 1"r DWR # 16-0196 Guilford County On February 29, 2016, the Division of Water Resources — Water Quality Programs (Division) received your application dated February 26, 2016, requesting a 401 Water Quality Certification / Individual Water Quality Certification from the Division for your project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. According to the parcel information provided in the application, the current owner of the parcel is NAME. Pursuant to 15A NCAC 02H .0502(f), when the applicant (NAME) does not have title to the property, documentation must be provided that the applicant has been authorized by the owner to apply for a certification. Please provide that documentation. 2. Please provide the Division a copy of your response to March 17, 2016 letter from the U.S. Army Corps of Engineers requesting additional information. [15A NCAC 02H .0502(c)] 3. Please provide a Jordan Lake Buffer Authorization or Variance from the local delegated municipality to document that impacts to the protected riparian buffer are in accordance with the approved local ordinances. [15A NCAC 02B .0267(7)(b)] 4. Please provide a copy of the locally approved stormwater management plan with proof of approval. [15A NCAC 02H .0506(b)(5) and (c)(5)] 450 W. DWR# 16-0196 Request for Additional Information Page 2 of 2 Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. The return of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please respond in writing within 30 calendar days of receipt of this letter by sending two copies of all of the above requested information to the 401 & Buffer Permitting Unit, 1650 Mail Service Center, Raleigh, NC 27699-1650. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
