Sullins, Director Division of Water Quality January 17, 2008 DWQ Project # 06-0659 Wake County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Jeffrey Smerko Trenton Road, LLC 105 Quail Ridge Road Wilmington, NC 28409 Subject Property: Trenton Road Subdivision Richlands Creek [030402, 27-33-11, C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Smerko: On December 18, 2007, the Division of Water Quality (DWQ) received your application dated December 18, 2007, to fill or otherwise impact 0.0004 acres of 404/wetland, 40 linear feet of perennial stream, and 4,241 square feet of Zone 1 Neuse River basin protected riparian buffers and 2,517 square feet of Zone 2 Neuse River basin protected riparian buffers to construct the proposed residential development. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: The filter strip for the level spreader located at the outlet of FES 40 appears to be too steep to allow for diffuse flow based on the incomplete topographic lines depicted on Figure 3. Please EITHER relocate the level spreader to a location with appropriate slopes in the filter strip OR provide a BMP that removes 30 or more percent of the nutrients rather than using a level spreader. If you choose to provide a BMP, please provide a DWQ BMP Supplement Form with all required items. For the proposed dry detention pond and the other two proposed level spreaders, please provide an up to date DWQ BMP Supplement Form with all required items so that the DWQ may review those designs (available on the web site above). Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
