In addition to unresolved violation issues, practical alternatives, minimization and avoidance efforts, and mitigation, there are also serious stormwater issues associated with securing a State stormwater Management Permit and a 401 Water Quality Certification from DWQ as previously discussed. Please coordinate the meeting date and time with Cyndi Karoly and Ian McMillan out of the DWQ 401 Oversight and Express Unit in Raleigh. One of them will be happy to attend the meeting in my absence. In regards to the delineation and the plan sheets you have emailed; I have concerns about Sheet 3/Searay Lane. I believe that this was the area that we (Noelle and I) had concerns that the upland area between the two wetland pockets was actually fill resulting from the historic sewer line (unauthorized activity) installation. I found the old file on the enforcement action and notice that Angie Pennock had issued an after-the-fact NWP 39 verification for 0.333 acres of wetland fill for roads; however, the permitted areas are not for Searay Lane. So, this may be an additional unauthorized activity; I recommend you discuss this with the Town. We need to track down the when, who and why this area is filled. Also, I cannot find any record that the Town made payment to EEP (then WRP) for their compensatory mitigation. If not, that's a permit non-compliance that needs to be addressed. Based on the last field inspection, I am comfortable with the wetland line you had flagged, so I do not see any need for an additional site visit - the only concerns now are with what is permitted fill versus non-permitted. As far as the Town's project, if you/they want to wait for a meeting to discuss the permitting process again, that's fine. One alternative would be to submit an IP application to get the process and project review started; which I would actually recommend. Going through the formal permitting process will "flush out" any of the outstanding issues with respect to the old permit, historic fill, alternatives, purpose and need, and secondary and cumulative impacts and, in the long run, probably save the Town time. The ditch that runs parallel to Snapper Lane has been flagged and surveyed but has not been incorporated in this revision. Given the ditch's proximity to the current road and the width of the current road, the plans propose filling or piping the feature. This ditch will be shown on the survey that I will send to you as well. Kevin Martin (S&EC) was the original project manager during the issuance of the NWP 12's. Due to its potentially precedent setting issues (e.g. roads having been platted and lots having been sold in the 1930's prior to the Clean Water Act of the 1970's), Kevin has asked that we hold a meeting with Kevin, Bob Zarzecki, and I from S&EC and you, Keith, and Ken from the USACE as well as the project engineers and representatives from the Town. It would be great if we could have the office meeting the same day as our site meeting (April 26th), but if that does not work with your schedules please let me know a date that does. I've attached a copy of my notes from that meeting in pdf format. Most of the meeting centered around the wetlands issues, but stormwater was discussed at the end. Because of all the piping they wanted to do to reduce flooding, the best solution appeared to be constructing roadside swales over top of the piping and installing raised inlets in the swales to force some detention time. They wanted to use an existing lake, but the Corps claimed jurisdiction. Noelle and I both determined that for a situation like this, a stormwater permit would be required if the disturbance exceeded 1 acre. If there are no lots involved, the permit they would apply for is the "Other" permit for public roads and bridges, which requires them to: 1)minimize the BUA; 2)direct runoff away from surface waters; and 3)employ BMP's to minimize water quality impacts. Adding lots to the mix would be a low density or high density subdivision permit, wherein the developer kept the overall BUA under 250 or 300 (depending on location & receiving stream classification) or provided an engineered system to treat the runoff.
