Dear Mr. Barron:
Reference the Department of the Army (DA) permit issued on October 2, 2006, to
Mitch Barron of Newland Communities for impacts associated with the Briar Chapel
Development. This development is approximately 1,589 acres in size and is located west
of US Highwayl5-501, north of Andrew's Store Road (SR 1528), and south of Mann's
Chapel Road (SR 1532), approximately 5 miles south of Chapel Hill, in Chatham County,
North Carolina. Coordinates (in decimal degrees) for the site are 35.8251 ° North,
79.1059 ° West. The site contains several unnamed tributaries and adjacent wetlands of
Pokeberry Creek and Wilkinson Creek, in the Cape Fear River Basin (8-Digit Cataloging
Unit 03030002). In addition, please reference the modification to this permit dated
December 5, 2007, requesting modification to crossings F, G, H, and I in the amount of
163 linear feet of permanent stream impact, 367 square feet of permanent wetland
impact, and 851 square feet of temporary wetland impact. Maps showing this
modification were included as Exhibit E.
Two additional impacts, identified as Crossing C and Utility Crossing 7, were
requested under this modification but were inadvertently left out of the December 5th
approval letter. Wetland impacts for Crossing C are now proposed in the amount of
0.0013 acre of permanent impact, and 0.0006 acre of temporary impact. Utility Crossing
7 impacts are now proposed at 0.2603 acre of permanent wetland impact.
We have completed our evaluation of your request and concur with your request
for a change in impacts associated with your referenced DA permit. Construction
drawings pertaining to this modification are attached to this letter and will act as special
permit conditions. These drawings are also considered supplementary plans of those
attached to the December 5`}' approval letter and identified as Exhibit E. No additional
mitigation is required for this modification.
It is understood that all other conditions of the permit, including the permit
expiration date, remain applicable. This includes the modification items described within
