Responses to your items of concern (DWR Project #20160229) are listed below:
1.Restoration work proposed on the right bank of Wash Creek includes excavating depositional material,
establishment of native vegetation, and installing coir matting. Final grading from the bankfull stage (el = 2130’)
to existing contours will consist of constructing a uniform slope, also commonly referred to as blending.
The drawings submitted as part of the 401 certification show hatching (representing coir matting) crossing the
approximated property boundary. This is a function of AutoCAD, not intentions to work off property. I revised
the drawing to remove hatching illustrating the matting crossing the boundary and a copy is attached. Our staff
surveyor sets grade stakes and delineates the limits of construction when the contractor mobilizes to the
site. These limits include property boundaries. No modifications or equipment use will occur off property.
2.The proposed stream repair includes construction of a rock j-hook. This structure reduces near-bank stress and
results in deposition between the vane and streambank. Velocity and stress is reduced downstream of the j-
hook due to redirecting energy vectors to the center of the stream channel, resulting in a scour pool. The
combination of the rock structure and installation of coir matting will protect the restored streambank until
permanent vegetation established.
The j-hook vane protects the streambank from the streambed elevation to bankfull stage. When flow events
exceed the bankfull stage, flooding begins within the flood prone area. The increased width of the flood prone
area reduces velocity allowing vegetative and matting measures to protect the streambanks.
The fill slope is steeper than optimum but is necessary due to the proximity to a municipal sewer line currently
threatened by the eroding streambank. The restored meander replicates dimensions, pattern, and profile found
in B4c reference reach data and will be stable when vegetation is established. This same reference reach was
used to restore Finley Creek in Hendersonville in 2009 and most recently last Fall on Mill Pond Creek at Rugby
Middle School in Hendersonville. Both projects are very similar to the Wash Creek site except their length was
much greater.

Rachel and Jeff,
On March 4, 2016, the Division of Water Resources (Division) received your application dated February 29, 2016,
requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that
your application is incomplete and cannot be processed. The application is on hold until all of the following items are
addressed:
1.The proposed project is in close proximity to a neighboring property. Please confirm that all activities associated
with this project, including construction, excavation, and planting will occur solely on Jordan Street LLC property
and that all equipment used during the project will be operated from Jordan Street LLC property. If work or
equipment is to occur, or be used, on a neighboring property, the appropriate authorization must be provided to
this office.
2.This office is concerned with the stability of the proposed fill slope on the outside meander bend, particularly
below the baseflow elevation. Given the slope angle and stabilization measures proposed, it is unclear whether
the fill slope will remain stable over the long-term. Please provide justification for the design and any additional
information relevant to the long-term stability of the fill slope.
Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the
proper consideration of the application. If all of the requested information is not received within 30 calendar days, of
receipt of his email, the Division will be unable to approve the application and it will be returned. The return of this
project will necessitate reapplication to the Division for approval, including a complete application package and the
appropriate fee.
