We're replacing Bridge No. 142 (SR 1639) on Tuttle Road in Forsyth with a new bridge. We believe this project can be
authorized under a NW 3 utilizing the Low Impact Bridge process. This is a courtesy copy for DWR.
There is a historic property adjacent to the project. Through consultation with SHPO, it was determined that the project
would have `No Adverse Effect' on the property. See attached documentation.
Also, we committed to a tree clearing moratorium from May 15-August 15 as a conservation measure to avoid
disturbing potential Northern long-eared bats in their summer roosting habitat under the `Interim 4d rule'. However,
with the issuance of the `Final 4d rule', NCDOT will no longer meet the moratorium.
Thus, for the proposed action, NCDOT has committed to the conservation measures listed below:
1) No alterations of a known hibernaculum's entrance or interior environment if it impairs an essential
behavioral pattern, including sheltering Northern long-eared bats (January 1 through December 31);
2) No tree removal within a 0.25 mile radius of a known hibernacula (January 1 through December 31);
and
3) No cutting or destroying a known, occupied maternity roost tree, or any other trees within a 150-foot
radius from the known, occupied maternity tree during the period from June 1 through and including
July 31.
NCDOT has determined that the proposed action does not require separate consultation on the grounds that
the proposed action is consistent with the final Section 4(d) rule, codified at 50 C.F.R. § 17.40(0) and effective
February 16, 2016. Section 7 responsibilities are therefore considered fulfilled.

Description of review activities, results, and conclusions:
Review of HPO quad maps, HPO GIS information, historic designations roster, and indexes was
undertaken on March 27, 2015. Based on this review, there is one Study Listed Property within
the Area of Potential Effects, the Vest-Tuttle Farm (FY2502). A survey was required, and it was
determined that the Vest-Tuttle Farm is eligible for National Register listing. The State Historic
Preservation Office concurred with this finding on July 23, 2015.

Subject: Endangered Species Consultation for Potential Impacts to the Northern Long-eared
Bat from the Replacement of Bridge No. 361 on SR 1639 (Tuttle Road) in Forsyth

As requested by the North Carolina Department of Transportation (NCDOT) in your letter of
July 2, 2015, we have reviewed the natural resources information and biological conclusion with
regard to the federally threatened northern long-eared bat (NLEB) (Myotis septentrionalis) for
the subject project. The proposed project includes replacing Bridge No. 142 on SR 1639 (Tuttle
Road) in Forsyth County, North Carolina. We provide the following comments in accordance
with the provisions of section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C.
1531-1543) (Act).
Habitat for the NLEB exists along the project corridor and has been evaluated for potential
impacts from project implementation. According to the information provided, no caves or mines
were found from a desktop search conducted for the project footprint and within one-half mile of
the project. The only structure that will be demolished was checked for bat use and none was
observed. The closest summer record for the NLEB is more than 50 miles fram the project
vicinity. Potential summer roosting habitat (in the form of forested patches interspersed with
farm fields) does exist within the project area, and some trees will be cleared during project
implementation.
Based on: (1) the negative surveys for wintering habitat, (2) the fact that no sign of bat use was
found during structure surveys, and (3) a commitment by the NCDOT to conduct minimal
tree-clearing and their agreement to a tree-cutting moratorium between May 15th and August 15th
(of any year) for the subject project, we agree that implementation of this project is "not likely to
adversely affecY' the NLEB in the project area. In view of this, we believe the requirements
under section 7(c) of the Act are fulfilled. However, obligations under section 7 of the Act must
be reconsidered if: (1) new information reveals impacts of this identified action that may affect
listed species or critical habitat in a manner not previously considered, (2) this action is
subsequently modified in a manner that was not considered in �his review, or (3) a new species is
listed or critical habitat is determined that may be affected by the identified action.

Project Description: As part of the Low Impact Bridge Program, NCDOT's Division 9 proposes to
replace Bridge No. 142 on SR 1639 (Tuttle Road) over West Fork Muddy Creek in Forsyth County.
Bridge No. 142 was built in 1977, and is considered to be structurally deficient and functionally obsolete.
There may be minor ditch-line impacts, and an off-site detour is to be used during construction. The Area
of Potential Effects (APE) will measure approximately 60 feet to either side of the centerline of the
roadway/bridge and 300 feet from either end of the bridge. Based on these measurements and the size of
the existing bridge, the APE measures approximately 74,499 square feet or about 1.71 acres, inclusive of
the existing roadway and the existing structure to be replaced.
SUMMARY OF CULTURAL RESOURCES REVIEW
Brief description of review activities, Nesults of review, and conclusions:
A map review and site file search was conducted at the Office of State Archaeology (OSA) on Tuesday,
March 31, 2015. An archaeological survey at this particular bridge location has never been conducted,
and no archaeological sites have been recorded within one-hali (1/2) mile of the proposed project. Digital
copies of HPO's maps (King Quadrangle) as well as the HPOWEB GIS Service
(http://gis.ncdcr.gov/hpoweb/) were last reviewed on Monday, Apri16, 2015. Although the boundary for
the Vest-Tuttle Farm (FY2502), a mid to late 19t" century complex, is adjacent to the proposed APE,
intact archaeological deposits associated with this resource are not anticipated within the footprint of the
proposed project. In addition, topographic maps, historic maps (NCMaps website), USDA soil survey
maps, and aerial photographs were utilized and inspected to gauge environmental factors that inay have
contributed to historic or prehistoric settlement within the project limits, and to assess the level of
modern, slope, agricultural, hydrological, and other erosive-type disturbances within and surrounding the
archaeological APE.
Brief'Explanation of why the available information provides a reliable basis for reasonably predicting
that there are no unidentified historic propeYties in the APE:
This is a Federally funded project that will require a Federal permit as well as permanent and temporary
easements. All proposed project activities are to take place within the proposed APE, defined as 60 feet
to either side of centerline and 300 feet from either end of the bridge. Since NCDOT's existing ROW
along SR 1639 (Tuttle Road) measures 60 feet wide, there may be environmental impacts beyond what is
currently owned/maintained by the NCDOT. A 100-foot ROW is being proposed. From an
environmental perspective, the APE falls within ihe Piedmont physiographic region, consists of the
floodplain for West Fork Muddy Creek and the steeply rolling terrain characteristic of the North Carolina

Foothills, and is composed of four (4) soil types: Madison clay loam, 6-10% slopes, eroded (McC2),
Pacolet clay loam, 15-45% slopes, eroded (PcF2), Cecil clay loam, 6-10% slopes, eroded (CeC2), and
Congaree complex (Co) soils, which are flooded frequently for brief periods of time. After comparing the
1964 and 1971 King USGS Quadrangles with the 1986 and 1996 King USGS Quadrangles, it is apparent
that a large section of SR 1639 (Tuttle Road) along with SR 1893 (Priddy Fann Road) was realigned
when Bridge No. 142 was constructed in 1977. Current parcel lines show where the original crossing of
West Fark Muddy Creek occurred, about 180 feet to the north. The Office of State Archaeology (OSA)
has reviewed only one (1) project in the vicinity for its potential to impact archaeological resources. No
archaeological survey was recommended for the small residential development along SR 3990 (Jefferson
Valley Drive); however, OSA did note that there "might've been something there, but they've started so
will clear." The key differences between the two locations are soil composition and topography. The
housing location consists of Cecil sandy loam (2-6% and 6-10% slopes, CcB and CcC) whereas the
proposed bridge replacement project occurs at a narrow stream crossing that's bordered to either side by
eroded soils. In addition, the boundary far the Vest-Tuttle Farm (FY2502) follows its parcel lines, which
explains its proximity to the proposed proj ect. In reality, the locus of activity for the historic farm
complex is situated over 700 feet outside the APE, and this particular corner of the property has been
subjected to various disturbances including a cleared, 150-foot wide power line easement and the
aforementioned realignment of SR 1639 (Tuttle Road). Given the degree of erosion, flood activity,
previous disturbances, and the steeply sloping topography within the APE, it is believed that the project
area, as depicted, is unlikely to contain intact and significant archaeological resources. Based on the
information above, there should be no archaeological survey required for this project. If design plans
change or are made available prior to construction, then additional consultation regarding archaeology
will be required. At this time, no further archaeological wark is recommended. If archaeological
materials are uncovered during project activities, ihen such resources will be dealt with according to the
procedures set forth for "unanticipated discoveries," to include notification of NCDOT's Archaeology
Group.

Subject: Section 7 Concurrence Request on the Northeru-long eared bat
version 4 for the project area associated with the replacement of Bridge
No. 142 on SR 1639 (Tuttle Road) in Forsyth County. TIP No. BD-
5109AB. WBS no. 45355.1.28.
As of Apri12, 2015, the northem long-eared bat (Myotis septentrionalis; NLEB) is listed by the
U.S. Fish and Wildlife Service (USFWS) as "Threatened" with an Interim 4d rule including
Forsyth County within NCDOT Division 9
(http://www.fws.gov/raleigh/species/cntylisUnc_counries.html). The project involves a 404
permit and federal funds and is subject to Section 7 of the Endangered Species Act.
Using USGS mines shapefile dataset, a desktop assessment was conducted for any mines within
one half mile of the project area. No mines were shown in the azea. Therefore, no mines needed
to be checked on foot. In addition, no known caves aze in the area for the project. Based on the
lack of mines and caves, no winter habitat will be affected by the project.
There are no manmade dwellings of suitable habitat that are proposed to be removed in the
project area. The projecY involves rep(acing an e�cisring bridge with a timber deck with metal
guard rails and timber end walls with creosote. The bridge was surveyed for presence of bats or
evidence of bats, and neither was found. Thus, no structure moratorium will be implemented on
the project.
According to the North Carolina Natural Heritage Program (NHP) Biotics Database, most
recently updated in April 2015, NLEB have not been documented in Forsyth County. However, a
rabies lab record that lacks specific location information exists for in neighboring Davidson
County. The closest specifically documented occurrence ofNLEB is in Wilkes County (NHP
2001 mist net record), more than 50 miles of any of the project sites. Potential summer roosting
and foraging habitat in the form of forested azeas interspersed with fields, and water sources do
exist in or around the project.
The project azea involves minimal tree clearing. NCDOT commits to a tree clearing moratorium
in the project azea from May 15 to August 15 of any calendaz year to avoid disturbing potential
Nor[hern long-eared bats in their sununer roosting habitat.

Based on the results of proximity to known occurrences of NLEB, potential foraging and roosting
habitat within the study azea, and currently available guidance from USFWS, we determined that
the project azea wil] have a biological conclusion of May Affect-Not Likely to Adversely Affect for
NLEB. NCDOT believes that the requirements of Section 7(a)(2) of the ESA have been satisfied
