At that time based on the session law I determined that they did not need a State Stormwater Permit because it was deemed permitted due to overland flow. I believe Buncombe county had some requirements (fees for added BUA) and the RO was working with them with respect to the construction activity. Cc: Higgins, Karen <karen__higginsnrd_e_nr_gov> Subject: Asheville Airport Runway #07-1841 v6 I'm seeing if anyone has any knowledge about the 401 modification request for an expansion of the Asheville airport runway? As you probably know, this is the facility where the legislature recently changed its ownership. I have the February 4, 2016 letter from ClearWater Consultants asking for a modification of the October 27, 2011 401 Certification to allow the runway to be built. I talked to Rebekah Reid of ClearWater and also their engineering consultant James Moose, who are working for the Airport Authority in getting permits. I'm trying to figure out what DWR's role (and my role) in obtaining and reviewing a stormwater plan should be. I believe that all of you have had some history with the project so I just wanted to check with you before I directed the Airport Authority to submit a stormwater management plan. Here are some of the issue's and some of my questions: 1. I understood from the engineer, James Moose, that the ownership of the facility will eventually be turned over to Buncombe County (if it's not already) but they cannot review the stormwater plan (at least not now) because it is in their charter or something. Also, I didn't get the impression that that Buncombe County would get authority in time to enable them to review the proposed expansion of their stormwater treatment device. 2. The engineer said that they needed the 401 approved as soon as possible and since the device (???) would be built over the sediment pond they have to close out the E&SC permit first. 3. The engineering consultant said that he had talked to Mike Randall and he seemed to understand the options available for diffuse runoff. However, he kept talking enlarging a "basin". 4. Some of my questions to you are: a. Do you have any opinion as to whether we should proceed with getting and reviewing the stomrwater plan? b. Is any of my understanding of this situation inaccurate? c. Is there anything else that I need to know before I proceed? Thanks
