The e�isting 2@ 60"x35`CMP is deteriaating and e hazard to motorists because the upstream pipe ends are close to the edge of pavemenL A masonry heacl�vall that protrudes n couple feet past the pipe inlets was conshucted in the past, but this did notfix the safery issue. The replTcement sh�uchve will be 2@ 60"x 60`CMP �vith conerete heT<Iw�lls with ttie pipes placed on a slightly sharper skew to better align with the stream chaunel upstream. The ne�v high flow pipe will have floodplain benches at the inlet and outlet The new base flow culvert pipe will have only a slight slope (�0.4%) and its inveit will be about one foot below the stream grade unless bedrock is encouutered. We would like to complete tl�e work soon, preferably before completion of a paving project th�t is currently unde��v�}� on this road. Enclosed are a PCN applieation, prelimina�y jurisdictional detennination, photographs of fhe project site, the culvert diagraiu, a m�rked vicinity map, a USGS topographic map, and other supportiug inform�tion. The North Caroliu� Natural 1 Ieritage Program lists 38 species for Clay County that have federal status and that are kuown from current or historical records. Three species, the green pitcher plant (Sm•rncenio oreophiln), rock gnome lichen (G7>>uonodernia linem•e), and the nortliern long- eared b�t (NLEB, �ll��olis septenh•ronali.r) are kno�vn from current records and �re listed as endangered ortlueatened. 'Chere are no records for listed species in the Suddawig Branch watershed. Wetlands aud damp rock faces ueeded by green pitclier plant and rock gnome Iichen, respectively, are not preseut near the site. For these reasons and due to the limited scope of the �vork, the project should have "no effect" on tliese listed terrestrial species. Clay County is considered oceupied h�bitat aud potential h�bitat for northern long-eared bTt (NLEB, Mj�otis seplenh•ionnlis) and Indiana bat (�llyolis sodcrNs), respectively. There are no caves or mines evident near the site, but there are a few h'ees that may need removal. According to the USFWS Asheville Pield Office's website, the project site does not f�ll within an area wliere pro�imity to NLEB hibernacula or materuity roost sites might be a concern. Therefore, we believe that the project should qualify for the e�ception from the incidental take prohibition for NLEB under the 4d rule that went into effect on Rebruap� 16, 2016. Tlie project only involves replacing a culvert and ground disturbance �vithin an esisting road right-of-n�ay. Therefore, ihere should be "no effect" of the project on cidhu�al resources. Erosion control devices �vill be installed and maintained as necessary during construction. Areas of disturbed soil will be quickly seeded and covered with shaw. Seed and matting will be placed along sheambanks to prevent erosion. Impacts to Waters oS the Uuited States Suddawig Branch (Class WS-IV) is shown ou the USGS topographic mTp es a pereunial stream and has sufficient flo�v to support Tquatic life. Tlie channel is well defned, lacks rooted vegetation, and is composed primarily of sand, gravel, and cobble. Suddawig Brancli flows appro�imatelp 0.5 mile to the Hiwassee River, which meets the definition of a Traditional Navigable Water (TNW). For these re�sons, we believe that Suddawig Branch is a Relatively Permenent Water aud is under thejarisdiction of the U.S. Arnry Corps of Engiueers. In order to complete the project, it will be necessa�y to impact Waters of tl�e United States in the Hiwassee River Basin (I IUC 06020002).
