RECEIVED November 11, 2024 NCDEQ Division of Water Resources NOV 1*2024 1617 Mail Service Center Raleigh, North Carolina 27699-1617 NCDEQ/DWR/NPDES RE: Lake Lure WWTP Influent Pump Station Emergency Replacement To Whom It May Concern: On September 27, 2024, floodwaters passing over the Lake Lure dam as a result of Hurricane Helene destroyed the wastewater pump station that conveys flows from the Town's Subaqueous Sanitary Sewer System (SASS)to the Wastewater Treatment Plant approximately 1600 linear feet downstream along the Broad River, which operates under NPDES Permit Number NC0025381. The Town, LaBella and Morgan 41 Corp. (who was already performing dam modification work in the immediate area of the pump station) immediately began an effort to replace the pump station, while raw wastewater flowed untreated into the 411 Broad River. Before and after photos are included on the following page. The floodwaters also destroyed the electrical equipment at the WWTP. Once this equipment was replaced and power was restored, a temporary pump began conveying flows to the WWTP while the Influent Pump Station reconstruction is being completed. The Town expects the Pump Station to be complete and operational in the next one to two weeks. The former pump station was a triplex suction-lift configuration. The replacement station is a triplex submersible configuration. The following items are attached: • Copy of the current NPDES Permit Number NC0025381. • Copy of the current SOC Number WQ 820-004 under which the treatment facility operates. • Construction drawings for the replacement station. All necessary specifications are included on the drawings, as this project was performed in an emergency/expedited design-build fashion. • Calculations for the replacement station. A check for the fee amount will be sent separately by the Town within 90 days of this submission. We respectfully request issuance of an Authorization to Construct. The Division of Water Resources will accept this application package for review only if all of the items are provided and the application is complete. Failure to submit all of the required items will result in the application package being returned as incomplete per 15A NCAC 02T.0105(b). B. A check or money order must be submitted in the amount of$1000.00 (except minor modifications) dated within 90 days of application submittal and made payable to North Carolina Department of Environmental Quality(NCDEQ). C. Plans and specifications must be prepared in accordance with 15 NCAC 02H. 0100, 15A NCAC 02T, North Carolina General Statute 133-3,North Carolina General Statute 143-215.1,and Division of Water Resources Minimum Design Criteria for NPDES Wastewater Treatment Facilities. D. The plans and specifications submitted must represent a completed final design that is ready to advertise for bid. E. Any content changes made to this Form ATC 10-23 shall result in the application package being returned. F. The Applicant shall submit ONE ORIGINAL and ONE DIGITAL COPY (CD) of the application, all supporting documentation and attachments. All information must be submitted bound or in a 3-ring binder,with a Section tab for each Section, except the Engineering Plans. G. There shall be no discharge of floating solids or visible foam in other than trace amounts. Page 5 of 10 Permit NC0025381 A. (3.) CHRONIC TOXICITY LIMIT (QUARTERLY) [15A NCAC 02B .0200 et seq.] The effluent discharge shall at no time exhibit observable inhibition of reproduction or significant mortality to Ceriodaphnia dubia at an effluent concentration of 10.4 % at the 0.495 MGD permitted flow level, and 19 % at the 0.995 MGD permitted flow level. The permit holder shall perform at a minimum, quarterly monitoring using test procedures outlined in the "North Carolina Ceriodaphnia Chronic Effluent Bioassay Procedure,"Revised December 2010, or subsequent versions or"North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised- December 2010) or subsequent versions. The tests will be performed during the months of January,April,July and October. These months signify the first month of each three-month toxicity testing quarter assigned to the facility. Effluent sampling for this testing must be obtained during representative effluent discharge and shall be performed at the NPDES permitted final effluent discharge below all treatment processes. If the test procedure performed as the first test of any single quarter results in a failure or ChV below the permit limit, then multiple-concentration testing shall be performed at a minimum, in each of the two following months as described in "North Carolina Phase II Chronic Whole Effluent Toxicity Test Procedure" (Revised-December 2010) or subsequent versions. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form(MR-1) for the months in which tests were performed, using the parameter code TGP3B for the pass/fail results and THP3B for the Chronic Value. Additionally, DWR Form AT-3 (original) is to be sent to the following address: Attention: North Carolina Division of Water Resources Water Sciences Section/Aquatic Toxicology Branch 1621 Mail Service Center Raleigh, North Carolina 27699-1621 Completed Aquatic Toxicity Test Forms shall be filed with the Water Sciences Section no later than 30 days after the end of the reporting period for which the report is made. Test data shall be complete, accurate, include all supporting chemical/physical measurements and all concentration/response data, and be certified by laboratory supervisor and ORC or approved designate signature. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the permittee will complete the information located at the top of the aquatic toxicity(AT)test form indicating the facility name,permit number, pipe number, county, and the month/year of the report with the notation of"No Flow" in the comment area of the form. The report shall be submitted to the Water Sciences Section at the address cited above. Page 6 of 10 Permit NC0025381 A. (3.) CHRONIC TOXICITY LIMIT (QUARTERLY), continued Should the permittee fail to monitor during a month in which toxicity monitoring is required, monitoring will be required during the following month. Assessment of toxicity compliance is based on the toxicity testing quarter, which is the three month time interval that begins on the first day of the month in which toxicity testing is required by this permit and continues until the final day of the third month. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Water Resources indicate potential impacts to the receiving stream, this permit may be re- opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival, minimum control organism reproduction, and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up testing to be completed no later than the last day of the month following the month of the initial monitoring. A. (4.) LAKE LURE DAM DISCHARGE [G.S. 143-215.66] The Town of Lake Lure controls the discharge rate of impounded water from Lake Lure. The Division has modeled the treatment plant's environmental impact based on flow parameters assuming a minimum discharge of 6.6 cfs. Therefore, as a Special Condition of this permit, the town shall record weekly(on the Upstream DMR) the Lake Lure Dam discharge to further evaluate the validity of these flow-based assumptions. A. (5.) EFFLUENT MERCURY ANALYSIS [15A NCAC 02B .0400 et seq., 02B .0500 et seq.] The Permittee shall provide one effluent mercury analysis, using EPA Method 1631 E, in conjunction with the next permit renewal application. The analysis should be taken within 12 months prior to the application date. Any additional effluent mercury measurements conducted from the effective date of this permit and up to the application date shall also be submitted with the renewal application. If the result of the mercury analysis is not provided with the application, the application may be returned as incomplete and the Permittee considered non-compliant. ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS [G.S. 143-215.1(b)] Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs) and specify that, if a state does not establish a system to receive such submittals, then permittees must submit DMRs electronically to the Environmental Protection Agency(EPA). The Division anticipates that these regulations will be adopted and is beginning implementation in late 2013. Signatory Requirements • Section D. (2.) Reporting • Section D. (6.) Records Retention • Section E. (5.) Monitoring Reports 1. Reporting [Supersedes Section D. (2.) and Section E. (5.) (a)1 Beginning no later than December 1, 2015 (270 days from the effective date of this permit), the permittee shall begin reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge Monitoring Report(eDMR) internet application. Monitoring results obtained during the previous month(s) shall be summarized for each month and submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring data and submit DMRs electronically using the internet. Until such time that the state's eDMR application is compliant with EPA's Cross-Media Electronic Reporting Regulation (CROMERR),permittees will be required to submit all discharge monitoring data to the state electronically using eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one signed original and a copy of the computer printed eDMR to the following address: NC DENR/DWR/ Information Processing Unit ATTENTION: Central Files/eDMR 1617 Mail Service Center Raleigh, North Carolina 27699-1617 If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility being physically located in an area where less than 10 percent of the households have broadband access, then a temporary waiver from the NPDES electronic reporting requirements may be granted and discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms approved by the Director. Duplicate signed copies shall be submitted to the mailing address above. Requests for temporary waivers from the NPDES electronic reporting requirements must be submitted in writing to the Division for written approval at least sixty(60)days prior to the date the facility would be required under this permit to begin using eDMR. Temporary waivers shall be valid for twelve(12) months and shall thereupon expire. At such time, DMRs shall be submitted electronically to the Division unless the permittee re-applies for and is granted a new temporary waiver by the Division. Page 8 of 10 Permit NC0025381 A. (6.) (d)1 All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II, Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section B. (11.)(b). A person, and not a position,must be delegated signatory authority for eDMR reporting purposes. For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account and login credentials to access the eDMR system. The Town and the Commission hereby stipulate the following: (a) The Town holds North Carolina Non-Discharge Permit WQCS00131 for operation of an existing wastewater collection system. The Town is unable to consistently comply with Condition I.2 regarding effectively managing,maintaining and operating the system to prevent impacts to groundwater, surface water or creation of nuisance conditions. Specifically, lake inflow and infiltration continue to cause excessive interference and inadequate treatment capabilities at the Town's WWTP. (b) The Town holds North Carolina NPDES permit NC0025381 for operation of the Town of Lake Lure wastewater treatment plant(WWTP)and for making an outlet therefrom for the discharge of treated wastewater to the Broad River,currently classified C waters of this State in the Broad River Basin. The Town is unable to consistently comply with effluent limits for Ammonia Nitrogen(NH3 as N)and Total Suspended Solids(TSS) as set forth in NPDES Permit NC0025381. (c) Noncompliance with the above permit conditions constitutes causing and contributing to pollution of the waters of this State named above, and the Town is within the jurisdiction of the Commission as set forth in G.S. Chapter 143,Article 21. (d) The Town has secured funding for the planning,design and construction of a multi-phase collection system replacement and WWTP improvement hereafter referred to as 'the project'. Phase I is to include rehabilitation of existing perimeter manholes and replacement of approximately 9,000 linear feet of the current collection system. Initial WWTP improvements will include repairs to the fine screen, addition of grit removal and modification of the solids handling processes. Completion of Phase I is intended to reduce lake infiltration and improve WWTP performance in preparation for subsequent phases of construction. (e) Since this Special Order is by Consent, neither party will file a petition for a contested case or for judicial review concerning its terms. 2. The Town, desiring to comply with the permits identified in paragraph 1(a)and 1(b)above,hereby agrees to do the following: SOC WQ S20-004 (a) The Town has outstanding civil penalty assessments that total $48,603.02.As a settlement of all alleged violations of NPDES permit NC0025381 and Non-Discharge permit WQCS00131 (NPDES: $44,363.53 &Non-Discharge: $2,119.59)occurring prior to entering into this SOC, the Town agrees to pay an up-front penalty in the amount of$9,720.60. The remaining balance of$38,882.42 and any additional fines incurred due to exceedances of unmodified limits during the life of the SOC are to be held in abeyance until the successful completion of this SOC.A check made payable to the NC Department of Environmental Quality and forwarded to the Supervisor of the NC DEQ Asheville Regional Office at 2090 U.S. Hwy 70, Swannanoa, N.C. 28778,by no later than ninety(90)days following the date on which this SOC is approved and executed by the Commission and received by the Town. (b) At the successful conclusion of this SOC, the penalty amount held in abeyance($38,882.42) and any additional penalties incurred due to unmodified limit exceedances will be remitted in full(i.e.,the Town's remaining penalty debt will be cancelled). Should the SOC not reach a successful conclusion,the full remaining penalty balance of$38,882.42 and incurred penalties related to unmodified limit exceedances will be due in full immediately. (c) Undertake the following activities in accordance with the indicated time schedule: (1) On or before December 30,2022,submit approvable plans and specification to the Division of Water Resources(hereinafter referred to as the Division)for its review for the Initial WWTP improvements referenced in 1(d)above. (2) Within five(5) months of receiving an approved Authorization to Construct(AtC)for the improvements identified in 2(cXI)above, award a construction contract for the Initial WWTP improvements. (3) Complete construction of the Phase I collection system improvements(as referenced in 1(d)above)on or before May 30,2026 (4) Amend SOC for Phase II of construction on or before July 31,2026. (5) Provide semi-annual progress reports summarizing activities undertaken by the Town with regard to the construction of Phase I. Reports will also provide a summary of the performance of the Town's existing WWTP during the previous six months,and detail efforts made to optimize WWTP during that time. Reports may be provided by hard copy or electronic means and shall be submitted to the NC DEQ Asheville Regional Office and the Division Central Office no later than the I Oa'day of June and December during the period of time the SOC is in effect. (d) During the time in which this SOC is effective,comply with the interim effluent limitations. Under this SOC,o_ih the parameters listed below have been modified from the most current NPDES Permit in effect. The Town agrees that unless excused under paragraph four(4),the Town will pay the Division Director, by check payable to the North Carolina Department of Environment Quality, stipulated penalties according to the following schedule for failure to meet the deadlines set out in paragraph 2. The only issue in such an action will be whether the thirty(30)days has elapsed. 5. This SOC and any terms and/or conditions contained herein, hereby supersede any and all previous Special Orders, Enforcement Compliance Schedule Letters,terms,conditions,and limits contained therein issued in connection with NPDES permit NC0025381 and Non-discharge permit WQCS00131. 6. Failure to meet the schedule dates identified in paragraph 2 may terminate this SOC and require the Town to comply with the terms and conditions contained in permit NC0025381 and WQCS00131. 7. Noncompliance with the terms of this SOC is subject to enforcement action in addition to the above stipulated penalties,including injunctive relief pursuant to G.S. 143-215.6.C. 8.
