TENNYSON Secretary (Rockingham/Hamlet Bypass) to US-220 (Ellerbe I am responding to your Notice of Deficiency dated February 22, 2016 far the above referenced project. This came as a result of an inspection by Dave Wanucha on February 19, 2016 for sediment loss due to recent storms received on the project. During this inspection, the NPDES reports were reviewed and found not to be in compliance, specitically due to the lag time between discovery of a noted "need of attention°' and act�ially making the needed repairs. Some items noted as urgent or routine were not completed within the allowed time frame. The Department is committed to staying in cotnpliance with the 401 Water Quality Certification for this project. We have reviewed the project and the NPDES record keeping and taken the following actions to keep this project in compliance: The Depart�nent has reviewed the proper NPDES reporting requirements with our Inspection staff along with the contractor's personnel. Some of the routine items that were not able to be completed within the 5 days due to continued rains, conditions too wet to work, or lack of manpower were put on the following weeks report as urgent. This resulted in the routine items being reported as ur�ent and not getting completed in the two days following. Moving forward, routine ite�ns will stay routine. If for reasons beyond the contractors control these itetns are not completed within 5 days, they will be noted witll supporting reasoning why they were not completed and added to the next report as routine and completed within the next week. Urgent items will be addressed within the 2 day period if at all possible. If carryover items are not completed the next week or the contractor is unable to complete roLitine or urgent items within the required time limits due to lack of manpower or lack of urgency on their part, the Department will suspend all operations on the project except work necessary to complete these items. The contractor has also emphasized this to their employees. The contractor is mobilizing additional tine gradiilg crews this month. NC 38315 �io-�a� �;aa �,� , .-- .-_ _ _ , . _, s f a �L"� 4j :.=7 E�a k� �: �' �,�' V I�,� � _ U ,�,�R � �016 U�NR •'lJA3'ER !2ESOURCES TRr�NSPI�RTATION PERNIITTING UNIT Ms. Amy Chapman R-3421ABC, Richmond County Page 2 • In addition to the extra grading crews, the contractor is planning to section off the project and have each section's grade crew responsible for erosion control in each section along with independent erosion control to assist each area. • We have reemphasized checking the project toward the end of each day for proper erosion control measures and reviewing the forecast to prepare the project for rain events. • The contractor's superintendent along with the Departments lead inspector will review the projects independently of the NPDES reporting to look for potential problem areas for erosion control. • The Division staff will monitor the contractor's progress on erosion control to ensure these additional measures committed by the contractor are being performed and are effective. Again, the Department is committed to ensuring that the contractor constructing this project operates within the confines of the NCDWR 401 permit. We will take necessary steps in the future if the contractor does not abide by the changes they have stated above. Please let us know if there are questions concerning this matter. .
