The Division of Energy, Mineral, and Land Resources (DEMLR) received a Post-Construction Stormwater
Management Permit Application for the subject project on September 9th, 2024.
15A NCAC 02H .1042(3)(c)of the North Carolina Administrative Code states that an application is considered
approved if the required response times outlined in G.S. 143-215.1 are not met, unless one of the following
exceptions applies:
i. The applicant agrees, in writing,to a longer review period.
ii. A public hearing is required for a final decision.
iii. The applicant fails to provide necessary information for the Division's review.
iv. The applicant denies the Division access to records or premises for information gathering.
As none of these exceptions were relevant to your application,SW3240201 is considered approved on October
9th, 2024, based on the aforementioned regulation (15A NCAC 02H .1042(3)(c)).
We are forwarding Permit No.SW3240201, dated October 9th, 2024,for the construction, operation and
maintenance of the built-upon areas(BUA) and vegetated conveyances or areas associated with the subject
project.This permit shall be effective from the date of issuance and shall be subject to the conditions and
Limitations as specified therein, and does not supersede any other agency permit that may be required.

Hi Matthew,
I reviewed the June 51",2024 submittal. Everything looks good to go besides 2 minor issues, so once we resolve
that,we can issue the permit. Since it would only require one page of the Supplement-EZ,you can just upload that
revised page and then I can print out the hard copies for the permit package.
1. Please correct the following issues with the Supplement-EZ Form:
a. Previous Comment Unaddressed-Drainage Areas Page:
i. Please fill out the entire site column(see prior comment). The entire site column is an accounting of the
entire project area(similar to how the drainage area column is an accounting of the entire drainage area).
BUA that is located within the project area should be included within the entire site column, whether or not
it drains to the SCM. NOTE:In order for the project to meet Runoff Treatment, the net increase in BUA
needs to be captured and treated within the SCM. If it is not practicable to capture and treat the net
increase in BUA, the uncaptured project area can be permitted as a low-density area(provided that all of
the low-density criteria is met in this portion of the project area). If it is not practicable to permit this area as
a low-density area, we can discuss further permitting options.
Per the provided plans,the project area is different from the drainage area to the SCM. Please revise, as these
columns were filled out with duplicate information.
2. Please verify that electronic copies of all documents required for a complete submission are uploaded. It
was noted that files were missing that will need to be present. Please review the electronic repository
(https://edocs.deq.nc.gov/WaterResources/Browse.aspx?id=494276&dbid=0&repo=WaterResources) and
verify that items on the Application Checklist have been provided, and that all submittal items are current.
Electronic files are required per 15A NCAC 02H .1042(2).
