James with the Division of Water Resources determined that the stream is subject to the Neuse Riparian Buffers at the confluence of the two streams so this road crossing does not require a riparian buffer authorization. My understanding is that David Schaeffer with the Corps determined that the stream is jurisdictional farther upstream from this confluence, and therefore, the crossing does require a 404 Permit and a 401 Certification. So I’m planning to just issue a 401 Certification and not an accompanying buffer authorization for this project. The Corps should also be issuing the 404 Permit. Let me know if you have any questions because I’m planning to do the 401 Certification shortly. I ran across your application while looking for another project and something caught my eye. In your application you reference the 12/3/15 stream determination performed by DWR. You also mention that Dave Shaeffer has performed a jurisdictional determination on the property, I assume Dave and James met you on property the same time. You asked for 75 feet of intermittent stream impact and buffer impact. The DWR stream determination letter however says that the stream starts at the confluence of the two drainages shown on the map. I assume this to mean that James determined 1 the drainages above this point to be ephemeral streams or simply no streams present, and otherwise not subject to the buffers. I would presume that Dave made the same determination that that the jurisdictional stream starts at the confluence, and that no jurisdictional waters exist above it. However, when I look at your site plans you extend both stream(s) and the buffer on the northern stream to the property eastern property line, well above the confluence point and where I think DWR determined the stream to start at. If my assumptions above are correct, then it appears that you’re proposing to cross with the road above the intermittent stream and buffers. If they are also not jurisdictional by the Corps, then you shouldn’t need a permit from either the Corps or DWR for this project. The linked image cannot be displayed.
