I have enclosed a set of plans, a PCN application for NWP #14, and a vicinity map relative to the
proposed bridge replacement project on SR 3470 Waters Cove Road, Buncombe County, NC.
We propose to replace the existing 19' timber bridge with a double pipe arch (2@ 81" x 59") with
low flow arch and sills. Stream slope at the site is 4.8%. Cubert installation will result in
permanent impact to 49 linear feet of an UT to Beaverdam Creek; floodplain bench construction
will permanently impact an additional 43 linear feet. Temporary impacts to 123 feet of the
stream are necessary for dewatering/diversion. The stream is approximately 7 feet wide with
predominately gravel and cobble substrate. The UT to Beaverdam Creek is classified as Class C,
Trout. ( Note: An existing 137" x 87" arch culvert is present approximately 50' downstream of
the project)
Existing channel morphology will be maintained upstream and downstream of the culvert.
Riparian vegetation will be reestablished along disturbed areas associated with the project.
Stormwater will be diverted through grass-lined ditches or vegetated buffers prior to entering
streams.
This project may impact potentially suitable northern long-eared bat (Myotis septentrior7alis)
(NLEB) summer roosting habitat via bridge removal. Therefore, a may affect, not likely to
adversely affect is requested for the NLEB. No tree clearing will be performed for the project.
The existing bridge is constructed of timber. The crown to bed measurement (distance from travel
surface to streambed) is 5 feet. Clearance between the bottom of the bridge and the stream
surface is approximately 3 feet. A survey of the bridge did not reveal any evidence of usage by
bats.
For the proposed action, NCDOT has committed to the conservation measures listed below:

I) No alterations of a known hibemaculum's entrance or interior environment if it impairs
an essential behavioral pattern, including sheltering Northern long-eared bats (January I
through December 31);
2) No tree removal within a 0.25 mile radius of a known hibernacula (January 1 through
December 31); and
3) No cutting or desU�oying a known, occupied maternity roost tree, or a�iy other trees within
a 150-foot radius from the known, occupied maternity tree during the period from June I
through and including July 31.
NCDOT has determined that the proposed action does not require separate consultation on the
grounds that the proposed action is consistent with the final Section 4(d) rule, codified at 50
C.F.R. § 17.40(0) and effective February 16, 2016. Section 7 responsibilities are therefore
considered fulfilled.
No effect on the remaining Buncombe County list of federally protected species (threatened or
endangered) or designated critical habitat will occur. Andrew Henderson of US Fish and Wildlife
Service is copied on the application for review.
As a part of the 401 Certification process, the project was processed through the DOT
Programmatic Agreement for Minor Project as required by Section 106 of the National
Historic Preservation Act of 1966 and GS 121-12(a). No Historic Resources will be affected.
By copy of this letter, we request Marla Chambers, North Carolina Wildlife Resources
Commission Western Region Coordinator, to comment directly to the Corps concerning the
permit request.
By copy of this letter, we are asking the Area Roadside Field Operations Engineer, to comment
on the above project. The UT to Beaverdam Creek is classified as Class C, Trout. The project
will not require a trout buffer variance.
By copy of this letter, I am forwarding one electronic copy of the application package to
Kristi Lynn Carpenter, NC Division of Water Resources, Transportation Permitting Unit
with cc to Kevin Barnett, NC DWR Asheville Regional Office for review and comment.

project. Based on the infotmetion received from you on February 24, 2016, the impacts are located in CU 06010105
of lhe French Broad River basin in the Southem Mountains (SM) Eco-Region, and are as follows:

1. The Corps of Engineers believes that there may be jurisdictional waters of the
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or other general permit verification requiring
"pre-construction notification" (PCN), or requests verification for a non-reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option to request an approved
JD before accepting the terms and conditions of the permit authorization, and
that basing a permit authorization on an approved JD could possibly result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to request an individual permit rather than accepting
the terms and conditions of the NWP or other general permit authorization; (4)
that the applicant can accept a permit authorization and thereby agree to comply
with all the terms and conditions of that permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without requesting
an approved JD constitutes the applicanYs acceptance of the use of the
preliminary JD, but that either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters of the United States, and precludes any challenge to
such jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331,
and that in any administrative appeal, jurisdictional issues can be raised (see 33
C.F.R. 331.5(a)(2)). If, during that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will
provide an approved JD to accomplish that result, as soon as is practicable.

General Project Narrative: This project involves the replacement of Bridge No. 100401 over UT Beaverdam Creek on SR 3470 (Billy Cove Road) in Buncombe Couny, NC with a 2@81"x59" Aluminized
(Description of Minimization of Water CSPA. This bridge replacement and the associated roadway improvements have been designed in a manner that minimizes the increase in impervious surface area. One of the
Quality Impacts) two culvert barrels will have a sill that is 0.5' higher than the other barrel, causing the stream to flow through only one barrel under normal flow conditions. Proposed drainage
ditches in the two quadrants north of the roadway will convey stormwater runoff from the road surface into UT Beaverdam Creek upstream of the proposed culvert. An existing
roadway ditch in the southeast quadrant of the culvert will remain undisturbed in order to continue to convey stormwater runoff from the road surtace and off-site sources to the
downstream side of the proposed culvert.

Avoidance and Minimization Efforts: The proposed culvert will be buried 1.0' with sills throughout the low flow channel to retain bed material. A floodplain bench and 1.5' sills in the high
(Bridge to Culvert) flow barrel of the culvert will promote low flow in one barrel only, maintaining the existing low flow channel dimensions and velocities as closely as
possible. The culvert approximates the existing bed slope and provides a smooth transition from upstream to downstream.
