Dear Mr. Elliott and Ms. Higgins,
A permit application requesting written authorization for impacts associated with bank
stabilization and restoration activities along the Swannanoa River and Ram Branch was
submitted by C1earWater Environmental Consultants, Inc. (CEC), on behalf of the
Biltmore Estate in January of 2014. The US Army Corps of Engineers (Corps) issued the
requested 404 permit on June 4, 2014 (Attachment A) and the NC Division of Water
Resources (DWR) issued the requested 401 Water Quality Certification on February 10,
2014 (Attachment B). During several large rain events in January of 2016, the left bank
of the Swannanoa River, between J -hook vanes at Stations 22+50 and 25+00, collapsed
and sloughed into the river (see photographs, Attachment C). At the closest point, this
bank failure is within 10 feet of the edge of Winery Road. If left unrepaired, the
structural integrity of Winery Road will be compromised. Additional impacts to the
Swannanoa River would be required to repair the bank failure.
Swannanoa River Bank Stabilization — The proposed repair work includes installation
of seven, 1 -foot geolifts with a rock toe (I 10 linear feet of impact) along the left bank of
the Swannanoa River and a grassed swale with an armored outlet (10 linear feet of
impact) located immediately upstream of the geolifts (Attachment D). Geolifts would be
constructed bottom to top with each geolift being complete prior to moving to the next
geolift. Each geolift would be moderately compacted, and seeded and mulched before
being wrapped with fabric. Live, dormant cuttings of native woody species would be
placed between each of the geolifts. A Jersey barrier coffer dam would be utilized to

isolate the proposed work area from river flow. A 4 -foot wide, upland grassed swale
would be constructed between the top geolift and the edge of Winery Road. This swale
would direct water away from the geolifts and discharge into the Swannanoa River via an
armored outlet.
The Biltmore Estate has retained Blue Ridge Archaeological Consultants (BRAC) to
address potential for the presences of archaeological and cultural resources at the site.
BRAC has been in correspondence with the NC State Historic Preservation Office
(SHPO). Correspondence applicable to 404 permitting will be submitted to the Corps
upon receipt.
The Biltmore Estate would like to request modification of the existing permits to allow
for the bank stabilization discussed above and illustrated in Attachment D. -
In summary, the Biltmore Estate requests to modify the existing permits as follows:

project includes realignment of the stream near the road crossing, installation of two constructed
riffles and rock toe.

1. Please review the attached North Carolina Wildlife Resources Commission letter dated
January 22, 2014.
2. Due to findings associated wilh 3113Nl2 monitoring should be conducted by a professional
archaeologist during the construction of the floodplain bench on the Swannanoa River. Any
archaeological features, postmolds, or significant concentrations of artifacts observed
during the monitoring of the construction of (lie bench should be fully investigated prior to
the completion of bench construction in those areas where such contexts are observed.
Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the
attached conditions and your plans submitted on January 9, 2014. Anv violation of the attached conditions or
deviation from your submitted plans may subject the permittee to a stop work order, a restoration order and/or
appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization
is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide permit
authorization is reissued and/or modified, this verification will remain valid until the expiration date identified
below, provided it complies with all requirements of the modified nationwide permit. If the nationwide permit
authorization expires or is suspended, revolved, or is modified, such that the activity would no longer comply with
the ternis and conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or
are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity
is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation.

Basis of Jurisdictional Determination:
There are stream channels located on the property that exhibit indicators of ordinary high water marks. The stream
channels on the property are known as the Rain Branch and the Swannanoa River which flows into the French Broad
River. This jurisdictional determination is valid for the impact areas only.
Attention USDA Program Participants
This delineation/determination has been conducted to identify the limits of Corps' Clean Water Act jurisdiction for
the particular site identified in this request. The delineation/determination may not be valid for the wetland
conservation provisions of the Food Security Act of 1985. if you or your tenant are USDA Program participants, or
anticipate participation in USDA programs, you should request a certified wetland determination from the local
office of the Natural Resources Conservation Service, prior to starting work.

Project impacts are covered by the attached Water Quality General Certification Number 3885 and the
conditions listed below. This certification is associated with the use of Nationwide Permit Number 27 once it is
issued to you by the U.S. Army Corps of Engineers. Please note that you should obtain or otherwise comply
with any other federal, state or local permits before proceeding with your project, including those required by
(but not limited to) Erosion and Sediment Control, Water Supply Watershed and Trout Buffer regulations.

your project, you must notify the Division and you may be required to submit a new application package
with the appropriate fee.
2. The designer or his designee shall supervise the installation of in -stream structures.
3. This authorization exempts the Permittee from meeting Condition #7 (dewatering) in the attached
general certification for the placement of in -stream structure material. All reasonable steps must be
taken to limit the amount of disturbance in the channel to reduce downstream turbidity during
construction.
4. Visual monitoring of the stabilization project shall be conducted annually for the first two years or two
bankfull events (whichever is longer). Any failures of structures, stream banks, or vegetation may
require future repairs or replacement, which requires coordination with the Asheville Regional Office to
ensure the stability and water quality of the stream and downstream waters.
5. Natural fiber matting is recommended for streambank stabilization.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a written
petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH) within
sixty (60) calendar days.
