Greetings Corps of Engineers, and NC Division of Water Resources,
Greetings Mr. Scarbraugh and Mr. Bigalow,
Thanks for your patience while MSA worked diligently to review several engineering matters related to
the Countryside Estates subdivision, including stormwater BMP engineering.
Please see attached revised JPA site plans showing minor changes in design to the subdivision.
- The footpath was removed from around the wetland area at the west end of the property
- The BMP between Lot 37 and Lot 54 has been resized, and the footpath adjusted accordingly.
- slight changes in the lot limits and road configuration.
In total, we have reduced the wetland impact to 19,830 square feet, or 0.455 acres, slightly less than
previously requested.

On December 7,' 2015,:.the Division of Water Resources ' (Division) received your application dated
November 25, 2015, requesting a 401 Water Quality Certification from the'Division for the subject project.
The :Division has determined that your application is incomplete. and'cannot be processed. The
application is on -hold until all of the following information Is received:'.
1. Impact Justification (Avoidance and Minimization)
Please provide more details regarding avoidance and minimization of 0.341 acres of -wetland
impacts for this project. [15A NCAC 02H .0506(f). and (g)]
4 This should include alternative designs and layouts of the project area.
• This Office believes that the wetland impact labeled on the plans as W2 can be moved or
reconfigured 'to avoid the impacts to the 401/404 wetland. Please revise the plans to avoid the
impacts or provide•a detailed explanation of why this plan for the activity cannot be practically
accomplished, reduced or reconfigured to avoid impacts to the 401/404 wetlands.
Pursuant to 15A NCAC 02H .0506 (6(f) and (g))] the applicant shall furnish all of the above requested
information for the proper consideration.of.the application. ".Ifal I of the requested information .is not
-received-in writing within-30'calendardays of receipt of this letter; the Division will be unable to approve
the application and it will. be returned. The return of this project will necessitate reapplication to the
Division for approval, including a complete application package and the appropriate.fee.

Project Description:
The project will involve construction of a 62 -lot residential subdivision.
Final engineering design of the proposed subdivision shall meet state and local requiremen4DRIP

Existing Site Conditions:
The site was logged approximately 2-3 years ago, and is currently
regenerating with a variety of common tree and herbaceous species.
Wetlands were delineated by MSA, P.C. and approved by the Corps
of Engineers in 2015.

A residential subdivision is located north of and adjacent to the project site.
Agricultural land is located to the south and west. Caratoke Highway is to the east.
Erosion and Sediment Control Measures:
Erosion and Sediment Control measures shall comply with state and local requirements. At a minimum, a properly installed silt fence shall be
maintained around the perimeter of disturbance areas at the conclusion of each work day. Silt fence shall be 36" in width with 4" entrenched
vertically and 4" entrenched horizontally.
E&S measures shall be installed prior to land disturbing activities, and will be maintained until permanent vegetative cover has established.
All soil stockpile areas shall be surrounded by silt fences.
E&S measures shall be checked periodically and after significant rain events and maintained as needed.
Vegetative Practices:
All areas disturbed by construction activities shall be seeded with an approved stabilization seed mix as soon as final grade is achieved, or if a
significant amount of time is to pass from disturbance until completion of project. A soil stabilization mat or protective blanket may be used where
needed to achieve stabilization.
Temporary Construction Entrance:
Construction machinery will access the site via the future entrance road footprint at the northeast corner of the site.
Wetland Management Strategies:
The limits of wetland areas to be preserved shall be designated and protective fencing installed around the perimeter prior to land disturbing
activities.
