I am responding to your Notice of Deficiency dated February 22, 2016 for the above referenced
project. This came as a result of an inspection by Dave Wanucha on February 19, 2016 for
sediment loss due to recent storms received on the project. During this inspection, the NPDES
reports were reviewed and found not to be in compliance, specifically due to the lag time between
discovery of a noted '`need of attentiod' and actually making Yhe needed repairs. Some items noted
as urgent or routine were not completed within the allowed time frame.
The Department is committed to staying in compliance with the 401 Water Quality Certifieation for
this project. We have reviewed the project and the NPDES record keeping and taken the following
aetions to keep this project in compliance:
The Department has reviewed the proper NPDES reporting requirements with our
Inspection staff along with the contractor's personnel. Some of the routine items that were
not able to be completed within the 5 days due to contii�ued rains, conditions too wet to
work, or lack of manpower were put on the following weeks report as urgeut. This resulted
in the routine items being reported as urgent and not getting completed in the two days
following. Moving forward, rouYine items will stay roufine. If for reasons beyond the
contractors control these items are not completed within 5 days, they will be noted with
supporting reasoning why they were not completed and added to Uie next report as routiue
and compleYed within the next week. Urgent items will be addressed within the 2 day
period if at all possible. If carryover items are not completed the next week or the
contractar is unable to complete routine or urgent items within the required time limits due
to lack of manpower or lack of urgency on their part, the Department will suspend all
operaiions on the project except work necessary to complete these items. The contractor
has also emphasized this to their employees.
The contractor is mobilizing additional fine grading crews this month. These crews will be
used to finish slopes for permanent vegetation.

• In addition to the extra grading crews, the contractor is planning to section off the project and have
each section's grade crew responsible for erosion control in each section along with independent
erosion contro] to assist each area.
• We have reemphasized checking the project toward the end oPeach day for proper erosion control
measures and reviewing the forecast to prepare the project for rain events.
• The conhaetor's superintendent along with the Departments lead inspector will review ihe projects
independently of the NPDES reporting to ]ook for potential problem areas for erosion control.
• The Division staff will monitor the contractor's progress on erosion control to ensurc lhese
additional measures commitCed by the contractor are being performed and are effective.
Again, the Depanment is commit[ed to ensuring that the contractor constructing this project operates
within the confines o'f the NCDWR 401 permit. We will take necessary steps in the future if the
contractor does not abide by the changes they have stated above. Please let us lrnow if there are questions
concerning this matter.
