Dear Jacob:
This letter serves as acknowledgement that we have revised the previously submitted package
to address all comments below as follows:
1. The following issues are present with the signing officials listed:
a. Section III.].a of the Application lists Joel Trice as the signing official for J&J Property
Enterprises, LLC, the identified Applicant/Developer. However, the provided documentation
from the NC Secretary of State does not identify Mr. Trice as a manager or company official.
Please either provide official documentation showing that Mr. Trice is a manager or company
official and authorized to sign for the LLC or list one of the identified managers or company
officials of the LLC, as required by 15A NCAC 02H .1042(2)(b)(ii) and .1040(1).
Response:The applicant has been updated to "Claudia Al-hassan".
b. Section 111.2.a of the Application lists Jordan Al-Hassan as the signing official for J&J
Property Enterprises, LLC, the identified property owner. However, the provided documentation
from the NC Secretary of State does not identify Mr. Al- Hassan as a manager or company
official. Please either provide official documentation showing that Mr. Al-Hassan is a manager
or company official and authorized to sign for the LLC or list one of the identified managers or
company officials of the LLC, as required by 15A NCAC 02H .1042(2)(b)(ii) and .1040(1).
Response: The signing official has been updated to "Claudia Al-hassan". They are listed as an
official for Encompass Building Group inc., J&J Custom Homes, LLC, and J&J Property
Enterprises, LLC.
c. Section IX of the Application is completed by an individual who has not yet
demonstrated that they have been given the authority to sign on behalf of the property
owner, J&J Property Enterprises, LLC. Please either have one of the individuals identified in 15A
NCAC 02H.1040(1) and listed in Section 111.2.a of the application sign this section of the
application form or provide a letter of authorization from this individual allowing another to sign
on their behalf.
Response: This section of the application has been updated to reflect that Claudia Al-hassan as
the property owner is giving Claudia Al-hassan as the developer authorization.
d. Section X of the Application is completed by an individual who has not yet
demonstrated that they have been given the authority to sign on behalf of the
applicant/Developer, Encompass Building Group. Please either have one of the individuals
identified in 15A NCAC 02H.1040(1) and listed in Section 111.1.a of the application sign this
section of the application form or provide a letter of authorization from this individual allowing
another to sign on their behalf.
Response: This section has also been updated with Claudia Al-hassan's information.
2. A portion of the identified project area appears to belong to J&J Custom Homes, LLC.
Please provide documentation showing that the Applicant has obtained legal rights to submit
a stormwater permit application within the area of the project that is owned by J&J Custom
Homes, LLC, as required by 15A NCAC 02H .1042(2)(c). Please also provide a copy of Section
111.2 (as well as supporting LLC documentation for the signing official) and Section IX of the
Application identifying J&J Custom Homes, LLC as a property owner associated with this
Application, as required by 15A NCAC
02H .1042(2)(a)(ix).
Response: Claudia Al-hassan is an owner/official for each of the three parties involved. As
such, they will be signing on the behalf of each.
3. As designed, this project does not appear to meet all requirements of a low-density
development. Please revise the following:
a. Per 15A NCAC 02H .1003(2)(c), stormwater that cannot be released as dispersed flow
shall be transported by vegetated conveyances. A minimal amount of non- vegetated
conveyances is only allowed in cases where it cannot be avoided, such as for driveway and
road crossings. The piping from GI #3 to FES #5 appears unnecessary. Please revise the project
package to remove this piping or provide justification as to why this piping is necessary.
Response:The identified storm drainage run has been removed and the swale has been
extended to outlet in a flat area below fill slope.
4. Consistency
Please revise the following for consistency:
a. Per the Application, 16,883 sf of On-site Streets and 317 sf of Other on-site BUA is
proposed, totaling 17,200 sf of common area BUA. Per the Supplement-EZ form, a total of
17,150 sf of common area BUA is proposed.
Response: Both forms have been updated to be correct and consistent. A total of 17,150 sf of
common area BUA is now identified on both forms and listed only as On-site streets (301 sf of
curb and gutter plus 16,849 sf of street pavement.)
b. There are swales identified on the provided plan sheets with side slopes of 2.9:1 and
4.8:1, which does not match the side slopes identified on the Supplement-EZ form. Please
note that side slopes may be no steeper than 3:1 unless it is demonstrated that the soils
and vegetation will remain stable in perpetuity based on engineering calculations and
on-site soil investigation, per 15A NCAC 02H .1003(2)(c)(i).
Response: Side slopes have been adjusted and side slope labeling has been corrected to
reflect slopes identified on the Suppplement-EZ form.
5. Application
2x hard copies of the Application with the following corrections made, as required by 15A
NCAC 02H .1042(2)(a) and Section VI, 1 of the Application:
a. Section I, 2-The address provided is not consistent with the project location provided in
Section I, 4. Please revise for consistency.
Response:The project address has been corrected on the application.
b. Section IV, 10-Please revise the following:
On-Site Drainage Area -Since this is a low-density project, the On-Site portion of the
drainage area will be equal to the entire project area. This line should match the Total
Drainage Area line.
Response:The drainage area amount has been corrected as noted.
ii. Off-Site Drainage Area -Since (for low-density projects) the On-Site Drainage Area is
equal to the Total Drainage Area, there is typically no off-site component to low-density
projects.
Response:The off-site drainage area now shows zero. Off-site drainage previously recorded
was for calculations of storm pipe at street connection and is shown on sheet C5.0.
iii. Existing BUA-Please ensure that all existing BUA is accounted for. It is noted that there is
BUA present within the delineated project area that was present before the 2007 Rules went
into effect. This must be accounted for.
Response: Existing BUA has now been accounted for and the project density has been
updated.
6. Supplement-EZ
lx hard copy of the complete, original Supplement-EZ Form with the following corrections
made, as required per Sections V & VI, 3 of the Application:
a. Cover Page
Line 7- Per 15A NCAC 02H .1003(4), the minimum setback width is 30 feet. It is noted that
there are no surface waters on site, but please revise this line to demonstrate compliance with
the rule. Lines 8 and 9 may be filled in as "N/A" to indicate the lack of surface waters on site.
Response:This has been updated to demonstrate compliance.
ii. Line 21 - "Treatment Swales" refers to the Secondary SCM (not vegetated
conveyances), which do not appear to be proposed at this time. Please revise this line to
indicate there will not be treatment swales proposed at this time or revise the project package
to show that they are, including compliance with the MDC.
Response: Project swales are only vegetated conveyances not treatment swales. Line 21 has
been updated to indicate none.
b. Drainage Areas Page
Lines 6 and 7-Please revise identically to the revision required in Section IV, 10 of the
Application with regard to On- and Off-Site components of a Low Density project (see earlier
comment).
Response:These lines have been updated to be consistent with the application.
ii. Lines 10 and 12-In addition to the revision for consistency (see earlier comment), please
complete Line 12. This will be a breakdown of common area BUA, and should match Section
IV, 10 of the Application.
Response: Lines 10 and 12 have been updated and are consistent with the application.
iii. Line 15- Please ensure this line is updated when accounting for existing BUA within the
project area.
Response: Existing BUA has now been accounted for.
7. Plans
2x hard copies of revised plan sheets with the following corrections made, as required by 15A
NCAC 02H .1042(2)(g) and Section VI, 8 of the Application:
a. Please include riprap sizing details on the main set of plans, as required by Section VI, 81
of the Application.
Response: Riprap sizing is called out at each area of ouffall protection on sheets EC1.0 and
C3.1. A data table has been added to the riprap detail on sheet EC1.2.
b. Please identify and delineate the drainage area to each permanent swale on the main
set of plans, as required by Section VI, 81 of the Application. It is noted that there are
delineations present on the submitted erosion control plans, but the delineations must
correspond to the permanent conditions of the project.
Response:The temporary swales and the permanent swales are identical in construction and
drainage areas. The swale drainage areas have been updated on sheet EC1.0.
c. Please identify and dimension all BUA on the main set of plans, as required by Section IV,
8j of the Application.
Response: All proposed and existing BUA is identified on sheet C5.0.
8. Calculations
lx signed, sealed, and dated hard copy of calculations with the following corrections made,
as required by Section VI, 7 of the Application:
a. Please provide calculations showing how the time of concentration (Tc) for the
proposed permanent swales was determined and please provide a reference for the 10-year
storm intensity value (i) used in the calculations.This is required per Section VI, 7 of the
Application.
Response: Travel time calculations for each segment of the Time of Concentration flow path for
each swale drainage area is shown now on sheet EC1.0. Tc calculations were added to the
Stormwater Management Report.
Storm intensity values were derived by interpolating between the 10 minute and 15 minute
duration intensity values (based on calculated Tc)for the 10 year storm shown on the Point
Precipitation Frequency Estimate provided by NOAA for the project location. This data has
been added to the Stormwater Management Report.
