Dear Mr. Shaver and Mr. Herndon, On behalf of the North Carolina Department of Transportation (NCDOT) Division 3 environmental officer, Mr. Stonewall Mathis, this submittal servers as a preliminary jurisdictional determination (PJD) request as well as a pre-construction notification (PCN) application requesting written concurrence from the US Army Corps of Engineers (USACE) and the NC Division of Water Resources (NCDWR) that the activities proposed below may proceed under Nationwide Permit 3 and General Water Quality Certification (GC) 3883. Project Purpose and Need The Mt. Misery Road (SR 1426) Pipe Replacement project (Project) proposes to replace the existing 66" x 51" CMPA with two 81" x 59" CMPAs with headwalls. The existing CMPA is undersized and has deteriorated presenting a safety concern. The proposed replacement will provide adequate flow to prevent damming and address the existing safety concerns, while also allowing for aquatic life passage. Project Location SR 1426 (Mt. Misery Road) intersects with US 74 at a point northwest of the Town of Navassa in Brunswick County, NC (see Figure 1). The Project area consists of approximately 0.44 acres (Figure 2) located at the point Mt. Misery Road crosses Indian Creek which is approximately 1.8 miles west of SR 1430 (Cedar Hill Road). SOILS PRESENT IN PROJECT AREA FOR MT. MISERY ROAD A delineation and evaluation of jurisdictional features within the defined project limits was conducted by SEPI on December 9t", 2015. The evaluation identified one jurisdictional stream (SA) and one jurisdictional wetland area (WA), as shown in Figure 4. Perennial stream SA (Indian Creek) is shown as a solid blue line on the USGS topographic quadrangle (see Figure 5). LiDAR imagery of the site is shown in Figure 6. Photos 1-6 of the jurisdictional features are also included. Proposed Impacts There are 44 feet of proposed permanent stream impacts resulting from the pipe replacement for inlet and outlet headwalls and outlet class B rip rap. 60 linear feet of temporary stream impacts are proposed for de-watering on both sides of the project. Proposed permanent wetland fill impacts associated with this project are 0.0018 acres for inlet headwall and rip rap. There are also 0.0129 acres of hand clearing in wetlands proposed on the inlet side of the project. To accommodate the designed flow capacity required by the NCDOT hydraulics unit two larger pipes are proposed to replace the existing single pipe. To avoid widening the stream channel or reducing the depth of the stream in connection with this construction activity, the first pipe will be aligned with the stream channel and serve as the low flow pipe (Permit Drawing 1 of 5). The second pipe will serve as an overflow during high flow events (Permit Drawing 2 of 5). Both pipes will be buried approximately 1 foot below the natural stream bed elevation as determined from upstream and downstream elevations away from the scour holes associated with the current pipe. The high flow pipe will have a sill installed 2 feet inside the inlet. To prevent wetland headcutting that could lead to instability and scour, the sill in the overflow pipe will be 2.2 feet tall which matches the inlet side wetland elevation. Rip rap placement around the outlet will be done in a manner that creates a natural stream channel cross section and flood plain bench (Permit Drawing 5 of 5). Both pipes will be buried approximately 1 foot below the natural stream bed elevation as determined from upstream and downstream elevations away from the scour holes associated with the current pipe. The high flow pipe will have a sill installed 2 feet inside the inlet. To prevent wetland headcutting that could lead to instability and scour, the sill in the overflow pipe will be 2.2 feet tall which matches the inlet side wetland elevation. Rip rap placement around the outlet will be done in a manner that creates a natural stream channel cross section and flood plain bench. NCDOT design is minimum requirements for State standards. 1 b. Misery Road), Brunswick County, NC An evaluation of natural communities and threatened and endangered (T&E) species for the NCDOT Pipe Replacement on SR 1426 (Mt. Misery Road) 1.8 miles west of SR 1430 (Cedar Hill Road) in Brunswick County included a GIS-based review of aerial imagery, USDA soil survey mapping, USGS topographic mapping and LiDAR imagery; a wetland and stream delineation; a review of the North Carolina Natural Heritage Program (NCNHP) web-based mapping tool; and a field survey by qualified environmental scientists. Fifteen federally threatened and endangered species are listed in Brunswick County by the US Fish & Wildlife Service (USFWS) according to the county list, updated March 25, 2015. The species include: American alligator (T (S/A)), bald eagle (BGPA), green sea turtle (T), hawksbill sea turtle (E), Kemp's Ridley sea turtle (E), leatherback sea turtle (E), loggerhead sea turtle (T), piping plover (T), red-cockaded woodpecker (E), red knot (T), West Indian manatee (E), wood stork (T), Cooley's meadowrue (E), rough-leaved loosestrife (E), and seabeach amaranth (T). Biological Conclusion: No Effect Review of GIS data and the NCNHP web-based mapping tool indicated current observances (2005) of American Alligator (T(S/A)) within the project area. The project area crosses Indian Creek, a tributary to the Cape Fear River with wetland habitat that could support American Alligator. No species were observed during a field survey conducted on December 9, 2015. The NCNHP mapping also showed a historic record (1979) of Red-cockaded Woodpecker (E) within approximately 0.25 miles of the project area. The NCNHP RCW occurrence was "evidence of breeding only". No species or cavity trees were observed during the field survey. This type of stream widening conflicts with both the USACE regional conditions and after speaking with Mason the State certification conditions as well. A new alternative should be considered to meet the conditions of our authorizations. Normally this comes in the form of aligning one barrel to the channel and providing a sill on the other barrel which would serve as an overflow barrel. Here is my regional conditions: " The dimension, pattern, and profile of the stream above and below a pipe or culvert should not be modified by widening the stream channel or by reducing the depth of the stream in connection with the construction activity." Misery Road and have a couple of items that need to be addressed before I can process the application. 1. You state that there are 35 If of permanent impacts on the outlet end of the culvert in the PCN and WIS. When I scale out the length of the impact on the plan sheet I get 35 If, however on the profile view it appears that the length of impact is 40 If based on my scale measurement from the headwall to the end of the rip rap. Would you please check this and let me know what you get. 2. The PCN states that this is a courtesy copy for DWR, however this is not correct because the project exceeds the 40 If of permanent stream impact threshold in WQC 3883. A change is not required, however I need you to confirm via e- mail that DOT gives DWR permission to debit the required $240 permit fee from 3B.201011, which is listed on line A.2e of the PCN as the projects WBS number.
