Please find responses to the requested information below. STATE STORMWATER DEPARTMENT Contact:Jacob Beeker 1) The electronic files associated with this project could not be found in the electronic repository. Please upload the files,as required by 15A NCAC 02H .1042(2).Electronic copies should be uploaded at the following location: https://edocs.deq.nc.gov/Forms/SW-Supplemental-Upload. -* Electronic files have been uploaded to NC Stormwater—Supplemental Information Upload site. 2) Per the provided USGS topographic map,there appears to be a surface water located within the project area.Please ensure the following: a) The surface water is clearly shown on the main set of plans (per 15A NCAC 02H .1042(2)(g)(iii)). —> The surface waters are clearly shown on the main Construction Drawing plan set. The Overall Site Plan (sheet C-2.0), the Overall Grading Plan (sheet C-4.0), Grading Plan sheets C-4.1 —C-4.3, BMP Detail Sheets C-4.20—C-4.21 show all the required surface water labels. b) Clearly identify and delineate the top of banks of the stream in the main set of plans(Section VI, 8h). If it is not possible to delineate the banks of the surface water(as would be the case for a narrow stream), please show the centerline of the surface water and provide a callout listing the surface area of that surface water that is within the project boundary.Note that the surface area of the surface water is the area between the top of the banks of the streams and normal pool of impounded structures. Ensure the vegetated setback is measured horizontally from the top of bank of each side of streams for all perennial and intermittent surface waters within and adjacent to the site. -f The stream centerlines are labeled on the Construction Drawing plan set. The banks are shown and labeled where possible. Where there are narrow streams, the surface area is noted in the label for that stream. The 30' vegetated setback is labeled and shown on the plans as well.The Overall Site Plan(sheet C-2.0),the Overall Grading Plan(sheet C-4.0), Grading Plan sheets C-4.1 — C-4.3, BMP Detail Sheets C-4.20 — C-4.21 show all the required labels c) The required vegetated setback/buffer from the surface water is clearly shown on the main set of plans (per 15A NCAC 02H .1042(2)(g)(iii)) and Section VI,8p. EAGLE ENGINEERING,INC. 2013-A Van Buren Avenue Indian Trail,NC 28079 Ph 704 882 4222 www.eagleonline.net Cottages at Wingate—Phase 1 Page 2 Wingate,NC Jurisdictional Project ID: SW3240602 NOTE: The minimum vegetated setback must be 30 ft; the setback must be measured from the top of bank and not the centerline. 15A NCAC 02H .1017 (10), 15A NCAC 02H.1003(4)(a), 15A NCAC 02H.1042(2)(g)(iii). -* The 30' vegetated buffer is shown on the plans and is measured from the stream bank. d) The surface area of this surface water is indicated in Section IV, 6 of the Application and the Supplement-EZ Form(Cover Page,Line 4). —> The Total Surface Water Area is 2.91 acres,as indicated in Section IV,6 of the completed application. The 2.91 acres is also indicated on Line 4 of the Supplement-EZ on the Cover Page. This area was noted on previous submittals. e) The surface area of this surface water is excluded from the project area in Section IV,7 of the Application and the Supplement-EZ Form(Cover Page,Line 2&Drainage Area Page,Entire Site Column,Line 5). -+ The surface area of the surface water is excluded from the project area in Section IV, 7 of the Application. The calculation for#7 of Section IV of the Application is as follows: Total Property Area—Total Coastal Wetlands Area—Total Surface Water Area =Total Project Area 75.01 acres—0 acres—2.91 acres=72.10 acres This information was provided on previous submittals. -+ The surface area of the surface water is excluded from the project area in the Supplement EZ Form. On the Cover Page, Line 2, the Project Area (ac) is listed as 72.10. On the Drainage Area Page,Entire Site Column,Line 5,it is asking for the total drainage area of the entire site, which is not the same as the "project area". The total drainage area is the sum of the on-site and off-site drainage for the entire site, which is not the same as the project area. f) The Percent BUA for the project area is recalculated in Section IV, 8 of the Application and the Supplement-EZ Form(Drainage Area Page,Entire Site Column,Line 18). -+ In Section IV, item 10, the proposed impervious areas for each drainage area is listed in the provided table, 498,248 sf, 174,676 sf, and 65,776 sf respectively. The total of these area is 738,700 sf. Following the formula of item 8: (Total Impervious/Total Project Area)x 100=Project% of Impervious Area (738,700 sf/72.10 acres)x 100=23.5%of Impervious Area This calculated impervious area is specific to on-site only and does not include any off- site impervious area. This information was provided on previous submittals. -* On the Supplement-EZ Form (Drainage Area Page, Entire Site Column, Line 18, the Percent BUA calculated to be 22%is the result of the Total BUA/Total Drainage Area. This takes into account both off-site drainage and off-site impervious,and therefore would not be the same as the on-site BUA%. g) The design is revised as needed to ensure that it complies with 15A NCAC 02H .1003(4). -* The design matches all calculations and information provided in the Stormwater Permit Application and the Supplement-EZ form. 3) 15A NCAC 02H.1040(1) and .1042(2)(b)(ii): The Application, O&M Agreement, and Deed Restrictions were signed by Chris Robusto; however, the provided documentation from the NC Secretary of State does not identify Mr. Robusto as a member or manager of this LLC. In the case of a limited liability corporation(LLC),the application must be signed by a manager or company official as defined in GS 57D. Please either: a) Provide official documentation showing that Mr. Robusto is a Member or Manager and authorized to sign for the LLC; or b) Have one of the identified members of the LLC sign the application documents; or EAGLE ENGINEERING,INC. 2013-A Van Buren Avenue Indian Trail,NC 28079 Ph 704 882 4222 www.eagleonline.net Cottages at Wingate—Phase 1 Page 3 Wingate,NC Jurisdictional Project ID: SW3240602 c) The signature by other agents shall be accepted on the application only if accompanied by a letter of authorization signed by the appropriate authority. Provide a letter of authorization from one of the identified manager of this LLC authorizing Mr. Robusto to sign on their behalf. - A"Written Consent to Action of the Manager of Dream Finders Homes LLC"has been compiled to authorize Jeff Ott as being authorized to sign on behalf of Dream Finders Homes LLC. Mr. Ott has been added to, and signed, all required forms. 4) Plans: 2x hard copies of revised plan sheets with the following corrections made, as required by 15A NCAC 02H .1042(2)(g) and Section VI, 8 of the Application: a) Please delineate the project area with bearings and distances on the main set of plans, as required by Section VI, 8i of the Application. The current area delineated appears to include Phase 2. —> Bearings and distances have been added to the Phase 1 boundary. Please see sheet C-2.0, the Overall Site Plan for further detail. 5) O&M Agreement: lx original, signed & notarized hard copy of the O&M Agreement Form, as required by 15A NCAC 02H .1042(2)(j)and Sections V&VI, 3 of the Application: a) If the signing official is changed,please submit a new O&M form with the new signature. - The signing official has been changed to Jeff Ott, and he has re-signed the O&M form.
