Introduction The Bandit Farms Buffer Mitigation and Nutrient Offset Bank Parcel (the Parcel, Figure 1) is approved in the Upper New Hope Subwatershed of Jordan Lake (Upper New Hope). The Parcel (NC Division of Water Resources [DWR]# 2016-0393v4) is developed under the Mitigation Banking Instrument (MBI) made and entered into by RestorEcology Jordan, LLC (RestorEcology) and the NC Department of Environmental Quality – Division of Water Resources (DWR) on October 31, 2023. The MBI was executed to develop the Parcel as an Upper New Hope riparian buffer mitigation and nutrient offset bank. Approximately 12.8 AC were planted with native hardwood trees and shrubs (Figure 2). This will lessen nutrient inputs into the streams from agricultural activities and provide restored stream buffers and adjacent riparian areas out to a maximum of 200' landward from existing stream top of banks. Existing wooded riparian areas adjacent to streams within the Parcel were preserved, resulting in a total Parcel size of approximately 17.5 acres. Riparian buffer credits and nutrient offset credits are generated by the Parcel and sold to permittees in the Upper New Hope to offset authorized impacts. 2. Parcel Location & Background The following sections give a brief summary of the parcel information provided in the Bank Parcel Development Package (BPDP) approved November 2, 2023. 2.1 Location and Setting The Parcel is located near Chapel Hill, NC, on the south side of Dairyland Rd. The on-site streams are the headwaters of Morgan Creek, with three unnamed tributaries. Morgan Creek eventually flows into University Lake and on into Jordan Lake. 2.2 Parcel Background The historic land use of the Parcel is cropland and pasture, with cleared buffers or narrow wooded corridors along the streams. During Parcel permitting and planting, the property containing the Parcel was developed as a vineyard. 2.3 Parcel Information Tables Key Parcel information is summarized on the following Table 1 through 4. Restoration Activities The following restoration activities were completed at the Parcel in accordance with the approved BPDP. 3.1 Site Preparation Planting preparation included electric fence removal, bushhogging, fescue spraying, and native seeding. Bushhogging was conducted monthly in the winter of 2023-2024. Electric fence removal and disposal was conducted in the western former pasture on January 12, 2024 (see Figure 2 for removal location). 3.2 Invasives Species Removal Invasive species, including Chinese privet (ligustrum sinense) and tree of heaven (Ailanthus altissimus), were treated in the preservation areas depicted on Figure 2 before planting starting February 6, 2024. The treated preservation areas totaled approximately 3.8 aces. Tall fescue (Lolium arundinaceum) herbicide spraying was conducted in the western former pasture in February 2024 (Figure 2) to lessen potential allelopathy from the fescue. 3.3 Seeding Native seeding and strawing of the former farm path on the eastern side of Stream B1 and B2 was conducted via broadcast seeder on February 1, 2024 (see Figure 2). The Planting Workplan is provided as Figure 2. The following 12 species and quantities were planted in the riparian restoration areas, at a density of 531 stems/acre based on total stems planted, close to the planned BPDP density of 534 stems/ac. These included the 7 species in Table 8.1 of the BPDP (Primary Planting List), along with 4 of the species from Table 8.2 (Substitute Planting List). Black walnut was planted by mistake, and an additional 450 trees or shrubs from Table 8.1 or 8.2 will be planted on the Parcel before Bandit Farms As-Built Report Upper New Hope Subwatershed of Jordan Lake 8 October 2024 March 15, 2025 to replace those stems. Black walnut stems have been excluded from stems/acre totals in this report. Upon planting this area, documentation of its completion will be submitted to DWR with the Credit Release Request for the remainder of Task 2. 3.5 Conservation Easement and Boundary Marking The conservation easement was marked at staked corners and at least every 200 feet along lengthy boundary lines with yellow Unique Places to Save signs on t-posts. At DWR’s request following the As- Built Site Visit (Appendix F), easement signage was also added approximately every 200 feet along the banks of Stream A and Morgan Creek where the easement boundary is the stream centerline. Additionally, white electric tape was used to make easement boundaries more clear in locations where the boundary was hard to distinguish from the surrounding fields, such as the crossing on Stream C2. During vineyard planting that occurred in the spring 2024 adjacent to the easement, a vineyard row was inadvertently installed into the easement on the west side of Stream B2 (see Figure 2). This area was identified by DWR during the As-Built Site Visit. As documented in the correspondence provided in Appendix F, the landowner removed the vineyard row from the easement June 11, 2024. Mitigation Potential and Deviations from the Bank Parcel Development Package As presented in Table 1, as-built mitigation totals from the survey measurements for Appendix A were found to be slightly lower than in the BPDP, as summarized in the following table: Table 7 – BPDP vs. As-Built Mitigation Totals Credit Type BPDP Total As-Built Total Nitrogen (lb/30 yr) 180.453 180.433 Phosphorus (lb/30 yr) 5.682 5.682 Buffer (ft2) 515,085.635 515,036.495 Accounting for the 40% of credit releases that have already occurred at Bandit Farms, 0.008 lb/30 yr of nitrogen credits and 19.656 ft2 of buffer credits will be subtracted from the as-built credit release request following receipt of as-built report approval. This will ensure that the released credits match up with the as-built totals found in Table 7. 5. Monitoring Protocol and Success Criteria 5.1 Monitoring Installation Eleven 10-meter by 10-meter monitoring plots were installed at the surveyed locations shown in Figure 3 and Appendix A. The plot corners were marked with t-posts, and planted stems were marked with pin flags. The southwest corner in each plot had an 8-foot PVC pipe and flagging attached to it for improved visibility. 5.2 Success Criteria Per the MBI, a minimum of 260 native tree and shrub species must be present after five years of monitoring. Per Table 6, a minimum of four native hardwood tree and shrub species were planted, and no one species was greater than 50% of the planted stems. Native hardwood tree volunteer species taller than 10 centimeters may be included during monitoring to meet performance standards as determined by the DWR. 6. Financial Assurance and Long-Term Management Financial assurance and Parcel maintenance will be conducted in accordance with the MBI. 6.1 Financial Assurance The Gray Casualty & Surety Company, Inc. (Gray) issued a performance bond for the penal sum of $150,000 on December 6, 2023 to cover Parcel planting. When the as-built report is approved, the performance bond will be terminated and a monitoring bond for the penal sum of $100,000 will be issued to cover monitoring year 1. Each year the penal sum amount will be reduced by $20,000 when the bond is renewed. A monitoring bond will be in place until monitoring year 5 is conducted and the Parcel Closeout Report is approved by DEQ. Bandit Farms As-Built Report Upper New Hope Subwatershed of Jordan Lake 10 October 2024 6.2 Parcel Maintenance If the Parcel or a specific component of the Parcel fails to achieve the success criteria outlined in the BPDP and Section 5.2, adaptive measures will be developed and appropriate remedial actions will be implemented. Maintenance will be performed to correct problems on the Parcel that have a high likelihood of affecting project success. Such items include, but are not limited to, fire, flooding, drought, or insects that cause excess tree mortality. Implemented actions will be designed to achieve the success criteria and will include a work schedule and updated monitoring criteria. An herbicide application schedule may need to be implemented in the first few years of tree establishment in the riparian restoration areas to prevent establishment of invasive species that may out-compete the planted native vegetation. The only herbicides used on the Parcel will be aquatic- approved herbicides that will be applied in accordance with North Carolina Department of Agriculture rules and regulations (NCFS, 2010). The easement boundary will be checked annually as part of monitoring activities. Easement boundary conditions as well as maintenance performed will be reported in the annual monitoring reports to DWR. If mowing inside the riparian preservation areas within Zone 1 and Zone 2 of the Jordan Water Supply buffers is deemed necessary by the Sponsor during the monitoring period, the Sponsor must notify DWR prior to conducting mowing activities to ensure that no buffer violations occur. Mowing inside the riparian restoration areas during the Parcel monitoring period to promote planting establishment was deemed allowable maintenance in the BPDP. 7. Year 0 Baseline Monitoring Results As documented in the Year 0 Baseline Monitoring Data provided as Appendix B, native hardwood tree and shrub species were planted at an average density of 526 stems per acre, sufficient to meet the success criteria of 260 stems per acre after five years. Black walnut stems were not included in stem density totals. The minimum stem density of 405 stems per acre occurred in plot MP-05 (Figure 3). The maximum stem density of 648 stems per acre occurred in plot MP-01 (Figure 3). Privet and tree of heaven mortality was observed to be widespread during as-built monitoring. There is one other issue on site regarding black walnut planting, I went back to review the Plan for this project and black walnut is not an approved tree on the list in the Plan. DWR made a comment about this during initial Plan review that you acknowledged. Due to its allelopathic properties, this tree cannot be counted towards this site’s success criteria. Do not plant black walnut for the upcoming supplemental planting on site. That was not according to plan. It appears that the planting contractor included that in the planting mix despite it not being listed as approved in my contract with them. The other 11 species in their planted mix were on the approved BPDP list. Looking at the monitoring data there is 1 black walnut individual in 3 of the plots; the As-Built Notice indicates that 450 stems were planted on the site, for 6% of the total. Given that black walnut occurs naturally on the site, I like the idea of leaving them in the ground and perhaps supplemental planting if monitoring indicates survival issues in the 3 plots that have them. Glad to discuss it further associated with the As-Built Report. Complete planting of 60 trees in 4,800 SF area east of Stream C2 (see figure) that was missed during planting. Ripple EcoSolutions proposed to complete this work by 4/19/24, and then confirmed in writing that it was completed. In a subsequent site inspection on May 30th, I found the trees had not been planted. George Morris, Ripple's owner, has committed to re-planting this area, but we are now entering the hottest portion of the growing season. Ideally we would conduct this planting in the November 2024 - January 2025 timeframe. I've attached a current photo of the area from May 30th for reference. 2. Remove vineyard construction encroachment on the west side of Stream B2 (see figure). The planted trees were not disturbed by the encroachment. The landowner completed this vineyard row removal June 11th, 2024, as shown in the attached photograph. I added an additional easement t-post and sign to mark the boundary more clearly as it enters the woodline. The photo is taken looking north from this new t-post to the next boundary marker. 3. Add signage every 200-feet at the stream's edge along Stream A and Morgan Creek where they serve as the easement boundary. This work was completed May 30th, 2024, and representative photos are attached. I'll look forward to discussing #1 with you in more detail. It is highly recommended to plant during the November 2024-January 2025 timeline for survivability and avoiding extra replanting if stems do not survive.
