Ste. 200 Asheville, N.C. 28803 Attn: Debra Green Dear Ms. Green: Haywood County has reviewed the Erosion and Sedimentation Control Plan submitted by you for the project known as "Wildbrook Village Phase III (Lots)." We have found the plan to be acceptable with the attached modification. These modifications as put forth by Haywood County require you to incorporate them as part of your development plan for this property. If your land-disturbing activity involves the utilization of ditches for the purpose of de-watering or lowering the water table, you must notify the Director of the Division of Water Resources for the state of North Carolina and forward that office a copy of your Erosion and Sediment Control Plan. Please be advised that per the Erosion and Sediment Control Ordinance, you are required to keep a copy of the approved erosion and sediment control plan at the job site. The approval of your erosion and sediment control plan is conditioned on your compliance with federal and state water quality laws, regulations and rules. If your land-disturbing activity involves any activity regulated by another agency, you are required to notify that office and provide them with a copy of your erosion and sediment control plan for their review and comment. If changes must be made to your erosion and sediment control plan as a result of more restrictive requirements from another regulatory agency, you must submit a copy of a revised erosion and sediment control plan for your project to this office for approval before you commence land- disturbing activity on areas of your project with required changes. According to the FINANCIAL RESPONSIBILITY/OWNERSHIP FORM, you are listed as the person responsible for this land disturbing activity. Even though you may contract someone to implement and maintain your erosion and sediment control plan, it is your responsibility to see that the requirements of the approved plan and the Ordinance are met. You are responsible for insuring that sediment stays on your site and that any permanent control measures succeed. Any additional land-disturbing activity beyond the approved limits must have a plan approved by the County and have a valid land-disturbing permit before any work begins outside the approved limits. Please be advised that measures may only be installed within the boundary of your tract. Approval of your plan does not give you permission to perform work in a shared right-of-way or upon property owned by others. It is your responsibility to obtain permission from all subject property owners if you intend to perform work in a shared right-of-way or upon property you do not own. If your work is subject to impacting state classified trout waters, it is your responsibility to install adequate measures to control turbidities to acceptable levels. Please be advised that installation of culverts in streams, creeks, branches, spring runs, etc. requires permission from the U.S Army Corps of Engineers (404 Permit) and also NCDENR Division of Water Quality (401 Certification) for impacts to federal and state jurisdictional areas. The telephone number for the Corps is 828-271-7980 in Asheville, and the number for DWQ is 828- 296-4500. We strongly advise you to plan your development activity so as to effectively consider possible negative impacts to property below your project from sediment damage and to courteously plan for permanent impacts to property below your project from increased volumes and velocities of runoff. As the person responsible for this development activity, accountability rests with you to phase all aspects of the land-disturbing activity within compliant timeframes. It is your responsibility to coordinate trenching and installation of utility lines to coincide within compliant timeframes for the establishment of ground cover on disturbed areas. Page 1 "As of April 1, 2019,all new construction activities are required to complete and submit an electronic Notice of Intent(eNOI) form requesting a Certificate of Coverage (COC) under the NCG010000 Construction General Permit. After the form is reviewed and found to be complete, you will receive a link with payment instructions for the applicable annual permit fee. After the fee is processed,you will receive the COC via email. As the Financially Responsible Party shown on the FRO form submitted for this project,you MUST obtain the COC prior to commencement of any land disturbing activity. The eNOI form and fee details may be accessed at deq.nc.gov/NCG01. Please direct questions about the eNOI form to the Stormwater Program staff in the Raleigh central office. If the owner/operator of this project changes in the future,the new responsible party must obtain a new COC. :" Title 15A NCAC 4B.0118(a) and the NCGO1 permit require that the following documentation be kept on file at the job site: 1.The approved E&SC plan as well as any approved deviation. 2. The NCGO1 permit and the COC,once it is received. 3. Records of inspections made during the previous 30 days. Please consider this letter as giving the notice required by the SPCA and the Ordinance of the County's right of periodic inspection to ensure compliance. The Haywood County Erosion and Sediment Control Ordinance is a performance- oriented program requiring protection of the natural resources and adjoining properties. If, following commencement of this project, it is determined that your plan as modified is inadequate, Haywood County may require further revisions to your plan and its implementation. You are required to inform this office of your starting date for land-disturbing activity. As per §154.74(C)(1)(a) of the Ordinance, you have the right to appeal our decision to modify your plan to the Haywood County Sediment Control Board, if you so choose. Temporary or permanent groundcover must be established by 21 calendar days of completing any phase of grading (not 21 working days). 3 Site is subject to NPDES General Permit. Check with The North Carolina Department of Water Resources for regulations for post-construction storm water management.
