future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. If the violations are of a continuing nature, not related to operation and/or maintenance problems,
and you anticipate remedial construction activities, then you may wish to consider applying for a Special Order by

Honestly besides the heavy rainfall I don't know. I do know that when we opened the sample bottle container that the
seals were already broken on the bottles and there was no paperwork which was unusual. I did let Sarah Graham know
of this issue.

Basically, if the water was really stirred up when discharged or the if sample was collected prior to flushing out the
outfall. Honestly though, it wasn't a much of an exceedance and could be an outlier. Since this seems to be the first
time it's happened, I not that worried about it. Again, I am just checking to see if there is anything on your end that
provide an explanation.
Also, we had historically high levels of rainfall in February. Is that something that could result in an
increase to TSS?
We had an exceedance of our stormwater total suspended solids limit in February. Can you think of
anything out of the ordinary for that sample? I need to add an explanation for the exceedance to the
February DMR.

A review of past TSS concentrations in stormwater discharged from the facility indicates this is the first TSS
exceedance (see attached graph of stormwater TSS concentrations vs. time).
The most recent discharge (April 7, 2021) had a TSS concentration of 6.0 mg/L which indicates the TSS
concentration has returned to expected levels.
On-site personnel stated there was historically high levels of rainfall in February 2021. A review of weather data
indicates there was approximately 1.7 inches of rainfall in the area between February 1 - February 8, 2021.
On-site personnel stated: "when we opened the sample bottle container the seals on the sample bottles were
broken and there was no paperwork which was unusual" (see attached 3/15/2021 from Ben Smith). Based on
this statement, it seems possible that the TSS sample bottle could have been contaminated with dust or some
other foreign matter.

Thank you for taking my call earlier this morning. This email is Zenith Energy's response to the Notice of Violation letter
(Tracking Number NOV-2021-LV-0241) received April 19, 2021 for a solids, total suspended (TSS) permit level
exceedance associated with stormwater discharged on February 8, 2021 from Zenith Energy's Selma, North Carolina
facility. An investigation conducted by Zenith Energy when the analytical results associated with the February 8th
discharge were received concluded the exceedance was most likely an anomaly, caused by historically heavy rainfall
prior to the February 8th stormwater discharge, or caused by an issue with the sample bottles. The reasons for this
conclusion are:

The secondary containment area is slightly sloped towards a discharge pipe in the southwest corner.
When enough water is standing, a raised pipe inside the secondary containment area is manually
lowered via a hand-crank, and the water travels through the pipe and is discharged on the other side
of the fence into a ditch in a wooded area. Water in the containment area often infiltrates or
evaporates and eliminates the need for frequent discharges. The hand-crank is tested monthly.

The facility consists of two oil/water separators, a product holding tanks, and a 12,000-gallon
Petroleum Contact Water (PCW) tank. Water that is collected at the covered loading rack area flows
through two oil/water separators. Any oil captured from the oil/water separators flows to the
product holding tank behind the main office, which is regularly pumped and treated offsite by
Hepaco. The water captured from the oil/water separator flows to the PCW tank which is

On July 1, 2021 Jason Robinson of the Raleigh Regional Office (RRO) conducted a compliance
evaluation inspection of the subject facility located at 29999 W Oak Street, Selma. The assistance
provided by Mr. Ben Smith, terminal manager was appreciated. Below is a list of findings developed
from the inspection:
1. The most recent permit became effective on December 1, 2018 and expires on March 31, 2023.
2. The facility consists of two oil/water separators, a product holding tanks, and a 12,000-gallon
Petroleum Contact Water (PCW) tank. Water that is collected at the covered loading rack area flows
through two oil/water separators. Any oil captured from the oil/water separators flows to the product
holding tank behind the main office, which is regularly pumped and treated offsite by Hepaco. The
water captured from the oil/water separator flows to the PCW tank which is underground in the tank
secondary containment area. The PCW tank is also pumped and treated offsite. Several pumps are
located in the tanks secondary containment area, but are separated by a berm. A pump is present to
pump any water that collects in the pump area to the secondary containment area.
3. The secondary containment area is slightly sloped towards a discharge pipe inside the southwest
corner of the containment area. When enough water is standing, the raised discharge pipe is
manually lowered via a hand-crank, and the water travels through the pipe and is discharged on the
other side of the fence into a ditch in a wooded area. Water in the containment area often
infiltrates/evaporates and eliminates the need for frequent discharges. The hand-crank is tested
monthly.
