This situation was first identified as part of a routine compliance inspection in February 2017, as a possible compliance issue, based on the permit requirements for grassed swales and limited piping under driveways. However, per .1003(2)(c) of the stormwater rules, a minimal amount of non- vegetated conveyances are allowed for erosion protection. After observing the construction, the Division does not consider this a compliance issue. However, such additions and changes to the stormwater system are best addressed before the changes are made by submitting the revised plans as a minor modification for review and approval by the Division. This determination should NOT be considered carte blanche to begin wholesale piping of swales or the widespread installation of rip rap in the swales. Piping and rip ran should be used judiciously, and only where erosion issues cannot be resolved by grading or vegetation/sodding. The Division notes that the permit for Phase IV, SW8 100203, is still in the name of the developer, Britt Development Co. of Archdale, LLC. PO Box 1688 Newport, NC 28570 Subject: NOTICE OF INSPECTION Gracelyn Park Subdivision Permit No. SW8 041006 Carteret County Dear Ms. Moore: On February 1, 2017, Brian Lambe of the Wilmington Regional Office of the Department of Energy, Land, and Mineral Resouces inspected Gracelyn Park Subdivision in Newport, Carteret County to determine compliance with Stormwater Management Permit Number SW8 041006 issued on October 15, 2004. DWQ file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit. Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter. Please be advised that you are required to comply with the terms, conditions and limitations of your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H .1003 and North Carolina General Statute 143-214.7, including operation and maintenance of your permitted stormwater system. The inspection revealed piping at the end of swale #12 that reached into a wetland ditch. The low density permit only allows for piping for driveways and access to lots. Swale #10 had a rip rap apron installed on the end extending into the wetland ditch. The permit requires all conveyance to be grass lined. Please provide details of the repairs and changes to this office. If the project has changed name, ownership or mailing address, a formal change of name/ownership form must be submitted to DWQ within 30 calendar days detailing the change. As long as he is a couple a feet above the curb outlet swale base,then he should be fine.The swale that looks like most of the bulk heading that has taken place, is outside of the stormwater system and most likely in the drainage ditch. Based on what I have seen there is not a violation and will not require a permit modification. Just be sure to keep this email for the future reference in your stormwater file,and I will put this email in our file.
