The two sets of 4" pvc pipe have been installed in the west end of the DA4 Infiltration basin in the paver parking lot and
under the end of lot pavers(we lifted two rows)and thence under the sand access road around the west side tennis
court. This morning I staked IB3 & IBS. We are hoping to start excavating these two 1'depth sand infiltration basins
starting on Monday.
I'd send pictures, but I was bouncing e-mails this afternoon. Glad yours made it through this morning. I have 29 gb of e-
mails, mostly with large drawings and pictures, and I hate to get rid of any. Every so often I am forced to free up space,
and today is that day again.
It should only be two-three days to properly dig and shape the 3:1 side slopes.

I am reviewing the schedule of compliance that was received on June 1, 2022 for the subject project.Almost everything
looks good to go, however,the provided schedule of compliance did not include a timeline for completing the actions
that will be taken to resolve the compliance issues.This timeline is needed in order to proceed with the schedule of
compliance. Can you please provide a timeline for completing the actions discussed in the schedule of compliance?A
timeline can be emailed to me and I will print and include with the schedule.
Being such a potentially minor item, I am hopeful that this will have a quick turnaround, and as such, I am beginning to
draft the permit so that it is ready to go as soon as the timeline is received. In the meantime,please let me know if you
have any questions.

Permit Transfer-Plan of Action for new permittee,the Bald Head Island Club.
Per the May 16, DEMLR Request for Additional Information, Bald Head Island Club has asked me to
provide the following answers and timeline for Stormwater Permit SW8-070801 Swans Quarter due to its
August 30, 2021 purchase of the 3.25 acre property from Bald Head Island Limited, LLC. See Below:
Plan of Action:
I. The Bald Head Island Club has retained ESP & Associates, Surveyors to do an entirely new
site/topographic survey for this project. We have been opn a waiting list to get this
completed, and a fresh drawing in NAD 1983. All of the original sitework and permit
drawings are in NAD 27, which has about a 90' difference in space. Simultaneously, the
Bald Head Island Club has engaged an Architect and Site Planning Firm on long term goals
of adding tennis courts and possibly a new Clubhouse. In a big organization, this takes lots
of steps and member and board approvals. So I still don't know what the finish layout
wants to be. And for CAMA purposes, I do not want to give up any of the permitted
buildings at this time until we have that new layout. I have talked to the Club Landscape
crew manager, and he does have time in the next 3 weeks, i.e. prior to the 4th of July
weekend, to construct an infiltration basin to provide the overflow volume of basins 3, 4 &
5. I will provide this new basin with two 4" sch 40 pvc equalization pipes to it, and submit
the Plan Modification and Review Fee as soon as I get the new base drawing in cad format
from ESP.
II. Once my drawing is updated, we will record a new O&M to the Brunswick County Register of
Deeds for Recording.
III. Per Above Item #1, I will be submitting a Plan Revision/Modification once I get the new survey
drawing in NAD 83. We don't want to have old work creep into this new drawing. Note
that the paver paring lot has not been asked to be partially pervious surface, as we do not
knows in the long term what the Club will want/can afford. I prefer to keep this lot as 100%
impervious, even though it is really not.

Dear Mr. Paul and Mr. Sawyer:
The Wilmington Regional Office of the Division of Energy,Mineral and Land Resources(DEMLR)received and
accepted a signed Permit Transfer Application Form for the subject project on November 14.2021 with additional
information requested on February 21,2022 and received on March 8,2022. The current and proposed permittees
have requested to transfer the permit in accordance with 15A NCAC 02H.1045(1)(a).A preliminary in-depth
review of the documentation submitted with the transfer request determined that the application is incomplete and
that additional information is needed.
The transfer was submitted under NCAC 02H.1045(1)(a) and the proposed permittee selected the option in
Section F of the application form where they agree to be the entity responsible for addressing any compliance
issues. To continue the review and processing of this transfer request,please provide the following documentation
in a single,hard copy submittal package to complete the application and demonstrate compliance with the
permit:
1) As noted in the February 21,2022 letter, on January 26,2022,the Wilmington Regional Office of the
Division of Energy,Mineral and Land Resources(DEMLR) inspected the subject project to determine the
status of compliance with this permit,most recently issued on August 6,2020.DEMLR file review and
site inspection revealed that the site is not in compliance with the terms and conditions of this permit. A
copy of the completed form entitled"Compliance Inspection Report" summarizing the findings of the
recent inspection is attached to this letter.A response letter containing a plan of action was received on
March 8,2022,however it was incomplete. Please either address the following items to demonstrate
compliance with the permit or submit a plan of action that provides a timeline in which the following
compliance issues will be resolved.
a) Permit Condition 12 and 15A NCAC 02H.1042(4)(a)effective January 1,2017:A copy of the
certification for the most recent version of the permit could not be found in the file,however part of
the project has been constructed.It is noted in the March 8,2022 response that a modification will be
submitted following this transfer in order to address other compliance issues and a new certification
will be provided.A timeframe for submitting the modification application/addressing this item,
however,was not provided.Please provide a schedule of compliance that includes a reasonable
timeframe for addressing this item.
b) Permit Condition 9.b and 15A NCAC 02H.1050(11): A copy of the recorded operation and
maintenance agreement has not been submitted.As indicated by the cited rule and permit condition,
the O&M agreement must be recorded with the County Register of Deeds. Please provide a copy of
the recorded operation and maintenance agreement or include an action item and timeline in the
schedule of compliance for addressing this item.

c) Permit Condition 4.a,6.a, 11: Infiltration Basin 3-4-5 Interconnected has not been constructed in its
entirety, as shown on the approved plans. Only the DA4 portion of the system has been constructed at
this time,however,BUA approved to drain to the DA3 and DA5 portions of the system has been
built. It is noted in the March 8,2022 response that a modification will be submitted following this
transfer in order to address this item,however,a timeframe for submitting the modification
application/addressing this item was not provided. Please revise the schedule of compliance to
include a reasonable timeframe for addressing this item.
All of the requested information listed above should be received in this Office by June 1,2022,or the application
will be returned as incomplete.Please note that only two letters requesting additional information is allowed in
the State Stormwater Program for a total of 30 days to submit the requested additional information. If the
information is not satisfactorily provided after either the second request or 30 days, the project will be returned.
If the project is returned and you wish to re-submit later,you will need to resubmit all required items at that time,
including the application fee.
Please note that if,upon review of the submitted information or upon a deficient compliance inspection of the
project,it is determined that a major modification to the permit is required to resolve the compliance issues,the
transfer application will be returned as incomplete.Upon the issuance of the modified permit,and the successful
completion of any work required by the modified permit and/or the restoration of the site to design condition,the
applicant will need to submit an updated transfer application and a new fee to the Division to start the transfer
process over again.
Please remember that the permittee is responsible for complying with the terms and conditions of the permit and
the approved plans and specifications until the Division approves the transfer request.

Bald Head Island Club has asked me to assist in the transfer of Stormwater Permit SW8-070801 Swans

Per your 1-21-22 Request for Additional Information/ Pan for Action on Non-Compliance, See below:
1. I Have updated Application E3 with the P.O. Box 3070/ 1 Salt Meadow Trail address. Note that
it is still a bit confusing, as the NC SOS is now listing Salt Meadow Trail as Southport, NC.
Southport is the 28461 area Post Office. There is a satellite Post Office on Bald Head Island also
with the28461 zip code that P.O. Box mail comes to. The post office does not deliver mail to
addresses on Bald Head Island. So the P.O. Box 3070 is the Bald Head Island Club's main P.O.
Box. I hesitate to call Salt Meadow Trail as Southport, as Salt Meadow Trail is a one block long
entry road to the Bald Head Island Club, obviously not in Southport.
2. I am including the Signed/Notarized O&M EZ form, signed by Bald Head Island Club CEO David
Sawyer.
Notice of Inspection Plan of Action:
I. Designer Certification is included for the DA4 Infiltration Basin. It acknowledges that Infiltration
Basins for DA1, 2, 6, 7 &8 have not been built as there has not been any construction yet. It
acknowledges per 1-26-22 Inspection Summary item 3, that the interconnect pipes and
basins for DA3 & DA5 have not yet been built. As you observed, the turfstone paver
parking could be submitted for partial credit. I also have been involved on Bald Head
Island long enough that once I did that, a new architect/planner/board will come in and
want a building there. I propose that once the permit transfer has occurred, I submit for a
plan modification to change DA4 to include all of the paver parking lot, and I eliminate
parking spaces B1 & Cl at the west end of the lot at the end median, and increase the
vertical sided infiltration basin size to treat all of the parking lot area. That will allow the
future tennis courts to have a clean design without piped stormwater from DA3 needing to
be included. I would then certify the completed DA4.
II. Per Above Item #2, I am including Signed/Notarized O&M EZ form, signed by Bald Head Island
Club CEO David Sawyer. _
III. Per Items 1 & I, I propose, once permit is in the Bald Head Island Club's n6me, to resubmit DA4,

3) Infiltration Basin 3-4-5 Interconnected has not been constructed in its entirety, as shown on the approved
plans. Only the DA4 portion of the system has been constructed at this time, however, BUA approved to drain to
the DA3 and DA5 portions of the system has been built. A modification has not been submitted showing that the
DA4 portion of the system receives the runoff from the entire parking lot and is able to handle that runoff as a
standalone system.

Wynd, Bald Head Island, NC from Bald Head Island Limited LLC to the Bald Head Island Club
Bald Head Island Club has asked me to assist in the transfer of Stormwater Permit SW8-070801 Swans
Quarter due to its August 30, 2021 purchase of the 3.25 acre property from Bald Head Island Limited,
LLC.
Swans Quarter was originally an1980's condominium project (Plat date 10-31-85, Map Cabinet Q,
Page 25) that wrapped around the Bald Head Island Club Tennis Courts and adjacent to it's original
"lap pool". At the time, Bald Head Island Limited owned the Bald Head Island Club. Club ownership
transferred to the Club Membership in the early 2000's. A 1994 Fire decimated the original condos.
Over the next decade, Bald Head Island Limited re-acquired ownership of the site from the individual
Condo owners, with plans to rebuild the project. The original condo construction was outside of the
CAMA AEC, and the Stormwater Division had not yet been established. The charred pile foundations
were basis for the 2007 permitting by CAMA and Stormwater. Highfill Engineering provided site
engineering and CAMA & Stormwater permitting. CAMA Major Permit is 121-07. Cothran Harris
Architects provided architectural plans, and Woods Engineering provided structural engineering I
was on "sabbatical" recovering from quadruple bypass surgery, but was involved in the project.
Project was shovel ready, sewer and water authorizations were in hand, and then the recession hit,
putting the rebuild on hold.

Bald Head Island Club 170+ acre Golf Course is to the right (multiple parcel I.D.'s). Clubhouse/pool
area is SW8-890106. In 2017, there was a Major Mod to Bald Head Island Club SW890106 for the
addition of 5 new swimming pools and the Horizons Restaurant. In 2020, the Club had a need for
additional summertime pool parking, near SW8-890106 permitted impervious area P6 & P7. An
agreement was reached with Bald Head Island Limited LLC to also put a temporary turfstone parking
lot across the property line onto Swans Quarter, approximately at SW8-070801 Buildings 3 & 4. Swans
Quarter Permit Mod was issued/stamp approved 8-6-20 per my seal date 7-14-20.

Unfortunately, Google Earth has not updated its June 14, 2019 Site Image. The pools and pool
restaurant had just opened three weeks earlier for Memorial Day Weekend 2019. Showing, in white,
the appx location of the temporary turf-stone paver golf cart overflow parking, completed in 2020.
The lower left non-jurisdictional lagoon has been filled and the temporary/modular pool bathrooms
have been removed. The entrance "road" connection to South Bald Head Wynd is appx per permit,
however the post-Hurricanes Florence, Dorian and Isaias use of the site as a FEMA mulch site clean-up
has pretty much left that portion of the site a barren flat. The area between the pools and South Bald
Head Wynd has been grassed.

Stormwater Permit SW8-070801 "treats" the water in 8 various sized infiltration basins. As part of the
temporary paver parking the original basin layouts were modified. Now with the Bald Head Island Club
purchase of Swans Quarter, there is a likelihood that the turfstone parking will become a permanent
feature. And the tennis courts may be extended westward. However, Building 6 and its intendant
Infiltration Basin 6 will probably be a Fall 2022 project.
The Stormwater Permit Transfer Application asks for Designer Certification of the completed project
and for O&M Maintenance Agreement turnover. These sections are being answered as N/A, as the
project is far from complete.
