4. According to our records, there has been no discharge from this facility during July 2004
through December 2005. All Discharge Monitoring Reports (DMR’s) for that period indicated
No Discharge. There was no analytical data to check.
3. The facility consists of 2 oil / water separators, product holding tank, and a 12,000 gallon
wastewater holding tank. Any product that leaves the covered loading rack area flows thru the
two oil water separators. Any product recovered from the oil / water separators flows to the
product holding tank and is hauled off as needed. Any water captured from the oil / water
separators flows to the wastewater holding tank in the bermed area containing 5 above ground
storage tanks. Stormwater that accumulates in the diked area is discharged into a small UT to
Mill Creek.

1. The subject permit became effective March 1, 2004 and will expire March 31, 2008. Please
ensure to apply for a permit renewal 180 days before the permit expiration date.
2. The Water Pollution Control System Operators Certification Commission has classified the
subject facility as a Grade 1 Physical / Chemical System. As required by Rule 15A NCAC 8G
.0202(2) and the subject permit, a certified grade one Physical / Chemical (PC-1) Operator in
Responsible Charge (ORC) and a back-up ORC must be designated for this system. Please
contact James Pugh at 919.733.0026, extension 341 concerning this requirement.

Facility contains two oil / water separators in series. Water flows from the last oil / water in series and to a
underground wastewater holding tank in the bermed area where 5 other above ground storage tanks are
located. When the holding tank is full, water is discharged along with any stormwater that accumulates in
the bermed area. Because this is a discharging system, facility is classified as a Physical/Chemical 1 and
requires a PC-1 ORC and back up PC-1 ORC.
There has been no discharge reported from the facility for the period July 2004 through December 2005.
The bermed area was dry and no discharge was observed.

Comment: There has been no discharge for the period July 2004 through December
2005. There was no data to analyze. I informed Mr. Williams that a PC-1 ORC and back
up PC-1 ORC is required for this facility. Water is discharged from the oil / water
separator.

This is to inform you that the Division of Water Quality has not received your monthly monitoring report
for June 2006. This is in violation of Part II, condition D(2) of the NPDES pennit, as well as 15 A NCAC
2B .506(a), which requires the submittal of Discharge Monitoring Reports no later than the twenty-eighth
(28th) day following the reporting period. Failure to submit reports as required will subject the violator to
the assessment of a civil penalty of up to $25,000 per violation. You will be considered noncompliant
with the self-monitoring requirements of your NPDES permit until the report has been submitted.
To prevent further action, please submit said report to Vanessa Manuel at the letterhead address within
fifteen (15) days of receipt of this notice.
Additionally, this letter provides notice that this office will recommend the assessment of civil penalties if
future reports are not received within the required time frame during the next twelve (12) reporting
months. The Division must take these steps because timely submittal of discharge monitoring reports is
essential to the efficient operation of our water quality programs. We appreciate your assistance in this
