A copy of the Compliance Inspection Report is enclosed for your review. Hudson Dennis, Operations Supervisor and Brian Blalock, Gas Tank Technician were also present during the inspection and their time and assistance is greatly appreciated The site visit and file review revealed that the subject facility is covered by NPDES General Stormwater Permit NCG120000 under Certificate of Coverage NCG120064. Permit coverage authorizes the discharge of stormwater from the facility to receiving waters designated as Brown Creek, class C waters, in the Yadkin River Basin(s). As a result of the inspection, the facility was found to not be in compliance with the conditions of the NCG120000 Permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES Stormwater Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. In reference to the review of the Stormwater Pollution Prevention Plan (SWPPP), the SWPPP was reviewed regarding information which was not available during the inspection on 8/9/2023. Documentation was observed that there were no spills having occurred in 2023 and that there was no presence of non-stormwater discharges from the outfalls of the Sediment Basins. The Solvent Management Plan had been updated with additional information, including a solvent management inventory. The Spill Prevention and Response Procedures (SPRP) had been modified to include the required information per the conditions of General Stormwater Permit NCG120000. The Analytical and Qualitative Monitoring records were reviewed, Since the last inspection there had been exceedances of the benchmark parameter for Fecal Coliform at Outfalls 4 and 9,putting the facility into Tier 1.The facility had not notified NCDEQ about these exceedances and will need to do so, including all required Tier 1 responses according to the General Permit NCG120000 requirements. More than 55 gallons of motor oil and/or hydraulic oil is currently being utilized by the facility per month when averaged over the calendar year. This information is still not being documented on the stormwater Discharge Monitoring Report(DMR)form.Although lab reports were reviewed which documented that quarterly Annual Monitoring had occurred, the DMRs have not been completed and uploaded quarterly as required. All Sediment Basins were inspected with no issues except for Sediment Basin 12 where gully erosion was observed on slopes adjacent to the outfall resulting in undermining of the associated riprap protection.There was no off-site erosion or sedimentation being caused by this issue. The facility is not in Compliance due to the aforementioned issues.
