Good Morning Mr.Garrow, Upon doing some research and speaking with Core & Main (Permit#NCG030461), I believe that Mueller should be considered exempt from the Tiered responses for this permit term. Core & Main is our lessee, and we share the property at 10210 Statesville Blvd with them. I have a letter addressed to Core & Main from a Zahid S. Khan (Employee of NCDEQ) dated October 6, 2021, relieving Core & Main from tiered responses for the duration of the permit. Speaking to the team over at Core & Main, my understanding is that it was determined by a representative from NCDEQ that Copper and Zinc were naturally occurring in the soil on this property, which was enough to justify the relief from tiered responses related to those materials. The letter I am referring to is attached to this email. Please review it and let us know if we can discuss getting the same exemption applied to Mueller. Good afternoon, am writing on behalf of Mueller Water Products located at 10210 Statesville Blvd., Cleveland, NC, 27013. We received the results from our 3rd quarter quantitative stormwater sampling, and it was determined that we had an exceedance of copper at outfall#2. The samples were collected by our environmental consultant, One Environmental. I've attached the lab results to this email. We are actively investigating to determine any potential causes for this sudden exceedance and rectify them as soon as possible. 2 We will be monitoring the outfall going forward and will pull a sample again this quarter. Based on past site inspections, including September 15, 2021, and email correspondence regarding copper and zinc, the facility is in compliance with the tiered response actions and other conditions of the NCG030461 Permit. Therefore, the Division is granting regulatory r"'plief from the Tier responses for another permit term. Upon receipt of this letter, the subject facility may resume the permit specified semi-annual analytical monitoring for the remainder of the current permit term which expires on June 30, 2026. This decision applies only to the copper and zinc benchmarks. A benchmark exceedance of any other parameter listed in your permit will trigger the tiered response actions as described in the general permit. You must notify this office, in writing, within five business days if you become aware of any other significant source of copper or zinc at your facility that has the potential to be exposed to stormwater. The relief granted in this letter is contingent upon the current industrial practices at the Core &Main Cleveland plant. Please retain and append this letter to your Stormwater Pollution Prevention Plan(SPPP) or permit.
