Good afternoon,
The Division of Energy, Mineral, and Land Resources (DEMLR) received a Post-Construction Stormwater
Management Permit Application for the subject project on July 17th, 2024.
15A NCAC 02H .1042(3)(c)of the North Carolina Administrative Code states that an application is considered
approved if the required response times outlined in G.S. 143-215.1 are not met, unless one of the following
exceptions applies:
i. The applicant agrees, in writing,to a longer review period.
ii. A public hearing is required for a final decision.
iii. The applicant fails to provide necessary information for the Division's review.
iv. The applicant denies the Division access to records or premises for information gathering.
As none of these exceptions were relevant to your application,SW6240704 is considered approved on August
16th, 2024, based on the aforementioned regulation (15A NCAC 02H .1042(3)(c)).
We are forwarding Permit No.SW4231201, dated August 16th, 2024,for the construction, operation and
maintenance of the built-upon areas(BUA) and vegetated conveyances or areas associated with the subject
project.This permit shall be effective from the date of issuance and shall be subject to the conditions and
Limitations as specified therein, and does not supersede any other agency permit that may be required.
The original signed permit package and approved plans are being mailed to the permittee, Pulte Home Company,

I was hoping you could send out an email saying the same thing as your voicemail, that the project is
approved and that you're working on the approval letters. I'm hoping Winston-Salem will accept that in

Good afternoon Mike and Brianna!
hope you both are making it through the crunch with staff reduction. I'm not trying to be a bother, but
we haven't heard anything back on Fiddlers Creek for a while. I believe you had mentioned that the
review time was now cut down to 30 days, which would have been 8/19. Could you let me know if this
means we have approval for this project moving forward? This is the outstanding item from getting
approval with Winston-Salem stormwater and erosion control for project approvals. Will we be able to
get an approval document to submit to the City?

With the loss of several staff members and the current workload of post-construction stormwater applications,we
generally do not have the availability for meetings.Also, due to the recently reduced statutory timeframes for

I understand that you were able to have a conversation last week with Ken Binkley with Pulte Homes
regarding Fiddlers Creek. We have the comments addressed and are ready to resubmit, but per that
conversation, would like to have a Teams call to go through and make sure we are understanding the
comments correctly and that our responses address your concerns. Could you let me know if you have
availability over the next couple of days to get this meeting in place?
Also, in the past, Jim would accept an email request for additional time to resubmit. Is that howyou all
would like to see that come in? We would like to request additional time on this project so that we can
hopefully have the meeting and make sure everything is addressed and ready to approve.

Our stormwater program is losing 3 people within last/this week. Your best bet is to call the main number at 919-

the Standard permitting process can take up to 90 calendar days to complete. You can see where this project stands in

it). Please upload all documents that you mailed into our office through the link provided below. Be sure to choose the
Central Office as the Primary Contact office.

"State Stormwater Information Uploads" section of the form. YOU MUST CLICK ON THE"ADD ANOTHER POST-
CONSTRUCTION FILE UPLOAD"TO ADD ADDITIONAL FILE TYPES TO THE SUBMISSION. Merely changing the file type
dropdown as you upload the various files (without adding additional file uploads)will upload all of the files as the last
file type selected, the submission will get flagged during review, and you will need to resubmit the files. Please do not
upload entire plan sets through this form, but rather upload the relevant individual sheets under the appropriate file

Good Afternoon,
We received additional information for your application for a new post-construction stormwater permit on 12/1/23. At
this time, the submission is not administratively complete and cannot be accepted for review in its current condition.
Please provide the following submittal items by close of business on 12/15/23 so that we may accept the project and
begin the review process, otherwise, the project will be returned as administratively incomplete.
• 2x hard copies of the Application with the following corrections made (These items are required per 15A NCAC
02H .1042(2)(a) and per Section VI, 1 of the Application):
• Section III, 4—Please provide the contact information (email address and phone number)for the local
jurisdiction for building permits.
• Section IV, 8—The percent impervious area for the project area does not appear to be calculated
correctly. Project density calculation information can be found in 15A NCAC 02H .1003(1).
• Section IV, 10—Please correct the typo made in the "total (sf)"for Drainage Area 2 in the Basin
Information Table.
• 1x original, signed & notarized hard copy of the O&M Agreement Form (This item is required per 15A NCAC 02H
.1042(2)(j) and per Sections V &VI, 3 of the Application).This form can be found on our website at the following
address: https://deg.nc.gov/about/divisions/energy-mineral-and-land-resources/stormwater/stormwater-
program/stormwater-design. Please note that a complete O&M Agreement Form will have 2 or more pages and
uses macros to generate the relevant sheets based on the information entered into the cover page. NOTE: Only
the cover page was provided, please make sure to click"load pages"to provide the additional pages specific
to the SCM type.
NOTE:As no plan sheets, notaries,or original signatures are needed,you can submit these additional items via email
so that I can print them and add them to your existing application.Thank you.

NOTE:This is an administrative completeness review, not a detailed engineering review, there may be other issues that
may be brough up during the engineering review.
If these items are received within the stipulated timeframe, we can accept the project and begin the review process.
Once accepted, reviews under the standard permitting process can take up to 90 calendar days per statute (one of our
two reviewer positions is currently vacant).

We received your application for a new post-construction stormwater permit on 11/15/23. At this time, the submission
is not administratively complete and cannot be accepted for review in its current condition. Please provide the following
submittal items within 30 calendar days (by close of business on 12/15/23) so that we may accept the project and begin
the review process, otherwise, the project will be returned as administratively incomplete.
• Please be aware that, effective October 1, 2023, the Fast-Track permitting option has been eliminated (The Fast-
Track option is still available for those projects that have filed their Fast-Track application on or before the
effective date). For this project, you will need to apply for post-construction stormwater coverage through the
Standard permitting option.
• 1x application fee check in the correct amount (this item is required per Session Law 2023-134, Section
12.14(e)(2)):
• Please be aware that, effective October 3, 2023, our permit application fee structure is as follows:
• New Permit or Major Modification for a project with one (1) or fewer SCMs=$1,000
• New Permit or Major Modification for a project with two (2) SCMs=$1,250
• New Permit or Major Modification for a project with three (3) SCMs=$1,750
• New Permit or Major Modification for a project with four(4) or more SCMs= $2,250
• Minor Modification =$250
• Renewal =$750
• Transfer=$750
• Renewal &Transfer Combination =$1,500
• General Permit=$700
• Per the submittal items, this project will require an application fee of$1750 as this application is for a
New Permit for a project with 3 SCMs. Please provide a new application fee check in this amount so that
we may process your application. NOTE: Despite being included in the transmittal letter, we did not
receive an application check.
• 2x hard copies of the Standard Process Application (This item is required per 15A NCAC 02H .1042(2)(a) and per
Section VI, 1 of the Application).
• The following errors were noted in the Fast-Track application. Please make sure to correct these items
when filling out the Standard Application.
• Section III, 2b—Please provide the contact information (email address and phone number)for
the property owner.
• 1x hard copy of the complete, original signed Supplement-EZ Form (This item is required per Sections V&VI, 3
of the Application).This form can be found on our website at the following

15A NCAC 02H .1042(2)(k), and Sections VI, 2 &VII). More information can be found on our

• 1x hard copy of official documentation showing that the Applicant is in good standing with the Secretary of State
and showing the title and position information for the signing official (These items are required per 15A NCAC
02H .1040(1), .1042(2)(b), and per Section VI, 11 of the Application).
• 2x signed &sealed hard copies of a plan sheet showing the following corrected additions:
• Signature and seals.
• Wetland delineation or a note on the plans stating that there are no wetlands located on-site.This item
is required per 15A NCAC 02H .1042(2)(g)(iii) &Section VI, 8m of the Application. Please also list the
name of the individual that made this determination in a note on the plans. NOTE:A note for non-tidal
wetlands was included in the key, but was not able to be distinguished on the plans. Please provide
clearer delineation for wetlands. (If there are no wetlands located on site, include a note on the plans
stating that there are no wetlands on site.
NOTE: Please do not resubmit plan sheets that are unnecessary for post-construction stormwater review.
Only submit the sheets in the set that are pertinent to our review.
NOTE:While not necessary for administrative completeness, the following issue may come up in technical review.There
appears to be some development proposed in the vegetated setback. Please keep in mind that no development is
allowed in the setback until it meets the requirements of G.S. 143-214.7(b2)(2).
