The revisions include: 1. Remove Lots 57 and 58 in Phase 4 as single family development lots and credit the 5,200 sf BUA per lot (10,400 sf total) to the development of the recreation center. 2. Add 22,379 sf of new built-upon area for the development of new recreation center-tennis courts, horseshoe, Bocce ball, gazebo, shuffle board, basket ball court and driveway. 3. Utilize the existing tennis court as new parking. 4. Allocate 35,329 sf to the LFPOA Park in the impervious surface listing, and adjusts the "Reserved for POA" BUA down by the difference of 11,969 sf. It has been determined that a formal permit modification is not required for the proposed changes. We are forwarding you an approved copy of the revised plans for your files. Please add the attached plans to the previously approved plan set. Please be aware that all terms and conditions of the permit issued on September 29, 2008, remain in full force and effect. Please also understand that the approval of this revision to the approved plans for the subject State Stormwater Permit is done on a case-by-case basis. Any other changes to this project must be approved through this Office prior to construction. The issuance of this plan revision does not preclude the permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction. The lots are located along Clubhouse drive within the subdivision. Lot 3 (refer to site plan) has been previously developed with a tennis court and landscaping. Lots 1 & 2 are currently undeveloped and heavily wooded with hardwoods. No wetlands have been identified on the property. The Brunswick County SCS Soil Survey indicates that the property's soils are Pactolus fine sand (PaA) and Wando loam (WaB), both these soils are poorly drained, and permeability is slow, there is an apparent high water table within 24"of the surface. Proposed Improvements The principal use of this development will be for a new tennis and basketball court and several other active recreation facilities (bocce ball, horseshoe pit, shuffle board) The existing tennis court lot will be utilized for parking and access will be from a proposed sidewalk from the existing parking lot and sidewalks from the existing tennis court/parking area. Drainage of the facilities will be sheet flow across the site. Ultimate disposal of excessive run off will be carried by the existing piping system in the existing parking lot. Existing BUA on these three lots (combined under new survey) amounts to 12,950 SF. Additional (new) BUA on this site amount to 22,379 SF for a total of 35,329 SF of BUA. Our understanding of the existing permit allows for 6,500 SF of BUA per lot(just lots 57 & 58). The Owner wishes to use the 6,500 SFlper lot and have the excess BUA subtracted from the POA's reserve included in the permit. A summary is included below. Sullins Dee Freeman Governor Director Secretary April 26, 2011 Mr. Steven Jennings 523 Genoes Point Road Supply, NC 28462 Subject: Complaint of Piping Lockwood Folly Subdivision Stormwater Project No. SW8 900225 Brunswick County Dear Mr. Jennings: The Division of Water Quality acknowledges your complaint to Ms. Kelly Johnson in the Wilmington Regional Office, regarding the installation of perforated piping between Lots 230 and 231 in the Lockwood Folly Subdivision. The Division is aware of this piping. The piping was approved as part of the September 29, 2008 permit modification which proposed to alleviate flooding in the subdivision and which approved an ownership change and subsequent transfer of the permit from the developer to the Lockwood Folly POA. The installation of this piping is not a permit violation as long as it conforms to the elevations, grades and lengths shown on the approved plans. This piping was allowed because it ultimately discharges into a golf course pond where it was judged to receive sufficient treatment prior to be being either used for irrigation or discharged. The Lockwood Folly POA must enforce compliance with the permit conditions on the lot owners, which includes a prohibition against any additional piping beyond what has already been approved. Failure to maintain compliance will subject the POA to potential enforcement action and fines. Of course, minimal driveway piping is allowed, even under the low density option. The POA must review all lot plans for compliance with the built-upon area limits and all proposed driveway piping to keep it as minimal as possible. He wants a pipe to be installed and the swale filled in.The POA attorney informed Mr. Jennings,through his attorney that;(1)the swale is not on his property,but in the POA common area road right of way,(2)the swale is required and regulated by the NCDENR Permit SW8 900225 and will remain. The reference Mr.Jennings makes to a neighbor"have added a lot of piping"is correct, (Lots 230 &231 on the C-3 project map,see attached)as indicated and approved on the C-3 project map. Proposed Improvements The principal use of this development will be for a new tennis and basketball court and several other active recreation facilities (bocce ball, horseshoe pit, shuffle board) The existing tennis court lot will be utilized for parking and access will be from a proposed sidewalk from the existing parking lot and sidewalks from the existing tennis court/parking area. The proposed recreation facilities appear to take up lots 56, 57 and 58, so it's possible to take the BUA allocations for those lots (4500 sf each = 13,500 sf) and apply it to the new recreation facilities without having to take all 20,485 sf from the POA's BUA reserve. But, without a narrative statement to that effect, I'm not sure if that is the intent of the POA or not. The current permitted POA reserve is 340,547 sf. If the total added BUA is 20,485 sf, and if 13,500 sf of that will come from the deletion of 3 lots, then the POA reserve will only need to be reduced down by 6,985 sf. Please confirm by providing supporting calculations with the narrative. Please provide a correct and accurate plan revision application.
