Based on our review of the project plans and specifications, we have determined that the project complies with the Stormwater Regulations set forth in Title 15A NCAC 2H. 1003 (a) (2) . Mr. Rawls and I spent much time going over the submittal. During our review, I discovered an omission in my calculations relative to the impervious area of a section of roadway. Before I left Mr. Rawls' office, I provided him with corrected tables. Mr. Rawls kindly agreed to continue his review, but it was understood that no action could be taken until a "formal" resubmittal was made. This letter represents said resubmittal. n_� t find three rieloacd you will find h ee items of the May 18 letter which have been revised. They are: 1. Table titled "Lockwood Folly Golf Links Land Use/Area Summary for Lands Located Within 575 Feet of Mean High Water..." 2. Table titled "Land Use/Area Summary for All Lockwood Folly Lands" 3. January 1, /988. .1)218 EXEMPTIONS FROM SURFACE WATER QUALITY STANDARDS Variances from applicable standards, revisions to water quality standards or site-specific water quality standards may be granted by the Commission on a case-by-case basis pursuant to General Statutes 143-215.3(e), 143-214.3 or 143-214.1. A listing of existing variances will be maimai.rmed and made available to the public by the Division. Exemptions established pursuant to this Rule will be reviewed as part of the Triennial Review of Water Quality Standards conducted pursuant to 4:, CFR 131.10(g). llistors' Note: Statutory Authority G.S. 143-214.1; /43-214.3; /43-215.3(e); Eff. October 1, 1989. .0219 WATER Qi ..LF1'Y MIANAGEMENT PLANS • (a) In implementing the water quality standards to protect the existing uses [as defined by Rule .0202(l6) of this Section] of the waters of the state or the water quality which supports those uses, the Commission shall develop water quality management plans on a priority basis to attain, maintain or enhance water quality throughout the state. Additional specific actions deemed necessary by the Commission to protect the water quality or the existing uses of the waters of the state will be specified in Paragraph (h) of this Rule. These actions may include anything within the powers of the Com- mission. The Commission may also consider local actions which have been taken to protect a water- body in determining the appropriate protection options to be incorporated into the water quality management plan. (b) All waters determined by the Commission to be protected by a water quality management plan are listed with specific actions as follows: (I) The I,ockwoods Folly River Arca (Lumber River Basin), which includes all waters of the lower I.ockwoods Folly River in an area extending north from the Intracoastal Waterway to a line EIINR - ENVIRONMENTAL MANAGEMENT TISA: 02R.0200 extending from Genocs Point to Mullet Creek, will be protected by the specific actions described in Subparagraphs (A) through (r) of this Rule. fop New development activities within 575' of the mean high water line which require a Sedi • - mentation Erosion Control Plan or a CAMA major development pcnnit must comply with the low density option of the coastal Stormwater Runoff Disposal Rules [as specified in I 5A NCAC 211 .1003(a)(2)I. (B) New or expanded NPDES permits will be issued only for non-domestic, non-industrial pro- cess type discharges (such as non-industrial process cooling or seafood processing discharges). • A public hearing is mandatory for any proposed (new or expanded) NPDES permit to this • protected area. (C) New non-discharge permits will be required to meet reduced loading rates and increased buffer zones, to be determined on a case-by-case basis. (D) New or expanded marinas must be located in upland basin areas. (E) No dredge or fill activities will be allowed where significant shellfish or "submerged aquatic vegetation bed resources occur, except for maintenance dredging, such as that required to maintain access to existing, channels and facilities located within the protected area or mainte- nance dredging for activities such as agriculture. 11istoty Note: Statutor Authority G.S. /43-214.1; 143-215.8A; Eff.
