Hi Jim. I tried calling but the line was busy. As I indicated yesterday it appears that all of the Merger decisions, along
with the FEIS, were based on the entire U-3109 project, not just one section or another; I confirmed that during my file
review today. Since purpose and need, alternatives, and LEDPA were all based on the entirety of the project, separating
the A section out as single and complete would be problematic. As such, project permitting should be pursued as a
phased project, with the A section based on final plans and impact calculations, and the B section based on preliminary
plans and impact estimates (not released for construction pending further Avoidance and Minimization/design).
Regarding the B section JD, for various reasons I believe that we will have to update/finalize the JD for the B section
prior to permitting. But, I'll confirm with Monte next week when he is back in the office.
Regarding site 12, I can't find anything in the file about additional streams from Greg. Forward on the info and I'll
compare with what I have.

Dave-
I hope that you had a great weekend. I apologize for bombarding you with questions related to this project, but I was
going through some of Greg's paperwork and had a few quick questions. Do you know whether this Section of the
project was determined to have independent utility? I assume that it does not, but wanted to make sure before I
proceeded with the application. If it does not, I am also assuming that we will have to do this as a phased IP and provide
preliminary impacts related to the B section. The main question that I have is related to the JD for the B Section. It
expired in 2008 and was not re-verified when the A section was in 2012. Is this an issue where we should proceed with
getting the B section re-verified?
My other question was related to 2 streams at Site 12. Per comments from the 4C meeting, Greg did a field visit to
investigate two potential stream features near the pond at Site 12. After the field visit, we determined that one was
intermittent and one was perennial. However, I cannot find any record of Greg providing this information to you. I have
told Hydro at this time to proceed with assuming that these features are jurisdictional, but wanted to know if Greg had
sent you anything about these features and, if not, whether you wanted to visit them to confirm his calls?
If you could email me back when you have an opportunity it would be much appreciated.
