Staff review of the plans and specifications has determined that the project,as proposed,will comply with the Stormwater Regulations set forth in Title 15A NCAC 21-1.1000 - 1062 rules.We are forwarding Permit No.SW3230802, dated October 28th, 2024,for the construction,operation and maintenance of the built-upon areas (BUA) and vegetated conveyances or areas associated with the subject project.This permit shall be effective from the date of issuance and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required. Jacob, From our previous comments from NCDEQ dated April, 4, 2024 the following option was presented by NCDEQ for the improvements to Green Acre Circle. However, if the BUA associated with the road widening is part of an NCDOT road, located within the NCDOT ROW, and upon completion, the project will be conveyed either to the NCDOT or another public entity and will be regulated in accordance with that entity's NPDES MS4 stormwater permit and the is constructed to NCDOT standards and is in accordance with the NCDOT Stormwater Best Management Practices Toolbox, it does not have to be considered as "off-site impervious,"if this is not the case, the BUA associated with the expansion of Green Acres Circle must be accounted for as "off-site impervious." We did not pursuit this option since we were under the impresssion the low density option would not have any issues with the Green Arces Circle improvements. Green Acres Circle is an existing State Road (SR 2478). NCDOT will have future maintenance of this road. NCDOT has approved the improvements, including the drainage, under Driveway Permit#C-1953 We will revise the calculations and the EZ form to match the attached plan. This will remove the Green Acres Circle from the permitted site area, therefore, it will not be considered "off-site impervious". Before we make another formal submittal, please let us know if this will be acceptable. Thanks. Barry M. My comment regarding the low-density portion of the project specifically refers to the use of drop/curb inlets and piped conveyance from D1-OTCB to D7-FES.As it stands,this is considered excessive piping,and is not allowed per the Low Density requirements. There are a few directions you can take to resolve this issue: 1. The excessive piping maybe removed (a minimal amount of piping for culverts underneath driveways and road crossings is permissible),and vegetated conveyances may be used to capture and convey the runoff from the low-density portions of the project. 2. The runoff collected with this pipe system may be captured and conveyed to an SCM.The drainage area and BUA accounting would need to be updated in this case,as the BUA captured and directed to the SCM would not be a part of the low-density area at that point. 3. A variance may be applied for, if neither of the above options are feasible. Please refer to 15A NCAC 02H .1003(6)for the requirements for obtaining a variance for this project. Please note that applying for a variance does not guarantee that said variance will be granted, and it must be done as a part of the next information resubmission.
