Dear Mr. Wheeler:
In the Notice of Violation and Assessment of Civil Penalty letter dated October 8, 2024, the City of Raleigh
was assessed a civil penalty for an incident related to a sanitary sewer overflow (SSO) from the Raleigh
Collection System during the month of May 2024. In an email from Carlos Perez dated October 16, 2024,
Mr. Perez requested clarification regarding conflicting information found within the subject civil penalty
assessment document.
The Assessment Factors page associated with the subject penalty assessment described an SSO incident
(incident number 202400944) that differed from the SSO incident (incident number 202400949) that
was assessed a civil penalty as reflected in Attachment A of the civil penalty assessment document. The
two incidences had different dates and spill volumes. This office inadvertently assessed a civil penalty
associated with incident number 202400949.
After reviewing the subject penalty assessment and the SSO incidents for the month of May 2024, this
office has determined that the subject civil penalty assessment case, DV-2024-0105, issued against permit
WQCS00002 did not contain accurate information and is hereby retracted.
We appreciate Mr. Perez communicating with our office about this matter and have updated our files and
