The Division of Water Resources (DWR) has performed a review of a 401 Water Quality Certification application dated
September 2, 2015 and received by DWR on February 3, 2016 for the above referenced project. The DWR has
determined that your application is incomplete and cannot be processed. The application is on-hold until the following
information is received:
1.Impact Justification (Avoidance and Minimization): Please illustrate or explain why the proposed parking area
cannot be moved or reconfigured to the east of the tributary to avoid and minimize jurisdictional impacts. Can
a retaining wall be used to safely avoid or minimize impacts? Please revise the plans and site configuration to
avoid and minimize the stream impacts or provide a detailed explanation of why the proposed plan cannot be
practically accomplished, reduced or reconfigured to better minimize the proposed stream impacts. \[15A NCAC

2.Per Condition 13 in WQC 3890 “all culverts must be placed below the elevation of the stream bed by one foot for
all culverts with a diameter greater than 48 inches and 20 percent of the culvert diameter for culverts having a
diameter less than 48 inches.” Please revise your plans to meet this Condition or request an exemption from
this Condition and provide justification for the exemption request. \[15A NCAC 02H .0506(b)(2) and .0502(b)\]

3.Per Condition 6 of GC 3890, all work must be done “in the dry”. Therefore, dewatering methods will be
necessary to temporarily dewater the stream channel during pipe installation. Please provide a construction
sequence and associated details that illustrates the method of dewatering to be utilized at the site and the
sequence of construction events to be followed to ensure compliance with this condition. In addition, please
ensure that the location of any temporary impacts are shown on the construction drawings and clearly indicated
in a revised impact table. \[15A NCAC 02H .0502(b)(3)\]
Pursuant to Title 15A NCAC 02H .0502, the applicant shall furnish all of the above requested information for the proper
consideration of the application. If all of the requested information is not received within 30 calendar days of receipt of
this email, the DWR will be unable to approve the application and it will be returned. The return of this project will
necessitate reapplication to the DWR for approval, including a complete application package and the appropriate fee.
