The Pretreatment, Emergency Response, and Collection Systems Unit (PERCS) of the Division of Water Quality
has reviewed the Enforcement Response Plan (ERP) for the Town of Burnsville. This submission was originally
received by the Division on November 5, 2009. Additional information was requested and was received on May
21, 2010.
The review indicates that with the following observations the ERP resolves the Division's concerns expressed in
our November 19, 2009, letter and that overall the ERP is adequate and meets the requirements of 15A NCAC
02H .0905 and 40 CFR 403.8 (f)(5). Proper implementation of an ERP is also required by Section IV, C, 9. of
your NPDES permit.
1) Section 2. of the ERP does reference the local SUO sections as approved in the draft SUO submitted to
PERCS on August 15, 2007. Correspondence was sent to the Town on August 21, 2007 which requested
that Section 4.20)(2) Permit Conditions, items IV and XV be added to the SUO prior to adoption. The
SUO was adopted on November 1, 2007. Please submit an adopted copy of the SUO with the
abovementioned changes to PERCS by August 16, 2010.
The Division expects you to follow this approved ERP for all enforcement actions. Modifications to this ERP
must be approved by the Division.
