Division staff has confirmed that the subject Certificate of Coverage [issued under NPDES
General Permit NCG5000001 is no longer required. Therefore, in accordance with your request,
CoC NCG500578 is rescinded, effective immediately.
If in the future your company wishes to discharge to the State's surface waters, you must first
apply for and receive a new NPDES permit. Discharge of wastewater without a valid NPDES
permit will subject the responsible party to a civil penalty of up to $25,000 per day.

3889 Abbotts Creek Church Rd, in Kemersville, NC.
Therefore, this letter serves as our formal request to have the aforementioned permit
immediately rescinded.

If any parts, measurement frequencies or sampling requirements contained in this General Permit are
unacceptable to you, you have the right to request an individual permit by submitting an individual permit
application. Unless such demand is made, the certificate of coverage shall be final and binding.
Please take notice that this Certificate of Coverage is not transferable except after notice to the
Division. The Division may require modification or revocation and reissuance of the certificate of coverage.
Contact the Winston-Salem Regional Office prior to any sale or transfer of the permitted facility.
Regional Office staff will assist you in documenting the transfer of this CoC.
This permit does not affect the legal requirements to obtain other permits which may be required by

be clearly indicated. This includes tracing the pathway of a storm sewer to its discharge point.
➢ Authorization for representatives. If this application will be submitted by a consulting
engineer (or engineering firm), include documentation from the Permittee showing that the
consultant submitting the application has been designated an Authorized Representative of the
applicant.

filed or required to be maintained under Article 21 or regulations of the Environmental Management Commission implementing that Article, or who
falsifies, tampers with or knowingly renders inaccurate any recording or monitoring device or method required to be operated or maintained under
Article 21 or regulations of the Environmental Management Commission implementing that Article, shall be guilty of a misdemeanor punishable by
a fine not to exceed $25,000, or by imprisonment not to exceed sic months, or by both. (18 U.S.C. Section 1001 provides a punishment by a fine
of not more than $25,000 or imprisonment not more than 5 years, or both, for a similar offense.)

Concerning the use of Ancocide biocides 4210 and 4050 at MCI Worldcom near Georgetown
community, east of High Point, N. C., our review has revealed that the Ancocide biocides 4210 and 4050
should be appropriate for use at the stated dosage rates and discharge conditions. Therefore, the Division
of Water Quality grants approval to MCI Worldcom for the use of the above mentioned Ancocide
biocides in its cooling tower.
Should you plan to change to a different biocide in the future, you should contact this office and
submit the appropriate information for approval prior to the change.
If any parts, measurement frequencies or sampling requirements contained in this general permit

PART IV - EVALUATION AND RECOMMENDATIONS
The Raleigh Regional Office has reviewed the compliance
history of the facility and conducted an inspection of the
facility. The treatment facility at Deep River Elementary School
was recently upgraded in order for the facility to meet their
compliance limits for BOD and ammonia. Since the expiration of
their Special Order By Consent, the facility has been compliant
with their BOD limit, but is slowly bringing their ammonia
results near their permit limit.
The facility is well maintained, and appears to be operating

properly. The receiving stream is an unnamed tributary with zero
flow. As stated earlier in the staff report, the tributary does
not have an upstream flow. The unnamed tributary had no visible
solids or foam present, and no odor attributed to the treatment
was detected. The RRO recommends the facility be renewed
according to the basin wide permitting plan.

A letter of request for an Authorization to Construct was received on January 17, 1995 by the
Division and final plans and specifications for the subject project have been reviewed and found to be
satisfactory. Authorization is hereby granted for the construction and modification of existing facilities to
include a 1,000 gallon grease trap, a 7,500 and a 3,500 gallon septic tank in series, a 47' x 47'
recirculating sand filter, dual 3,000 gallon recirculation tanks, Perc-Rite controls, dual disc filters with
auto filter backwash, and a 20 gpm ultraviolet disinfection unit with discharge of treated wastewater into
an unnamed tributary to Copper Mine Creek.
This Authorization to Construct is issued in accordance with Part III, Paragraph A of NPDES
Permit No. NCO049115 issued July 19, 1991 and shall be subject to revocation unless the wastewater
treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No.
NC0049115.
The sludge generated from these treatment facilities must be disposed of in accordance with G.S.
143-215.1 and in a manner approved by the North Carolina Division of Environmental Management.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Raleigh Regional Office, telephone number [phone] shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in

Upon classification of the facility by the Certification Commission, the Permittee shall employ a
certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment
facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the
classification assigned to the wastewater treatment facilities by the Certification Commission. The
Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with
the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and
must properly manage and document daily operation and maintenance of the facility and must comply with
all other conditions of Title 15A, Chapter 8A, .0202. Once the facility is classified, the Permittee must
submit a letter to the Certification Commission which designates the operator in responsible charge within
thirty days after the wastewater treatment facilities are 50% complete.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
The sand media of the recirculating sand filter must comply with the Division's sand specifications.
The engineer's certification will be evidence that this certification has been met.
A leakage test shall be performed on the septic tank and recirculation tank to insure that any
exfiltration occurs at a rate which does not exceed twenty (20) gallons per twenty-four (24) hour per 1,000
gallons of tank capacity. The engineer's certification will serve as proof of compliance with this condition.
Please note that potential exists for non-compliance with winter limits with this type of a
wastewater treatment system as a result of temperature effects upon bacterial activity. Possible solutions
may include minor modification of the treatment syste by installation of a greenhouse cover over the sand
filter unit and/or performing spray application during daylight hours in the winter season.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from complying
with any and all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.

On May 6, 1993, Mr. Karl Shaffer of the Raleigh Regional
Office visited the above named school for the purpose of inspecting
construction progress on the overland flow wastewater system. Mr.
Shaffer was accompanied by Mr. James Shackleton of the Lee County
Health Department. Together, they met Mr. Ron Fincher, general
contractor, on the site. On May 26, 1993, Mr. Shaffer visited your
office and the office of Mr. Horace Nance, maintenance supervisor
for the school board, for the purpose of reviewing an approved set
of plans. Again, on June 2, 1993, Mr. Shaffer met with Mr.
Shackleton, Mr. Fincher, and Mr. Nance for a construction check.
As required by the Authorization to Construct (ATC dated
October 28, 1993), your office must maintain an approved set of
construction plans, stamped as such by this Division. Two sets of
plans were produced for Mr. Shaffer's inspection from your staff,
but neither was an approved set. This is of concern for the
Division, not only as a potential violation of the referenced ATC,
but by the fact that apparently there have been several
unauthorized changes to the approved plans. One set of changes was
requested by Dr. Barrett Kays on February 10, 1993, and responded
to by Mr. Steve Tedder, Water Quality Section Chief, on February
23, 1993. Variations in the approved plans must be reviewed and
approved by the Division to insure the best possible chance for
proper system installation and functioning.

During the construction inspections, Mr. Shaffer had concerns
with the presence of fractured bedrock at the ground surface. Pre -
permitting discussions and correspondence with Dr. Barrett Kays led
the RRO to believe that a suitable clay liner either existed on the
site, or would be brought in to adequately seal the site. Neither
of -these agreements was upheld; however, after review of the
construction plans and specifications, we realize that this
information was not included as a requirement. The contract
supervisor, Mr. Ron Fincher, has done a good job on site with the
poor existing conditions. After thorough examination of the
preparation of the subgrade, this office has determined that it
will be marginally suitable for construction to continue. No
recommendation for additional work or monitoring wells will be
required at this time.
We have reviewed your June 24, 1993 letter concerning the
March BOD violation and will recommend that stipulated penalties
will not be requested.

and final plans and specifications for the subject project have been reviewed and found to be satisfactory.
Authorization is hereby granted for the construction of a 6,000 GPD overland flow system consisting of
two existing septic tanks, two existing sand filters, the removal of an existing chlorinator, the addition of a
6,000 gallon pump tank with a 17 GPM pump and a 1,000 gallon pump tank with a 17 GPM pump, two
overland flow cells each measuring 62 feet by 65 feet with pressure distribution header and collection ditch
with inlet structure, an ozonator (minimum of 46 grams ozone per day) with 1,200 gallon baffled ozone
contact tank, a 4 inch effluent discharge pipe with flap valve and outlet structure, and all associated piping,
manholes, valves, controls, alarms, and appurtenances to serve Deep River Elementary School for the
treatment of domestic waste with discharge of treated wastewater into an unnamed tributary of Copper
Mine Creek in the Cape Fear River Basin.
The Division of Environmental Management does not agree that the technology of overland flow
treatment is a one that has been demonstrated to consistently comply with the effluent limitations as
contained in the NPDES permit for this facility. It is certainly an available technology and your consultant
has assured us that the system as proposed, will consistently meet the Lr*itations included in the NPDES
permit. Therefore, the Division is willing to allow the school board to proceed. Please be, advised.
however, the school board is responsible for any violations of the effluent li-nitations and i f the proposeA-
facility, once constructed and operational, cannot consistently meet the effluent limitations, additional
treatment facilities will be required to correct any deficiencies or to upgrade the facility after obtaining the
appropriate approvals for construction, if or when necessary.
This Authorization to Construct is issued in accordance with Part III paragraph A of NPDES
Permit No. NCO049115 issued July 19, 1991, and shall be subject to revocation unless the wastewater
treatment facilities are constructed in accordance with the conditions and limitations specified in Permit No.
NC0049115.

notification to the regional supervisor shall be made during the normal office hours from 8:00 a.m. until
5:00 p.m. on Monday through Friday, excluding State Holidays.
Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, this Authorization to Construct and the approved plans and

The Compliance Boundary, for the disposal system is specified by regulations in 15 NCAC 2L,
Classifications and Water Quality Standards applicable to the groundwater of North Carolina. An
exceedance of Groundwater Quality Standards beyond the Compliance Boundary is subject to penalty
provisions applicable under General Statute 143-215.6A. The sale of property, by the Permittee, which is
within or contiguous to the disposal system site may alter location of the Compliance Boundary.
For facilities permitted on or after December 30, 1983, the Compliance Boundary is established at
the lesser of 250 feet from the overland flow cells or 50 feet within the property boundary.
If the title to any property which may affect the location of the Compliance Boundary is changed,
the permittee shall notify the Division Director within 14 days. The Director shall then establish a modified
Compliance Boundary which will be done as a modification to the Permit.
The REVIEW BOUNDARY for the disposal system is specked by regulations in 15 NCAC 2L,
Groundwater Classifications and Standards. A REVIEW BOUNDARY is established around disposa_
systems midway between the Compliance Boundary and the perimeter of the waste disposal area. When
the concentration of any substance equals or exceeds the maximum allowable concentration of that
substance at the REVIEW BOUNDARY, as determined by monitoring, the permittee shall either (i)
demonstrate, through predictive calculations or modeling, that.natural site conditions, facility design and
operational controls will prevent a violation of standards at the Compliance Boundary; or, (ii) submit a
plan for the alteration of existing site conditions, facility design or operational controls that will prevent a
violation of standards at the Compliance Boundary, and implement that plan upon its approval by the
Director.
Any groundwater quality monitoring, as deemed necessary by the Division, shall be provided.

Upon classification of the facility by the Certification Commission, the Permittee shall employ a
certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment
facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the
classification assigned to the wastewater treatment facilities by the Certification Commission. The
Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with
the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and
must properly manage and document daily operation and maintenance of the facility and must comply with
all other conditions of Title 15A, Chapter 8A, .0202.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
The sand media of the existing sand filters must comply with the Division's sand specifications.
The engineer's certification will be evidence that this certification has been met.
A leakage test shall be performed on the septic tanks and dosing tanks to insure that any exfiltration
occurs at a rate which does not exceed twenty (20) gallons per twenty-four (24) hour per 1,000 gallons of
tank capacity. The engineer's certification will serve as proof of compliance with this condition.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this Authorization to Construct does not preclude the Permittee from complying
with any and all statutes, rules, regulations, or ordinances which may beimposed by other government
agencies (local, state, and federal) which have jurisdiction.

A letter of request for an Authorization to Construct was received October 10, 1991 by the
Division and final plans and specifications for the subject project have been reviewed and found to
be satisfactory. Authorization is hereby granted for the construction of chlorination system
consisting of a baffled 1,000 gallon chlorine contact tank and a tablet chlorinator (a Sanuril 100
model, or equal) to be added to an existing septic tank sand filter system ( following the sand filters
and before the effluent discharge) with discharge of treated wastewater into an unnamed tributary
to Copper Mine Creek, classified Class C waters.
This Authorization to Construct is issued in accordance with Part III paragraph A of
NPDES Permit No. NCO049115 issued July 19, 1991, and shall be subject to revocation unless
the wastewater treatment facilities are constructed in accordance with the conditions and limitations
specified in Permit No. NC0049115.
The sludge generated from these treatment facilities must be disposed of in accordance with
G.S. 143-215.1 and in a manner approved by the North Carolina Division of Environmental
Management
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as may be
required by this Division, such as the construction of additional or replacement wastewater
treatment or disposal facilities.
The Raleigh Regional Office, phone no. 919/ 571-4700, shall be notified at least
forty-eight (48) hours in advance of operation of the installed facilities so that an in -place
inspection can be made. Such notification to the regional supervisor shall be made during the
normal office hours from 8:00 a.m. until 5:00 p.m. on Monday through Friday, excluding State
Holidays.

Upon completion of construction and prior to operation of this permitted facility, a
certification must be received from a professional engineer certifying that the permitted facility has
been installed in accordance with the NPDES Permit, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to the Permits and Engineering Unit,
P.O. Box 29535, Raleigh, NC 27626-0535.
The subject wastewater treatment and disposal facilities shall be connected to an operational
publicly owned wastewater collection system within 180 days of its availability to the subject
facilities, if the subject wastewater treatment or disposal facilities are in noncompliance with the
terms and conditions of the NPDES permit, the Authorization to Construct, or the governing
statutes or regulations. Prior to the initiation of these connection activities, appropriate approval
must be received from this Division.

Dear Mr. Weaver,
The purpose of this letter is to provide a notification of non -renewal for the Wastewater
Certificate of Coverage (NCG500097) at the Kidde Fire Fighting facility, 141 Junny Road, Angier,
North Carolina 27501. As of July 31, 2007, the Kidde facility will no longer discharge boiler
blowdown wastewater to stormwater. The boiler blowdown has been piped to the publicly
owned treatment works (POTW) so that it no longer discharges to stormwater. No other
wastewaters currently discharge to stormwater, nor are any future processes expected to
discharge wastewater to stormwater. The Kidde facility will continue to operate under the
general stormwater permit (NCG050000) for apparel, printing, leather, and rubber facilities.

permit for petroleum contaminated groundwater remediation systems. This General Permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North
Carolina and the US Environmental Protection Agency dated December 6, 1983 and as subsequently amended.
The Certificate of Coverage previously issued to your facility is now valid under the revised General Permit for
discharges associated with groundwater remediation systems (NCG510000 - issued August 22,1996). The new General
Permit is more comprehensive, in that it covers remediation of groundwater contaminated with heavier fuels (such as
diesel, fuel oil, and kerosene) as well as gasoline contamination. Please note that the permit has three effluent

In accordance with your application for an NPDES discharge permit received January 4, 1993 by
the Division, we are herewith forwarding the subject Certificate of Coverage under the state-NPDES
general permit for groundwater remediation and one set of final approved plans and specifications.
Authorization is hereby granted for the construction and operation of a groundwater remediation system
consisting of a oil/water separator, air stripper, and carbon filtration and all associated appurtenances with
discharge of treated wastewater into an unnamed tributary to the Cape Fear River. This Certificate of
Coverage is issued pursuant to the requirements of North Carolina and the US Environmental Protection
Agency Memorandum of Agreement dated December 6, 1983 and as subsequently amended.
If any parts, measurement frequencies or sampling requirements contained in this general permit
are unacceptable to you, you have the right to submit an individual permit application and letter requesting
coverage under an individual permit. Unless such demand is made, this decision shall be final and
binding. Please take notice this permit is not transferable. Part II, E.4. addresses the requirements to be
followed in case of change of ownership or control of this discharge.
The Authorization to Construct is issued in accordance with Part III, Paragraph 2 of NPDES
Permit No. NCG510000, and shall be subject to revocation unless the wastewater treatment facilities are
constructed in accordance with the conditions and limitations specified in Permit No. NCG510000.
In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required by this
Division, such as the construction of additional or replacement wastewater treatment or disposal facilities.
The Fayetteville Regional Office, telephone number 919/486-1541, shall be notified at least forty-
eight (48) hours in advance of operation of the installed facilities so that an in -place inspection can be
made. Such notification to the regional supervisor shall be made during the normal office hours from 8:00
a.m. until 5:00 p.m. on Monday through Friday, excluding State Holidays.

Upon completion of construction and prior to operation of this permitted facility, a certification
must be received from a professional engineer certifying that the permitted facility has been installed in
accordance with the NPDES Permit, the Certificate of Coverage, this Authorization to Construct and the
approved plans and specifications. Mail the Certification to the Permits and Engineering Unit, P.O. Box
29535, Raleigh, NC 27626-0535.
A copy of the approved plans and specifications shall be maintained on file by the Permittee for the
life of the facility.
Failure to abide by the requirements contained in this Authorization to Construct may subject the
Permittee to an enforcement action by the Division of Environmental Management in accordance with
North Carolina General Statute 143-215.6A to 143-215.6C.
The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be required by the Division of Environmental
Management or permits required by the Division of Land Resources, the Coastal Area Management Act or
any Federal or Local other governmental permit that may be required.

Reference is made to the subject NPDES Permit. Staff of the NPDES Permits & Engineering
Group have confirmed that this permit should have been rescinded on issuance of NPDES Permit
No. NCO039586 on July 31, 1996. NCO026735 will be removed from our computer tracking
systems, effective immediately.
If in the future you wish to again discharge wastewater to the State's surface waters, you "oi
must first apply for and receive a new NPDES Permit. Discharging without a valid NPDES
Permit will subject the discharger to a civil penalty of up to $10,000 per day. :

This facility was discharging into Little White Oak Creek which was determined to be a
S7Q10/30Q2 = 0.0 cfs by Sanderson in 1987. She recommended removal of the discharge. In
response to this, C P & L formed a task force to scope various alternatives to this discharge. After
discussing the results of this task force with DEM staff on 1/20/93, it was decided that the WWTP
would be upgraded but not relocated. Per BPJ discussed and agreed upon in this meeting, limits
will be given as 15 mg/I (BODS) and 4 mg/I (NH3) with dechlorination (TRC limit of 28 µg/l) and
a WET test (24-hour acute P/F @90%).

ACUTE TOXICITY PASSWAIL PERMIT LIMIT (QRTRLY)
The permittee shall conduct acute toxicity tests on a quarterly basis using protocols defined in the North Carolina
Procedure Document entitled "Pass/Fail Methodology For Determining Acute Tonicity In A Single Effluent
Concentration." The monitoring shall be performed as a Fathead Minnow (Pimephales promelas 24 hour static
test, using effluent collected as a 24 hour composite. The effluent concentration at which there may be at no time
significant acute mortality is 90% (defined as treatment two in the North Carolina procedure document). Effluent
samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste
treatment. The fast test will be performed after thirty days from the effective date of this permit during the

All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGE6C.

Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in
association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity
sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will
begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will
revert to quarterly in the months specified above.
Should any test data from either these monitoring requirements or tests performed by the North Carolina Division
of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and
modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival and appropriate environmental controls, shall constitute an invalid test and will require immediate
retesting(within 30 days of initial monitoring event). Failure to submit suitable test results will constitute
noncompliance with monitoring requirements.
