Therefore, in accordance with your request, CoC NCG500578 is rescinded, effective immediately. If in the future your company wishes to discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. Discharge of wastewater without a valid NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. Since the expiration of their Special Order By Consent, the facility has been compliant with their BOD limit, but is slowly bringing their ammonia results near their permit limit. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202. Mr. Shaffer was accompanied by Mr. James Shackleton of the Lee County Health Department. Together, they met Mr. Ron Fincher, general contractor, on the site. On May 26, 1993, Mr. Shaffer visited your office and the office of Mr. Horace Nance, maintenance supervisor for the school board, for the purpose of reviewing an approved set of plans. Again, on June 2, 1993, Mr. Shaffer met with Mr. Shackleton, Mr. Fincher, and Mr. Nance for a construction check. As required by the Authorization to Construct (ATC dated October 28, 1993), your office must maintain an approved set of construction plans, stamped as such by this Division. Two sets of plans were produced for Mr. Shaffer's inspection from your staff, but neither was an approved set. This is of concern for the Division, not only as a potential violation of the referenced ATC, but by the fact that apparently there have been several unauthorized changes to the approved plans. The Compliance Boundary, for the disposal system is specified by regulations in 15 NCAC 2L, Classifications and Water Quality Standards applicable to the groundwater of North Carolina. An exceedance of Groundwater Quality Standards beyond the Compliance Boundary is subject to penalty provisions applicable under General Statute 143-215.6A. The sale of property, by the Permittee, which is within or contiguous to the disposal system site may alter location of the Compliance Boundary. For facilities permitted on or after December 30, 1983, the Compliance Boundary is established at the lesser of 250 feet from the overland flow cells or 50 feet within the property boundary. If the title to any property which may affect the location of the Compliance Boundary is changed, the permittee shall notify the Division Director within 14 days. The Director shall then establish a modified Compliance Boundary which will be done as a modification to the Permit. The REVIEW BOUNDARY for the disposal system is specked by regulations in 15 NCAC 2L, Groundwater Classifications and Standards. A REVIEW BOUNDARY is established around disposa_ systems midway between the Compliance Boundary and the perimeter of the waste disposal area. She recommended removal of the discharge. In response to this, C P & L formed a task force to scope various alternatives to this discharge. After discussing the results of this task force with DEM staff on 1/20/93, it was decided that the WWTP would be upgraded but not relocated. Per BPJ discussed and agreed upon in this meeting, limits will be given as 15 mg/I (BODS) and 4 mg/I (NH3) with dechlorination (TRC limit of 28 µg/l) and a WET test (24-hour acute P/F @90%). The monitoring shall be performed as a Fathead Minnow (Pimephales promelas 24 hour static test, using effluent collected as a 24 hour composite. The effluent concentration at which there may be at no time significant acute mortality is 90% (defined as treatment two in the North Carolina procedure document). Effluent samples for self -monitoring purposes must be obtained during representative effluent discharge below all waste treatment. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from either these monitoring requirements or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting(within 30 days of initial monitoring event).
