Please find your comments listed below with our response provided in bold. 1. 15A NCAC 02H.1019(5)(a)(i and ii): It is noted that the current version of the permit was written as greater than 'A mile from SA waters,as mentioned in the January 28, 2022 response,however,the current version of this permit was written under a previous version of the rules. The proposed modification,however,brings the site up to the 2017 Rules and as such, must meet all of the applicable rules and minimum design criteria(MDC). The provided USGS map appears to measure the %2 mile radius from SA waters (Becky's Creek/Bishops Creek, SA;HQW) only from the outfall of the pond. An SCM with any portion of its drainage area located within the SA waters boundary,however, must be designed to meet SA water requirements. Based on the provided information,as well as aerial imagery (attached for reference), it appears that a portion of the drainage area is located within '/2 mile of the surface waters. As such,this project would be subject to SA requirements. Please confirm the intended design and ensure that all applicable rules and requirements, including the SA requirements,have been met. Please ensure that any revisions are made completely and consistently throughout all affected application documents. • RESPONSE: Based on your comment,we have revised the plans,narrative, calculations,application, supplements and O&M Agreements to comply with requirements for discharging SCM's located within '/2 mile of SA waters. The following summary identifies the changes made to help guide you efficiently through the review and approval process. a. Section IV, Paragraph 1 on Page 3 of 6 of form SW11-101 has been revised to clarify that the design meets the requirements of discharging SCM's located within %mile from SA waters. b. The relevant portion of the Stormwater Design Narrative has been revised to remove reference to the site being outside of'A mile from SA waters. The development will consist of multifamily buildings, amenities, associated driveways,parking,utilities and stormwater management facilities. The proposed development is bound by Charlie Medlin Drive(existing) and Caretta Drive (proposed). The property is further identified by Pender County Tax Parcel ID 4235-36- 0239-0000 and described in Deed Book 4745 Page 1974 and Map Book 67 Page 98. Rights of use and access for Caretta Drive are described in an easement recorded in Book 4745 Page 1979. The property has an approximate latitude and longitude of 34°26'40"N,77°33' 50"W. The project is designed to be built in two phases,however,the stormwater pond permitting and BUA calculations account for the full impervious of both phases as shown on the plans with additional future impervious allocation as needed. The ground cover for the subject property is mixed with open meadow,isolated(non-404) wetlands,and woodlands. The topography of the site varies from EL. 30 to EL. 19 in the isolated wetlands. The soils consist of Onslow loamy fine sand(On) and Pits(Pt) according to the provided soils map from NRCS Web Soil Survey Map. According to the attached USGS information,the project drains to Becky's Creek(Bishops Creek)which has a stream classification of SA;HQW [18-87-8] and is within the White Oak Basin. PROPOSED IMPROVEMENTS The multi-family development will capture and treat all stormwater runoff associated with the development according to Town of Surf City and NCDEQ requirements. All stormwater runoff associated with the development will be captured within a storm drainage system that will convey the runoff to a Wet Pond Stormwater SCM. This letter, with attachments, is the report of our testing. Field Testing On January 5, 2021, ECS conducted an exploration of the subsurface soil and groundwater conditions, in accordance with the NCDEQ Stormwater Design Manual section A-2, at two requested locations shown on the attached Boring Location Plan (Figure 1). ECS used GPS equipment in order to determine the boring locations. The purpose of this exploration was to obtain subsurface information of the in situ soils for the SCM area(s). ECS explored the subsurface soil and groundwater conditions by advancing one hand auger boring into the existing ground surface at each of the requested boring locations. ECS visually classified the subsurface soils and obtained representative samples of each soil type encountered. ECS also recorded the SHWT and groundwater elevation observed at the time of the hand auger borings. The attached Infiltration Testing Form provides a summary of the subsurface conditions encountered at the hand auger boring locations. The SHWT and groundwater elevation was estimated at the boring locations below the existing grade elevation. A summary of the findings are as follows: Location SHWT Groundwater I-1 0 inches 10 inches 1-2 0 inches 4 inches ECS has conducted two infiltration tests utilizing a compact constant head permeameter near the hand auger borings in order to estimate the infiltration rate for the subsurface soils. Infiltration tests are typically conducted at two feet above the SHWT or in the most restrictive soil horizon. Tests in clayey conditions are conducted for durations of up to 30 minutes. If a more precise hydraulic conductivity value is desired for these locations, then ECS recommends collecting samples and performing laboratory permeability testing. Closure ECS's analysis of the site has been based on our understanding of the site, the project information provided to us, and the data obtained during our exploration. If the project information provided to us is changed, please contact us so that our recommendations can be reviewed and appropriate revisions provided, if necessary. The discovery of any site or subsurface conditions during construction which deviate from the data outlined in this exploration should be reported to us for our review, analysis and revision of our recommendations, if necessary. Please find your comments listed below with our response provided in bold. 1. 15A NCAC 02H.1042(2)(a)(iv), .1001(1)(c), and .1002(8): The note on plan sheets C- 2.0 and C-3.0 indicate that improvements to Charlie Medlin Drive and roundabout are proposed as part of this project,however,they do not appear to be accounted for in the application package. Furthermore, it is not clear if the runoff from the proposed multiuse path along Charlie Medlin Drive is being collected and treated. The drainage area map does not appear to include this section of the multiuse path and adequate grading information for this area is not present on the grading sheet to support that this area is being directed to the collection system. It appears that the runoff from this section of proposed multiuse path and Charlie Medlin Drive is likely draining to DI- 204 through DI-210,which bypasses the proposed SCM. Any right-of-way improvements proposed for the development of this site are considered part of the common plan of development must be included and accounted for in this project. Options for including these improvements in the application package are: a. Collect and treat the proposed built-upon area or an equal amount of existing built- upon area; or b. Demonstrate these improvements meet the requirements of a low density project per .1003(1) and.1003(2); • RESPONSE: Charlie Medlin Drive and the associated roundabout were previously constructed by the Town,not part of this project. The previous version of this permit,which was transferred to the current owner and is subject to this pending request for modification for changes to the SCM and additional on-site BUA,did not require Charlie Medlin Drive nor the roundabout to be included in the drainage area for the on-site SCM. On March 31, 2021 Kellie Norris sent an email listing the available options for proceeding with this project.The second option in that email, which was ultimately the option pursued,was to "submit a transfer to the regular program with the modification to get logged in afterwards to the regular or express program."The transfer/renewal was issued on October 18,2021 and the modification package was accepted the same day, as Kellie described, and is in my queue. I am currently reviewing projects accepted in late August. Furthermore,this modification would not have been able to be scheduled into the Express program until the transfer/renewal was approved. Due to the staffing issues the Express program is currently experiencing,there is a backlog of requests to be scheduled well into the new year. With that said,the regular program, with the accepted date of October 18,2021, is likely the quickest path forward for this project. Hopefully this thoroughly answers your question.
