This permit shall be effective from the date of issuance until September 23, 2029, and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the nature and volume of stormwater described in the application and other supporting data. 2. The subdivision is permitted for one (1) lot, allowed a maximum of 81,500 square feet of built- upon area. 3. This stormwater system has been approved for the management of stormwater runoff as described in Section 1.8 of this permit. The runoff from all built-upon area within the permitted drainage area(s) of this project must be directed into the permitted stormwater control system(s). The wet pond has been designed to handle the runoff from 334,286 square feet of impervious area. respectively. 4. The maximum built-upon area allowed for the entire subdivision is 334,286 square feet. The built-upon area available for future development onsite and within the right of way (ROVV) is 3,500 and 11,500 square feet, respectively. 5. A 50' wide vegetative buffer must be provided adjacent surface waters, measured horizontally from and perpendicular to the normal pool of impounded structures, the banks of each side of streams and rivers and the mean high water line of tidal waters. 6. A vegetated filter strip is not required for this pond as it has been designed for a 90% total suspended solids removal efficiency. No person or entity, including the permittee, shall alter any component of the approved stormwater drainage system shown on the approved plans, unless and until the Division has approved of the revised plan. 2. The permittee is responsible for the routine monitoring of the project for compliance with the built-upon area limits, grading, and the storm drainage system established by this permit, the oermit documents. and the approved plans. 3. The permittee shall review all individual proposed and modified lot plans for compliance with the conditions of this permit. The permittee shall not approve any lot plans where the maximum allowed built-upon area has been exceeded, or where revisions to the grading or to the storm drainage system are proposed unless and until a permit modification has been approved by the Division. 4. The permittee shall notify any lot owner that is found to be in noncompliance with the conditions of this permit in writing and shall require timely resolution. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 6. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built-upon surface. 7. No person or entity, including the permittee, shall alter any component shown in the approved plans and specifications. Prior to the construction of any modification to the approved plans, the permittee shall submit to the Director, and shall have received approval for modified plans, specifications, and calculations including, but not limited to, those listed below. For changes to the project or SCM that impact the certifications, a new or updated certification(s), as applicable, will be required and a copy must be submitted to the appropriate DEQ regional office upon completion of the modification. a. Any modification to the approved plans and specifications, regardless of size including the SCM(s), BUA, details, etc. b. Redesign or addition to the approved amount of BUA or to the drainage area. c. Further development, subdivision, acquisition, lease or sale of any, all or part of the project and/or property area as reported in the approved plans and specifications. d. Altering, modifying, removing, relocating, redirecting, regrading, or resizing of any component of the approved SCM(s), the stormwater collection system and/or vegetative conveyance shown on the approved plan. e. The construction of any allocated future BUA. f. The construction of any permeable pavement, #57 stone area, public trails, or landscaping material to be considered a permeable surface that were not included in the approved plans and specifications. g. Other modifications as determined by the Director. 8. All stormwater collection and treatment systems must be located in either public rights-of-way or dedicated common areas or recorded easements. The final plats for the project will be recorded showing all such required rights-of-way, common area and easements, in accordance with the approved plans. 9. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 10. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. 11 If the stormwater system was used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility_ 12. The facilities shall be constructed, operated and maintained in accordance with the provisions of this permit, the approved plans and specification, add the supporting documents attached to this permit and on file with the Division. 13. The permittee shall at all times provide the operation and maintenance necessary to assure that all components of the permitted stormwater system function at the design condition. The approved Operation and Maintenance Agreement must be followed in its entirety and maintenance must occur at the scheduled intervals. 14. Records of maintenance activities must be kept by the permittee. The records will indicate the date, activity, name of person performing the work and what actions were taken. Page 3 of 5 State Stormwater Management Systems Permit No. SW8 110804 15. The maximum built-upon area allowed for the offsite lot is 81,500 square feet. This allotted amount includes any built-upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. 16. All runoff from the built-upon areas on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters, which drain to the pond or street, grading the lot to drain toward the street or directly into the pond, or grading perimeter swales and directing them into the pond or street. 17. Each lot within the subdivision whose ownership is not retained by the permittee, must submit a separate Offsite Stormwater Management Permit application package to the Division of and receive a permit prior to any construction on the lot. 18. Prior to transfer of the permit, a file review and site inspection will be conducted by Division personnel to ensure the permit conditions have been met and that the project and the on-site stormwater system complies with the permit conditions. Any items not in compliance must be repaired, replaced restored, or resolved prior to the transfer. Records of maintenance activities performed to date may be requested. 19. Decorative spray fountains are allowed in the pond, subject to the following criteria: a. The minimum permanent pool volume is 30,000 cubic feet. b. The fountain must draw its water from less than 2' below the permanent pool surface. c. Separated units, where the nozzle, pump and intake are connected by tubing, may be used only if they draw from the surface in the deepest part of the pond. d. The fountain may not be placed into the forebay. e. The falling water from the fountain must be centered in the main pond, away from the shoreline. f. The maximum horsepower for a fountain in this pond is 3/ horsepower. III. GENERAL CONDITIONS 1. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed "Permit Transfer Application Form" (available on the Division website) accompanied by the required fee and supporting documentation as listed on the form, to the Division at least 60 days prior to any one or more of the following events: a. The sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions and protective covenants; b. The assignment or conveyance of declarant rights to another individual or entity; c. The sale or conveyance of the common areas to a Homeowner's or Property Owner's Association, subject to the requirements of NCGS 143-214.7(c2); d. Dissolution of the partnership, corporate, or LLC entity, subject to NCGS 55-14-05 or NCGS 57D-6-07 and 08; e. Bankruptcy; f. Foreclosure, subject to the requirements of Session Law 2013-121; 2. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the stormwater permit. 3. Any individual or entity found to be in noncompliance with the provisions of this stormwater management permit or the requirements of the Stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 5. In the event that the facilities fail to perform satisfactorily the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 6. The permittee grants DEQ Staff permission to enter the property during normal business hours for the purpose of inspecting the permitted stormwater management facility. 7. The permit issued shall continue in force and effect until the permittee files a request with the Division for a permit modification, transfer, renewal, or rescission; however, these actions do not stay any permit conditions. 8. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 9. Approved plans and specifications for this project are incorporated by reference and are enforceable parts of the permit. The permittee shall maintain a copy of the permit, O&M Agreements, and the approved plans at all times. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit as allowed by the laws, rules and regulations contained in Session Law 2006-246, Title 15A NCAC 2H.1000, and NCGS 143-215.1 et.al. .j. The permittee shall submit a completed "Permit Information Update Application Form" (available on the Division website) to the Division within 30 days to making any one or more of the following changes: a. A name change of the current permittee; b. A name change of the project; c. A mailing address change of the permittee; 12. A permit renewal request must be submitted at least 180 days prior to the expiration date of this permit. No portion of the wet pond should be fertilized after the initial fertilization that is required to establish the plants on the vegetated shelf. Stable groundcover will be maintained in the drainage area to reduce the sediment load to the wet pond. -If the pond must be drained for an emergency or to perform maintenance,the flushing of sediment through the emergency drain will be minimized as much as possible. At least once annually,a dam safety expert will inspect the embankment.Any problems that are found will be repaired immediately. _The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. After the wet pond is established, it will be inspected quarterly and within 24 hours after every storm event greater than 1.0 inches(or 1.5 inches if in a Coastal County). Records of operation and maintenance shall be kept in a known set location and shall be available upon request. Inspection activities shall be performed as follows. Our legal counsel had already had a conversation with Todd Roessler about Bishop Creek Apartments last month in which they discussed the available options. Based on the information provided by you and your counsel, the DEMLR Stormwater Program and our legal counsel agree that it is not possible for the Program to unilaterally and immediately revoke the current permit (which was issued to multiple entities, none of which include the current owner). In order to comply with the law, we need to take one of the paths set forth in the General Statutes and DEQ Rules (reflected in the emails from the Wilmington Regional Office staff). To reiterate,these options are: waiting for the permit to expire in September and then pursuing a new permit, pursuing a revocation of the current permit by the Director (per rules, this takes 60 days), or transferring the current permit to the new owner and then either rescinding or modifying it so that your client can pursue his plans for the property. I realize that this seems like a lot of"red tape"to achieve the goal of obtaining a new/updated permit for this project, but unfortunately these are the only options allowed by the law at this time. Going forward, we will be pursuing updates to our rules to create an easier process for these types of situations in the future. Regardless,the options that you described did not consider the following enacted legislation. Note my commentary in red. 7 § 143-214.7. Stormwater runoff rules and programs (c5) The Department may transfer a permit issued pursuant to this section without the consent of the permit holder to a successor-owner of the property on which the permitted activity is occurring or will occur as provided in this subsection: (1) The Department may transfer a permit if all of the following conditions are met: a. The successor-owner of the property submits to the Department a written request for the transfer of the permit. This can happen quickly since the successor-owner, Hudson Bishops Creek Property, LLC, is the one initiating this permitting effort. b. The Department finds all of the following: 1. The permit holder is one of the following: I. A natural person who is deceased. Richard Ray Sullivan has deceased. II. A partnership, limited liability corporation, corporation, or any other business association that has been dissolved. Bishop Creek Apartments at Surf City, LLC has been dissolved by the Sec. of State. III. A person who has been lawfully and fmally divested of title to the property on which the permitted activity is occurring or will occur. Daniel M. Medlin Trustee, Henry All.en. We ultimately want to seek a new permit or permit modification that will 8 change the amount of BUA and size and location of the pond, but the permit could be transferred as is under this law before the modification takes place if that is a better path forward. (2) The permit holder shall comply with all terms and conditions of the permit until such time as the permit is transferred. (3) The successor-owner shall comply with all terms and conditions of the permit once the permit has been transferred. (4) Notwithstanding changes to law made after the original issuance of the permit, the Department may not impose new or different terms and conditions in the permit without the prior express consent of the successor-owner. If, based on your prior email, it is easier and faster to get the prior landowners to request the rescission or transfer the permit,then I am happy to try to coordinate that effort. If not,then I believe we meet all the criteria set forth in the Law (above)for the Department to transfer the permit to the successor-owner,at which point we can just modify the permit as was our original intent. Neither the sale of the project in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the permit. • The permit issued shall continue in force and effect until revoked or terminated.The permit may be modified, revoked and reissued or terminated for cause.The filing of a request for a permit modification, revocation and re-issuance or termination does not stay any permit condition. Unfortunately, if there is no way to contact the LLC and/or the property owners listed on the permit,the only option to move forward is to transfer the permit. In order to modify SW8 110804, the applicant has to be the same as the current permittee,therefore the permit would have to be transferred. However there are other options. All options are as listed below: 1. Submit the transfer application to the regular program. If you do select to rescind SW8 110804, a second express request will be required for the rescission of SW8 110804.An Express fee of$500 at the time of rescission submittal will also be required (along with the other Express High Density New Permit fee of$4,000). The developer has been working with the Wilmington Regional Office to modify one of the permits. The current developer is trying to do the right thing by modifying the permit to address the current development plans and update owner/developer information. I'm hoping that you can help move this along—it's a timing issue. I'll give you a call later this morning to discuss. Two permits were originally issued in September 2011: o The first(SW8 110804)was for the development of the proposed apartments, parking, etc. and construction of the new stormwater pond. This permit was issued to Bishop Creek Apartments at Surf City, LLC(the former development entity,which has since been administratively dissolved by the NC Sec. of State). Because at the time of the permit this development entity only had the land under contract and was not yet the owner,the permit is also issued to the previous landowners, Mr. Richard Ray&Henry Allen Sullivan and the Daniel M. Medlin Trust and Julie Z. Medlin Trust. o The second permit(SW8 980720)covered an existing pond for the adjacent commercial center,which is sited on a parcel of land which is to be included as part of the apartment project,to be abandoned and for the stormwater from this commercial center to be collected and routed through the new pond to be constructed as part of the apartments. This permit was issued to Treasure Coast Development, Inc.,the former owner of the commercial center and the parcel on which the pond to be abandoned sits. The proposed development was recently sold. Despite requests and efforts to transfer the permits prior to closing,the permits were not transferred. The current developer recently submitted a request to the Wilmington Regional Office to modify the first permit to include changes required by the new development plan. The Wilmington Regional Office will not accept this request citing that it must come from the original permittee (now dissolved)or the original landowner(now either deceased or long since divested any interest in the property or project). 4 To process the permit modification,the Wilmington Regional Office has provided three options: • Wait for the old permit to expire,which is not until September of this year, and then proceed with the application process for a new permit in the name of the new owner(Hudson). • Have the original permittee (dissolved)or land owner(deceased, divested of interest,or unwilling to participate) request for the permit to be transferred to Hudson so they can modify the permit or rescinded such that Hudson can apply for a new permit. • Have the current developer apply for the permit to be forcibly transferred without consent of the previous permittee under the provisions of NCGS§ 143-21.4.7. Stormwater runoff rules and programs, but we have been told that this process can only be handled through the "regular" program,not the "express" program and could take a minimum of 60 days to be reviewed by staff. Regardless,the options that you described did not consider the following enacted legislation. Note my commentary in red. § 143-214.7. Stormwater runoff rules and programs (c5) The Department may transfer a permit issued pursuant to this section without the consent of the permit holder to a successor-owner of the property on which the permitted activity is occurring or will occur as provided in this subsection: (1) The Department may transfer a permit if all of the following conditions are met: a. The successor-owner of the property submits to the Department a written request for the transfer of the permit. This can happen quickly since th , successor-owner, Hudson B isbops Creek Property, LLC, is the one initiating this permitting effort. b. The Department fmds all of the following: 1. The permit holder is one of the following: I. A natural person who is deceased. Richard Ray Sullivan has deceased. II. A.partnership, limited liability corporation, corporation, or any other business association that has been dissolved. Bishop Creek Apartments at Surf City, LLC has been dissolved by the Sec. of State. 2 III. A person who has been lawfully and finally divested of title to the property on which the permitted activity is occurring or will occur. Daniel M. Medlin Trustee, Henry Allen Sullivan, and Richard Ray Sullivan Trust sold properties on which permitted activity will occur. IV. A person who has sold the property on which the permitted activity is occurring or will occur. Daniel M. Medlin, Trustee, Henry Allen Sullivan, and Richard Ray Sullivan Trust sold properties on which permitted activity will occur. 2. The successor-owner holds title to the property on which the permitted activity is occurring or will occur. Hudson Bishops Creek Property, LLC now owns all of the property on which the permitted activity will occur. 3. The successor-owner is the sole claimant of the right to engage in the permitted activity. Hudson Bishops Creek Propeity, LLC now owes all of the property on which the permitted activity W :il+ occur. 4. There will be no substantial change in the p•'witted activity. We ultimately want to seek a new permit or permit modification that will change the amount of BTU and size and location of the pond, but the permit could be transferred as is under this law before the modification takes place if that is a better path forward. (2) The permit holder shall comply with all terms and conditions of the permit until such time as the permit is transferred. (3) The successor-owner shall comply with all terms and conditions of the permit once the permit has been transferred. (4) Notwithstanding changes to law made after the original issuance of the permit, the Department may not impose new or different terms and conditions in the permit without the prior express consent of the successor-owner. If, based on your prior email,it is easier and faster to get the prior landowners to request the rescission or transfer the permit,then I am happy to try to coordinate that effort. If not,then I believe we meet all the criteria set forth in the Law (above)for the Department to transfer the permit to the successor-owner,at which point we can just modify the permit as was our original intent. This is a modification of the existing permit (SW08110804) that was for 144 units. The modification is an update to the existing 144 units and addition of 54 units. The project is within a drainage basin that drains to Becky's Creek (SA, HQW). The stormwater will be conveyed by a variety of facilities that include wet detention and level spreaders.
